Self-custody shifts security and recovery work to you, while third-party custody adds reliance on the provider’s operations, terms, and financial condition. Neither option is automatically safer or cheaper for everyone.
What Bitcoin custody means
A wallet does not contain Bitcoin itself. It stores the private keys or passcodes used to access and authorize transactions. A private key can authorize a transaction; a public key can be used to verify transactions and receive assets, but it cannot authorize one. Losing a private key can mean permanently losing access to the Bitcoin. The SEC explains these basics in its December 12, 2025 Investor Bulletin.
Self-custody
With self-custody, you control the keys and are responsible for protecting them and arranging recovery. The SEC puts it plainly: “With self-custody, you control your crypto assets and are responsible for managing the private keys to any of your crypto wallets.”
Third-party custody
With third-party custody, an exchange or another custody provider manages and controls access to the keys. This can reduce the work of personally managing keys, but access depends on the provider’s systems and account terms. The SEC warns: “If the third-party custodian is hacked, shuts down, or goes bankrupt, you may lose access to your crypto assets.”

Those quotations come from SEC staff educational materials, not rules or regulations; the 2025 bulletin says it has no legal force or effect.
How the risks and responsibilities differ

This is a risk-allocation decision, not a universal safety ranking. The SEC describes risks on both sides, but does not establish that one approach is always safer or less expensive.
Hot and cold wallets are a separate choice
“Hot” and “cold” describe a wallet’s connection and storage method; “self-custody” and “third-party custody” describe who controls the keys. Either custody model can use hot storage, cold storage, or a combination.

Hot wallets
A hot wallet is connected to the internet. The SEC says this can make transactions convenient, while increasing exposure to cyberthreats.

Cold wallets
A cold wallet is typically an offline physical device. It is generally more secure from cyberthreats than a hot wallet, but less convenient for transactions. A cold device can still be lost, damaged, or stolen, potentially causing permanent loss of access. Hardware can have a purchase cost; no universal device price is established in the SEC bulletin.
Plan for recovery before choosing self-custody
A seed phrase—also called a seed recovery phrase or mnemonic phrase—can restore a wallet if a key is lost or wallet hardware or software is damaged. It is part of the wallet’s recovery plan, not a substitute for protecting the keys.

- Store the seed phrase securely and never share it, as the SEC advises.
- Consider what happens if your device is lost, damaged, or unavailable, and whether you can still access the recovery information.
- Understand that a backup does not help if it is lost, exposed, or unusable. No particular backup product or material is guaranteed to eliminate those risks.
Questions to ask before trusting a custodian
Do not assume that an exchange account works like a personal wallet. Before depositing Bitcoin, read the provider’s terms and investigate how it safeguards assets and what happens if its business or systems fail.
- Background and regulation: What is the provider’s history, and what regulation applies to this service in your jurisdiction?
- Key access and storage: Where and how are keys stored? Who can access them, and does the provider use hot storage, cold storage, or both?
- Failure and withdrawals: What do the account agreement and applicable law say about withdrawals, restrictions, insolvency, or a shutdown?
- Asset handling: Are customer assets commingled, lent, or used as collateral (sometimes called rehypothecation)?
- Insurance: What exactly is covered, by whom, under which conditions, and what is excluded? Verify the actual policy or terms rather than relying on a general claim.
- Privacy: How does the provider protect personal information?
- Financial disclosures: If it publishes proof of reserves, what does that evidence establish—and what does it leave out?
The SEC’s March 23, 2023 Investor Alert cautions that proof of reserves may be only a point-in-time snapshot. It may not show liabilities or how assets are used between snapshots, and it is not as rigorous or comprehensive as an audit of financial statements. A proof-of-reserves claim alone does not establish that customers can recover assets in insolvency.
Protections available to some registered securities intermediaries should not be assumed to apply to every crypto exchange or custodian. The outcome depends on the jurisdiction, provider, asset, and account agreement. Verify the protections that apply to your specific account rather than assuming insurance, segregation, or recovery is guaranteed.

Compare the complete cost schedules
Self-custody costs
The SEC says cold-wallet physical devices typically cost money, while hot wallets may initially be free. Wallet transactions typically involve fees. The bulletin gives no universal hardware price or transaction-fee amount, so estimate costs using the wallet and transactions you actually expect to use.
Third-party custody costs
Ask the provider for its complete fee schedule. Check the recurring asset-based fee, transaction fees, fees to transfer Bitcoin out, and any account setup or closure charges. Compare those actual terms against your expected account balance and transaction pattern; the available SEC materials do not support a blanket claim that either custody model costs less.

A spot Bitcoin ETP is an adjacent option for price exposure, not a form of direct Bitcoin custody. The SEC describes these products as exchange-traded commodity trusts that hold Bitcoin and seek to provide exposure to its price without requiring investors to invest directly in the underlying asset. Buying ETP shares does not give you direct control of Bitcoin wallet keys.

An ETP may avoid some direct risks of transacting on a crypto platform or managing wallet keys, but it has its own costs and risks. The SEC says spot Bitcoin ETPs generally charge a sponsor fee for operating expenses; that fee reduces the Bitcoin represented by shares over time. ETP shares can also deviate from Bitcoin’s price. These products are not registered as investment companies under the Investment Company Act of 1940, even when a product name or public discussion calls one an ETF. See the SEC’s September 9, 2024 Investor Bulletin for details.
ETPs do not remove Bitcoin market risk. In that same September 9, 2024 bulletin, the SEC described Bitcoin as highly speculative and volatile, including when accessed through an ETP.
How to decide which approach fits
Ask yourself whether you are comfortable setting up and maintaining a wallet, protecting the keys and recovery phrase, and bearing responsibility for access. If you prefer a provider to manage key access, assess that provider’s terms, asset handling, security, failure arrangements, and full fee schedule before relying on it. If you want Bitcoin price exposure without directly managing wallet keys, consider whether an ETP’s structure, fees, and risks fit your needs—while recognizing that it is not direct Bitcoin ownership.
