TikTok and its parent company, ByteDance, agreed in August 2026 to a $400 million U.S. settlement over allegations involving children’s privacy. The settlement is not a court finding that TikTok violated the law: the Justice Department says the claims were allegations and that liability was not determined. Nor did DOJ call it a record fine. The case matters because it describes what the government alleged about children under 13 using TikTok and explains what COPPA requires of covered services.
What did TikTok allegedly do?
In a 2024 complaint, the Federal Trade Commission and Justice Department alleged that children under 13 used regular TikTok accounts, got past the service’s age-screening process, and had personal information collected without the parental notice and consent required by the Children’s Online Privacy Protection Act (COPPA). The agencies also alleged problems involving advertising, the child-focused Kids Mode, profiling, and requests to delete children’s information. These were allegations in the case, not findings after a trial. The 2024 DOJ announcement and the FTC announcement describe the complaint.
The complaint placed the allegations in the context of TikTok’s reach: it said the service had more than 170 million U.S. users as of 2024. It also cited survey figures that two-thirds of U.S. teens reported using TikTok in 2022 and nearly half used it multiple times a day by late 2023. Those figures are complaint context, not findings that those users were children under 13 or that the settlement established misconduct. DOJ’s complaint announcement supplies the figures.
Was TikTok fined, and was it a record?
On August 21, 2026, DOJ announced a $400 million settlement resolving the U.S. claims against TikTok and ByteDance. The department says $300 million is payable immediately and the remaining $100 million is conditional on entry of an order vacating the Musical.ly consent decree. DOJ characterizes the settlement as one of the largest COPPA recoveries, not as a record. It also explicitly says the claims were allegations and there was no determination of liability. The “record fine” wording comes from an earlier case and needs a date and agency attached to it. In 2019, the FTC described the $5.7 million Musical.ly settlement as the largest civil penalty it had obtained in a children’s privacy case at that time. That 2019 characterization does not make the 2026 settlement a record, and the two amounts arose in different legal contexts.

What does COPPA protect?
COPPA is a U.S. federal law concerning the online collection of personal information from children under 13. It applies to child-directed online services and to general-audience services when they have actual knowledge that they are collecting personal information from a child under 13. Under FTC guidance, covered services must give parents notice and obtain verifiable parental consent before collecting, using, or disclosing a child’s personal information.

Parents have rights under the rule to review their child’s information, withdraw consent, and request deletion. The FTC’s COPPA guidance for businesses explains the requirements and parental rights. COPPA does not mean every service used by a child is automatically covered in the same way; coverage depends on whether the service is child-directed or has the required knowledge about the user’s age.

What can parents do?
- Review the account and privacy settings. Check the child’s profile, available safety and privacy controls, and what information the service says it collects.
- Use parental rights where applicable. If a service is covered by COPPA, parents may seek to review their child’s information, withdraw consent, or request deletion.
- Report a suspected violation. The FTC directs consumers to ReportFraud.ftc.gov to report suspected violations.
