There is no universal way to opt out of a video game’s arbitration clause. Find the exact agreement for the game, account, console, or online service you use, then follow its deadline, delivery method, and notice requirements. The examples below are from official US-facing or North American terms reviewed on October 7, 2026; rules and terms can differ by region and may change.

Before sending anything, find the agreement that applies

A game publisher, console maker, and online service can each have separate terms. Opting out of one agreement does not necessarily opt you out of the others. Open the current terms from the game, account, console, or service involved, and locate its arbitration section. Record the agreement name and version, along with when you accepted it, first used the product, or purchased it.

For the agreement you are checking, identify these details before drafting a notice:

  • The deadline and the event that starts it: for example, signup, acceptance, purchase, or first use.
  • The required delivery channel and exact recipient.
  • Every required identifier, statement, signature, and other formality.
  • What the opt-out changes—and whether a class action waiver or another arbitration agreement remains in effect.

Examples of opt-out instructions in current terms

These examples apply only to the agreements named here. Check the live terms before relying on a deadline, address, or email.

Agreement Deadline and trigger Notice method and required details Scope
Epic Games Terms of Service 30 days after first signing up for Epic’s Licensed Products. For later material changes, the terms allow an opt-out within 30 days after notice of the change. Mail a written notice titled “Arbitration Opt-Out Notice” to the address in the terms. Include the end user’s full name, Epic Games Account, email address, a clear opt-out statement, and signature. A parent or guardian may act for a minor. The opt-out covers binding individual arbitration, not Epic’s class action waiver. It is prospective and does not undo an earlier arbitration agreement. US PlayStation Terms of Service 30 days from accepting the agreement, unless applicable law requires a longer period. Mail written notification to Sony’s specified San Mateo address. Include your name, address, PlayStation Services online ID if you have one, and a clear statement that you do not wish to resolve disputes with a Sony Entity through arbitration. Nintendo Switch 2 User Agreement 30 days after purchasing the console. Send written notice to Nintendo of America at the address in the agreement. Include each person’s name and contact information, the applicable console serial number(s), and a purchase receipt if applicable. This instruction is specific to the cited Switch 2 agreement, not a general Nintendo game opt-out rule. See Nintendo’s Switch 2 User Agreement.
Activision Terms of Use 30 days after purchasing the Product, or, if there was no purchase, 30 days after first accessing or using the Product and agreeing to the terms. Email legalaffairs@activision.com with the subject “Arbitration Opt-Out.” The cited notice opts out of the arbitration agreement and class action waiver provisions in Section 4. Xbox App Terms of Use For US users, the app terms describe a 60-day informal resolution process followed by binding individual arbitration. The app page refers to a separate complete arbitration agreement and does not provide enough detail by itself to establish an opt-out route. Check the linked agreement and terms for the particular Xbox product. Do not assume an opt-out exists—or that it does not. See Xbox App Terms of Use.

How to prepare and send a compliant notice

  1. Open the relevant current terms. Use the agreement for the particular publisher, game, account, console, or service—not a notice template found for a different company.
  2. Find the opt-out paragraph. Note the triggering event and calculate the deadline from that event. A 30-day period can start at different times in different agreements.
  3. Copy the requirements into a checklist. Confirm the recipient, delivery channel, exact subject or notice title, identifiers, statement, and signature requirements. Use the address or email in the applicable terms.
  4. Draft the notice to match those requirements. State clearly that you are opting out, and include every required detail. There is no universal template that can be assumed to satisfy every agreement.
  5. Send it within the stated period and keep records. Retain a copy of the notice and contemporaneous evidence of when and how you sent it. Recordkeeping is practical advice; the agreements reviewed do not prescribe a particular proof-of-mailing product or service.

What an opt-out does not necessarily change

Read the scope language carefully. Epic expressly separates its individual arbitration requirement from its class action waiver. Activision’s cited notice covers both its arbitration agreement and class action waiver provisions in Section 4. PlayStation states that opting out does not affect a different arbitration agreement already binding the user. An opt-out should not be treated as undoing an agreement that was already binding unless the applicable terms or legal advice establish that result.

When the instructions or deadline are unclear

The examples above do not establish a rule for every country, publisher, game, or older contract. The PlayStation terms cited are for the US, Nintendo’s cited agreement is North American and specific to Switch 2, and Activision’s applicable terms may vary by region. If your deadline may be close, prioritize the agreement that governs your product rather than researching unrelated terms.
