Under the federal Fair Labor Standards Act (FLSA), an employer generally does not need your approval before correcting a timecard—but the record must accurately show the hours you actually worked. Federal recordkeeping rules do not expressly make employee approval a prerequisite to edits. State or local law, a collective bargaining agreement, or your employer’s written policy may add procedures.

What federal law requires

For employees covered by the FLSA’s minimum-wage and overtime provisions, employers must keep accurate information about hours worked and wages earned. The regulation requires records of “Hours worked each workday and total hours worked each workweek.” (U.S. Department of Labor Fact Sheet #21; 29 CFR 516.2.)

The federal materials do not state a general rule requiring an employee to approve a correction before the employer changes its records. That conclusion is an inference from the recordkeeping rules and the Department of Labor’s explanation that employers may choose their timekeeping method; it is not a universal rule about every workplace. The key federal requirement is accuracy: an edit cannot lawfully make the record misstate hours actually worked.

Employers can choose a timekeeping method

The Department of Labor says employers may use a time clock, a timekeeper, or hours entered by employees. “Any timekeeping plan is acceptable as long as it is complete and accurate.” That flexibility does not authorize deleting work time from the record.

Fixed schedules have a limited exception

If you work a fixed schedule and follow it, your employer may keep the usual schedule instead of recording your hours every day. If you work more or less than scheduled, the record must show the exact hours worked each day and week. The Department of Labor describes this as exception reporting.

When a timecard edit is a problem

A correction may be appropriate when it fixes a mistake—for example, a missed punch that is corrected to reflect the time you were present. A change that removes hours you actually worked can make the employer’s records inaccurate and may affect minimum-wage or overtime pay. Whether a particular edit violates the law depends on the facts, including your coverage, hours, pay, and the evidence available. A changed timecard alone does not establish that a crime occurred or determine what remedy applies.

What to do if you disagree with a change

  1. Write down your hours. Keep a dated personal record of start and end times, meal breaks, and any work performed outside your scheduled hours. The Department of Labor recommends tracking your hours and provides a free timesheet app and printable work-hours calendar.
  2. Save supporting records. Keep relevant schedules, time-punch records, messages about the edit, and pay statements. Save copies or screenshots when available.
  3. Ask for the change in writing. Contact your supervisor or payroll department, identify the date and hours in dispute, and ask what was changed and why. If the revised record is wrong, request a correction and retain the response.
  4. Check the rules that apply to your workplace. Review your employer’s timekeeping policy and any collective bargaining agreement. State and local requirements may also provide additional procedures; the federal rule alone does not resolve those questions.
  5. Consider contacting the Department of Labor. The Department’s worker information page includes information about filing a Wage and Hour Division complaint. Whether to file, and what claims may apply, depends on your circumstances.

How long time records must be kept

The Department of Labor says employers generally must retain payroll records for at least three years. Records used to calculate wages—including time cards—must generally be kept for two years. These are federal retention periods; they do not guarantee that a worker can access every record through a particular process.

Why your location and workplace rules matter

This is the federal baseline, not a ruling on a particular timecard dispute. State or local law, a written employer policy, or a collective bargaining agreement may set additional requirements for changes, notice, access, or dispute procedures. The federal sources cited here do not establish which additional rules apply without knowing your work location and workplace arrangements.
