Duke Energy Carolinas and North Carolina Public Staff reached a settlement in the utility’s North Carolina rate case on July 17, 2026. It would raise rates if approved and add customer protections, but the available settlement materials do not show that it created a separate data-center tariff or settled how all costs for very large power users should be allocated. The North Carolina Utilities Commission (NCUC) must make the final decision.

What the Duke Energy Carolinas settlement covers

The agreement is part of Duke Energy Carolinas’ (DEC) 2025 rate case before the NCUC, Docket E-7 Sub 1329. Public Staff is the state agency that represents utility customers in regulatory proceedings. Duke announced the comprehensive settlement with Public Staff and other stakeholders on July 17, 2026; its SEC-filed case summary describes the rate-case terms. Both sources make clear that the agreement is subject to commission review.

The settlement resolved remaining revenue-requirement issues in a case that initially sought about a 15.0% increase in retail revenues over two years, or roughly $1.002 billion, according to Duke’s SEC-filed summary. Its financial terms include a 9.8% return on equity and a 53% equity component in the capital structure. Those are regulatory-finance figures, not percentages by which an individual household’s bill will rise.

The same filing describes an approximately $25.7 billion North Carolina retail rate base for the historic base case and approximately $3.8 billion in capital for the multiyear rate plan. These are case and investment figures, not direct bill estimates.

How to read the different rate-increase figures

The reported percentages describe different measures and should not be treated as interchangeable. Duke’s headline is an average annual increase across two years; Axios reported separate figures for residential customers and for all customers.

The available reports do not provide an independent calculation of the effect on a particular customer’s bill. Axios attributed a typical-bill illustration to a Duke spokesperson: a $157.15 monthly residential bill would rise by $6.53 in year one and a further $4.66 in year two. Treat that as the spokesperson’s illustration, not a personalized bill forecast.

Did the settlement create a data-center tariff?

The available documents do not establish that it did. Duke’s SEC-filed summary of an earlier partial stipulation listed customer growth and related large-load plant allocation, large-load interconnection facilities and contributions in aid of construction, and a large-load tariff among issues not resolved at that stage. Axios reported after the comprehensive settlement that the parties had agreed to continue expedited discussions about a tariff that could apply to data centers. Continued discussion is not the same as an adopted tariff.

That distinction matters because a tariff would set rules for how a category of customers is charged, while a rate-case settlement can resolve other elements of the utility’s revenue requirement without settling every question about very large new loads. The materials here do not specify a final allocation rule for all data-center-related costs.

What customer protections and assistance are included

  • Infrastructure-delay refund rider: Duke’s announcement says the multiyear-rate-plan rider would return money with interest if planned infrastructure upgrades are late.
  • Low-income assistance and weatherization: Duke said shareholders would contribute $10 million toward these programs.
  • Belews Creek reliability upgrades: Duke said federal funding would reduce customer costs associated with the upgrades.

These are provisions or outcomes Duke described in its July 17 settlement announcement. The refund rider is tied to delays in planned upgrades; it is not described as a general refund mechanism for data-center costs.

What Duke says about large-customer contracts

In a separate July 23, 2026 announcement of its Customer Protection Plus framework, Duke said large-customer agreements can include customer-funded connection costs, long-term commitments, upfront financial security, termination charges, and temporary curtailment during limited grid events. Duke CEO Harry Sideris characterized the company’s position this way: “Duke Energy remains laser-focused on ensuring data centers not only pay their fair share but also yield savings for our existing customers.”

That statement and framework describe Duke’s broader approach; they are not findings by the NCUC and are not shown to be terms adopted by the July rate-case settlement. The announcement also does not establish that every listed contract provision applies uniformly to every North Carolina data center.

Who joined the agreement, and when could rates change?

Duke’s July 17 announcement named Carolina Industrial Group for Fair Utility Rates, Carolina Utility Customers Association, North Carolina Sustainable Energy Association, and Walmart among the other settlement parties, and said additional parties were expected to join. Axios reported Microsoft among the signatories.

The NCUC retains authority to approve, reject, or otherwise act on the agreement. Duke said the new rates would take effect January 1, 2027 if approved. Its SEC filing said it expected an order in November 2026, but the material available as of October 7, 2026 does not establish that a final commission order had been issued. Approval and effective dates can change; the NCUC docket is the authoritative place to check the case status.

The SEC-filed summary also says parties agreed to evaluate delaying DEC’s next base-rate filing until no earlier than November 1, 2028, conditional on NCUC deferral treatment for certain new generating assets. That is a conditional evaluation, not a guaranteed pause in rate cases through that date.
