Before replacing an AI vendor, verify that the new service can handle your real work, that your data and integrations can move as needed, and that the contract, security controls, and regulatory responsibilities support the change. Then test the replacement in a controlled rollout with a workable rollback plan.
First, define what “AI vendor” means in your case
An AI vendor might provide a model or API, an application built on a model, or a cloud or data-processing service that hosts or handles AI workloads. A change to one layer is not necessarily a change to the others. Identify which service is changing, who provides each layer, and who inside your organization owns it before comparing alternatives.
Check these areas before choosing a replacement
Scope, owners, and dependencies
List each affected use case, the incumbent model and application, its business and technical owners, the user groups involved, and the applicable risk classification. Map the dependencies that make the service work:
- API calls, model versions, prompts, structured-output requirements, and tool calls
- Retrieval indexes, embeddings, fine-tunes, guardrails, and evaluation sets
- Logging, downstream applications, integrations, and operational workflows
Distinguish a model replacement from a change to the surrounding application or cloud environment. That determines which components need to be rebuilt, retested, or separately migrated.

Task quality and failure behavior
Do not assume a similar interface or API means equivalent behavior. Build a representative test set from real business tasks, using appropriate privacy protections, and run the incumbent and candidate against the same inputs. Compare task completion and answer quality as well as errors, edge cases, adversarial inputs, latency, availability, and cost under expected demand. NIST’s ARIA resources distinguish model testing, red-teaming, and field testing as evaluation levels; a benchmark alone does not replace a limited pilot in the workflows that matter.
Data handling, security, and responsible use
Review how the candidate handles submitted data, retention and deletion, access controls, training or reuse, incident notification, and data-region or residency requirements. Confirm that its security controls and supporting evidence fit your organization’s risk profile. Consider confidentiality, intellectual property, and trade-secret restrictions when deciding what can be transferred or used in tests.

Map potential harms and impacts across the AI lifecycle, and assign responsibility for monitoring after the change. The OECD’s 2026 Due Diligence Guidance for Responsible AI addresses responsible-business-conduct due diligence for enterprises involved in AI use and development.
Portability and interoperability
Ask the incumbent exactly what data and metadata it can export, in which machine-readable formats, and when. Ask the destination provider which formats, integrations, and configuration it accepts. Treat prompts, embeddings, indexes, model configurations, fine-tunes, and outputs as separate portability questions: a general data export does not establish that each will transfer or work unchanged.

For covered data-processing services in the EU, the Data Act establishes switching measures and contract transparency requirements. The European Commission says switching charges, including egress charges, are to be removed from 12 January 2027. During the transition from 11 January 2024 through 12 January 2027, covered providers may charge costs incurred in relation to switching and egress. - Termination notice, early-termination terms, and service-continuity provisions
- Data return, deletion, retention, transition assistance, and export timing
- Charges for egress, transfer, or migration, including how they are calculated
- Intellectual property, confidentiality, liability, and audit rights
Confirm who will help with the transition, how long both services can remain available, and what happens to stored data after termination.
Operational fit and adoption effort
Compare the replacement’s model and API capabilities, expected availability and latency, documentation, compliance support, and integration requirements against your needs. Estimate the engineering work to adapt prompts, outputs, retrieval, tools, monitoring, and user workflows. Include the time needed to update user instructions and support processes; lower usage cost may not mean lower total migration effort.

- Set acceptance criteria. Agree in advance on task-quality thresholds, unacceptable failure modes, performance expectations, and the conditions required for production use.
- Test the same work on both services. Use representative tasks and edge cases, then include adversarial testing and a limited real-world pilot. Record results by workflow so that a strong average does not conceal a critical failure.
- Validate the destination environment. Test integrations, output formats, access controls, monitoring, and downstream applications with the actual destination configuration. Adapt and retest workflows rather than assuming they transfer unchanged.
- Stage the cutover. Where feasible, use a parallel run or phased rollout. Keep the incumbent available until critical workflows pass acceptance checks, and define rollback triggers before routing production work to the replacement.
- Assign post-cutover ownership. Update documentation, incident ownership, user guidance, and support processes. Monitor performance and issues after launch, with named owners and a route to escalate problems.
Recheck legal duties for the system and your role
Regulatory duties can depend on the use case, system category, jurisdiction, and whether your organization is acting as a provider, deployer, or another actor in the AI value chain. For EU general-purpose AI, Commission guidance describes information and documentation that providers must make available to downstream AI system providers, including technical integration requirements and information about capabilities and limitations. The EU AI Act also contains provisions concerning changes to certain high-risk AI systems and cooperation between an initial provider and a new provider in specified circumstances. Check the Commission’s GPAI guidance and the consolidated AI Act text against your specific system and role; these sources do not make every vendor change subject to the same obligations.
