A finance director in local government leads the council’s financial stewardship and advises on its financial decisions. The role covers far more than accounting: it includes budget and reserve advice, financial controls, audit and risk arrangements, and statutory action when serious legal or financial tests are met. The exact statutory title depends on where the authority is in the UK.

What does a finance director do in local government?

“Finance director” is an organizational job title, not a single statutory designation used identically across the UK. In England and Wales, the role is commonly associated with the chief finance officer (CFO), also known as the section 151 officer. Scotland uses the section 95 officer designation, and Northern Ireland uses a chief finance officer under its section 54 framework. For an English or Welsh council, section 151 of the Local Government Act 1972 requires the authority to arrange for the proper administration of its financial affairs and to assign responsibility for that administration to one of its officers. The CFO is therefore a senior adviser and safeguard for the council’s financial administration—not simply the person who prepares accounts.

What are the finance director’s main responsibilities?

Advising on budgets and reserves

The CFO advises members on the financial implications of budgets and decisions. Councils must set a balanced budget. When council tax is set, the section 151 officer reports on whether the budget estimates are robust and whether proposed reserves are adequate; elected members must have regard to that report. Monitoring affordability and financial sustainability

The CFO monitors whether the authority can meet its financial commitments and must report when relevant statutory conditions indicate that expenditure, including proposed expenditure, is likely to exceed available resources. Borrowing must be affordable, and councils must have regard to applicable statutory codes when borrowing or investing. The role is thus concerned with the financial consequences of decisions over time, not only whether an individual transaction is recorded correctly.

Maintaining controls, accounts, audit and risk arrangements

The CFO’s financial leadership supports the authority’s arrangements for sound internal control and risk management, effective internal audit, and annual accounts that are subject to external audit. These arrangements help the council demonstrate that public money is managed regularly and accountably.

Assuring the use of grants and public funds

For specified education grants, Department for Education guidance says the section 151 officer arranges local financial and management controls and provides assurance that grants are used for their intended purposes, including through annual submissions. Government grant frameworks also describe CFO checks related to governance, procurement, conflicts of interest, counter-fraud and risk. How does the finance director fit into council governance?

The CFO is one of local government’s three high-profile statutory officers, alongside the head of paid service and the monitoring officer. The Local Government Association calls this grouping the “Golden Triangle.” Each officer has distinct responsibilities; they are expected to advise clearly and impartially, work together on concerns, and preserve independent challenge. The finance director advises and safeguards financial administration, but does not automatically make every policy or spending decision. Decisions are made through the council’s governance arrangements. Members retain their decision-making role while having regard to specified CFO advice, including the report on budget estimates and reserves.

What is a section 114 report?

A section 114 report is an exceptional statutory escalation, not a routine budget update. In England and Wales, the section 151 officer must issue a report when relevant legal conditions are met, including specified unlawful expenditure or likely expenditure exceeding available resources. It signals a serious concern requiring formal consideration by the authority. MHCLG’s 2026 statement describes the reporting framework.

After a section 114 notice, full council must meet within 21 days to consider it. In the case of an unbalanced-budget notice, the authority is prohibited during that period from entering into new agreements involving expenditure. The deadline and restriction are procedural consequences of the notice, not evidence that every financial concern automatically triggers one.
