Use the SEC’s crypto enforcement index to discover SEC matters, and search the CFTC’s general Press Releases index for CFTC announcements. In either case, follow the listing to the underlying complaint, order, rule, or court record before drawing conclusions: an index entry or press release is not itself proof of allegations, a final outcome, or a generally applicable rule.
Find SEC crypto enforcement actions

Open the SEC’s Enforcement Actions index, within its Cyber, Crypto Assets and Emerging Technology materials.

Look under Crypto Assets and use the action name and filing date to identify a matter. The index also has a separate Trading Suspensions section.

Open the individual matter record and any linked complaint, order, or court materials. Confirm what was alleged, the procedural status, and the outcome, if one has been reached.

Check the matter page and later SEC announcements for updates. The index says it was last reviewed or updated April 24, 2025, so it may not reflect later developments.
For broader agency materials, check the SEC’s rule pages and newsroom. For example, the SEC’s March 17, 2026 interpretive release page identifies a joint SEC-CFTC interpretation and gives its effective date as March 23, 2026.
Search CFTC crypto announcements and records

Open the CFTC’s Press Releases index.

Search by keyword—such as a company, token, or conduct—and narrow results with the visible filters for release type, release number, tag, or year.

Check the release date and number, then follow links to the underlying order, court filing, rulemaking document, or staff FAQ.

For a specific enforcement matter, use the primary record to verify the case number, filing date, agency allegations, and latest procedural status.
This is a general announcement index, not a verified, exhaustive crypto enforcement docket. The agency materials examined do not establish a single CFTC index that covers every crypto enforcement action.

Tell rules, proposals, interpretations, and FAQs apart
An agency page can point to documents with different legal status. Identify the document type and status before relying on it:

| Proposed rule or advanced notice of proposed rulemaking | A proposal or request for input, not a final rule. | Comment status and whether a later final rule has been issued. |
| Interpretation | The issuing agency’s interpretation of how law applies. | The text’s stated scope and the legal authority it discusses. |
| Staff FAQ | Staff explanation or views. | Whether the page says it is staff guidance rather than a Commission rule or action. |

For each item, record the agency, document type, issue or filing date, effective date if applicable, release or case number, current status, and the activity or parties covered. Use precise verbs supported by the record: an agency may have “filed” a complaint or “alleged” conduct; a court may have “held” something; parties may have “settled.” One case does not establish a universal classification for every crypto asset or activity.

What the 2026 SEC-CFTC interpretation says—and does not say
The SEC and CFTC issued a joint interpretation on March 17, 2026, effective March 23, 2026. The SEC page identifies the release as interpretive and notes that the CFTC provides guidance relating to it. A primary text is available in the CFTC-hosted Federal Register version.
The interpretation classifies crypto assets and discusses when an asset may be subject to an investment contract. It also addresses protocol mining, protocol staking, wrapping, and airdrops. Its own text states: “The interpretation in this release does not supersede or replace the Howey test, which is binding legal precedent.” Read it as the Commission’s interpretation and views on how aspects of that test apply—not as a replacement for the governing precedent.
Use SEC crypto FAQs with their stated limits
The SEC Division of Corporation Finance’s crypto FAQs were updated September 28, 2026. The page says the FAQs represent staff views, are not a rule or regulation, have no legal force or effect, and create no new obligations. They can help explain staff thinking, but cite the interpretation or governing law for legal propositions rather than presenting an FAQ as a binding Commission rule.
Check dates and status before relying on a listing
Listings change, and a page’s headline may not tell you whether the material is binding or final. For example, the CFTC Press Releases index listed an advanced notice of proposed rulemaking on crypto asset transactions and markets dated October 5, 2026. That is a proposal-stage request for input, not evidence that a final rule is in force. The same index listed updated FAQs concerning registrants and crypto assets dated September 24, 2026; identify their issuing office and stated status before treating them as agency action.

A search index is a route to a record; the linked record establishes what happened and the latest status you can confirm.
