Before a data center is approved, ask local officials what decision is pending, who has authority over each part of it, and where residents can review the project’s evidence. Then ask for project-specific answers on electricity, water, land use, neighborhood effects, public costs and benefits, safety, and enforceable commitments. The approval sequence and local authority vary by jurisdiction and project.

Start with the decision and the project record

What decision is pending, and who can make it?

Ask officials to identify each action under consideration: for example, a rezoning, special exception, site plan, building permit, utility or substation review, or incentive decision. Ask which body decides each part, what approvals remain, and which matters are controlled by the municipality, state agencies, or utilities.

This distinction matters because local land-use authority does not necessarily cover every project effect. Michigan’s data-center guidance, for example, distinguishes state regulation of matters such as electric service, water withdrawals, air emissions, and wastewater from local authority over land use and community impacts. Pennsylvania’s Data Center Planning Toolkit is likewise framed around the roles local governments actually have.

What exactly is proposed, and what is still uncertain?

Request the site boundaries, proposed scale, construction and operating timelines, intended end user or tenant if known, and the infrastructure the project would need. Ask officials to identify which details are binding commitments and which are estimates or conceptual plans.

If information is confidential, ask what is being withheld, the reason and duration for withholding it, and what meaningful project information will be public before land-use, utility, or incentive decisions. The University of Iowa Hubbell Environmental Law Initiative’s Iowa Data Center Decision Tool raises the importance of narrowly tailored confidentiality and public information before final decisions.

Ask how electricity demand and its costs will be handled

Ask the applicant or relevant utility to provide expected and peak electricity demand, when the demand would begin, the planned power sources, and the transmission, substation, or other upgrades required. Ask how reliability will be maintained and who will pay for each upgrade.

Two useful questions are: “Will this raise local water or electricity rates?” and “Do residents pay the cost of increased energy demand by data centers?” The second is a heading in a Fairfax County FAQ; the City of Page uses the first question in its FAQ. Treat both as questions to investigate, not as answers that apply everywhere.

Fairfax County says residents do not directly pay for the electricity data centers use, but may bear a portion of infrastructure improvement costs needed to support increased demand. That is the county’s explanation of its own context, not a universal rule for other utilities, rate structures, or jurisdictions. Michigan’s guidance identifies electricity cost and reliability as recurring community concerns.

Ask about water, wastewater, and site fit

What water will the project use?

Request projected water withdrawals and consumption by source and season, cooling-system details, drought contingencies, and plans for wastewater and stormwater. Ask which permits or utility-capacity analyses apply and whether those analyses account for other demands on the same supplies or systems. Michigan identifies water use and environmental effects as recurring questions; Pennsylvania’s toolkit includes water among the infrastructure capacities local governments may need to evaluate.

Does the site fit adopted plans and zoning?

Ask which land-use approvals are required, how the proposed use fits adopted plans and zoning, and how the site relates to nearby homes and other uses. Request the applicable standards for setbacks, screening, lighting, and building design, and ask whether the application seeks exceptions or changes to those standards.

Fairfax County describes local standards that can include noise studies, visual screening, design requirements, and minimum distances; hearing requirements depend there on project size and location. These are examples of one county’s process, not rules that apply in every community.

Ask what neighbors will hear and experience

Request a qualified noise study that describes the equipment and operating conditions assessed, including nighttime conditions, backup generators, relevant low-frequency sound, and cumulative effects. Ask officials to explain which limits would apply and how they would be measured.

Also ask whether the approval would require post-construction testing, ongoing monitoring, public reporting, a complaint-response process, and corrective action if limits are exceeded. The Iowa decision tool raises measurable dBA and low-frequency dBC standards and post-construction testing or reporting as possible standards. Fairfax County describes noise studies as part of its local review. Neither source establishes a nationwide noise limit.

A handheld sound-level meter can help a resident note when or where a sound is noticeable, but a consumer reading is not a regulatory measurement and does not replace a qualified study or enforceable standard.

Ask how construction, emergencies, and operations will be managed

Request the proposed construction hours and traffic plan, emergency access arrangements, fire-protection planning, hazardous-materials information, stormwater controls, and details about backup energy systems. Ask who will serve as the named operational contact after the facility opens and what recurring operational reports, if any, will be required.

The Iowa decision tool identifies construction hours, emergency access, hazardous materials, stormwater, and post-construction testing or reporting among possible standards. Ask which of these issues are addressed in this application and which conditions would be enforceable; the tool does not establish that every locality has authority to impose every standard.

Ask for the net public value, not just the headline investment

Request separate figures for temporary construction jobs and permanent jobs, local hiring, wages, projected tax payments, tax abatements or other incentives, added public-service demand, infrastructure costs, and long-term obligations. Ask what assumptions and time period each estimate uses and who will verify results.

Pennsylvania’s toolkit includes fiscal and economic impacts, and Michigan lists jobs and taxes among common community questions. An announced investment amount is not, by itself, a measure of net public benefit: compare expected public revenues and specific benefits with incentives, public costs, and obligations over the same period.

Ask what promises are enforceable and how the public can respond

What happens if a promised benefit is not delivered?

For every proposed benefit or mitigation measure, ask who is party to the agreement, what exactly is due and when, how progress will be reported, who verifies compliance, and what remedy follows if the commitment is missed. Distinguish public statements from obligations written into an agreement or approval condition.

Pennsylvania’s GRID Requirements page describes binding developer commitments in that state’s permitting context. It should not be read as proof that every municipality has the same authority or can impose the same requirements.

When can residents see evidence and comment?

Ask when application materials and technical reports will be public, when comments are due, how officials will respond to them, and whether hearings are required. Ask how later changes to the project would be disclosed and reviewed. The Iowa tool emphasizes meaningful public information before final decisions; Fairfax County describes hearing requirements in its own processes.

How to compare sites or proposals

For multiple proposals, request the same type of evidence for each and compare them on the same axes. Record the document or estimate behind each answer, its date, and whether it is a binding commitment or a projection.
