Under the Export Administration Regulations (EAR), some unclassified software or technology is treated as “published” and outside the EAR when it is available to the public without restrictions on further dissemination. But the rule has exceptions, encryption is treated separately, and sharing controlled material with a foreign person can trigger deemed-export or deemed-reexport rules.
Does publishing code on a public repository count as an export?
It can make some unclassified software or technology “published” under EAR § 734.7, which says that it is not subject to the EAR when made available to the public without restrictions on further dissemination. BIS identifies public libraries and websites as examples of public availability. A public GitHub repository may fit that concept, but the platform or an open-source license alone does not establish that every file, feature, or related activity qualifies.
The relevant question is what is being made available and under what conditions. Consider the exact code and technology, whether they are classified, whether recipients can further disseminate them, and whether a specific EAR exception applies. Publication does not erase separate end-use, end-user, or destination restrictions.
How do different release methods affect the analysis?

Why is encryption treated differently?
Encryption source code and object code can remain subject to the EAR even when related code is open source. BIS distinguishes publicly available open-source code from a separate item that incorporates or calls that code. An item is not automatically publicly available just because one of its components is.

Depending on the item and circumstances, an encryption release may require classification, notification, access controls, use of a license exception, or a BIS authorization. License Exception ENC has destination and recipient limits, including restrictions involving Country Groups E:1 and E:2. Do not assume that an ordinary open-source release process satisfies those requirements; determine which encryption provisions apply to the specific code and distribution.
When does contributor access become a deemed export?
Under the EAR, releasing controlled technology or source code to a foreign person in the United States can be a deemed export to that person’s most recent country of citizenship or permanent residency. If controlled technology or source code is released in one foreign country to a national of another foreign country, BIS describes that as a deemed reexport. The fact that access is for collaboration rather than a download does not, by itself, settle whether a release occurred.

For a project handling controlled material, map more than the main repository. Review access to private issues and discussions, build and deployment systems, documentation, support channels, and other places where the technology or source code may be exposed. Determine which contributors can see controlled material and whether the relevant release is authorized.

Yes. EAR Parts 740 and 744 include restrictions that can apply independently of whether code is publicly available or a license exception might otherwise appear relevant. Part 744 includes controls on specified military end uses and military end users, including controls involving certain microprocessors and associated software and technology. Screen the recipient and intended use as well as the destination; do not treat public release as a substitute for checking applicable restrictions.

How should a maintainer assess a release?
- Inventory the release. Identify the exact technology, source code, object code, model, documentation, or service involved. Separate components that may have different classifications or controls.
- Assess publication. Determine whether the material is unclassified and genuinely available to the public without restrictions on further dissemination, as described in EAR § 734.7.
- Check exceptions. Review the applicable provisions in EAR Part 734, including the separate treatment of encryption and the provisions for firearm-production technology or software.
- Review contributor access. Determine whether a foreign person could receive a release of controlled technology or source code, including through private repositories, discussions, or project systems. Assess deemed-export and deemed-reexport implications where applicable.
- Screen parties and uses. Check the destination, end user, and end use against applicable requirements in Parts 740 and 744.
- Record the decision. Document the classification and the basis for any publication treatment, notification, access control, license exception, or license decision. Where the facts or applicable requirements are unclear, consult BIS or qualified export-control counsel.
