The clearest way to add games to a retro handheld legally is to use a download the game’s rights holder or an authorized distributor expressly permits, or a homebrew or public-domain game whose license allows your intended use. Owning an old cartridge does not automatically make a ROM download from another site lawful, and a game’s age or absence from stores does not by itself make it free to copy.
Choose a game file you are authorized to use
A ROM is a copy of game software. Before downloading one, identify who owns the rights and whether that rights holder—or a distributor it authorizes—offers the file. Nintendo’s U.S. support guidance describes unauthorized downloads of Nintendo games as pirate copies and says unauthorized Nintendo game copies preloaded on retro devices infringe its copyrights. That is Nintendo’s position on its works, not a complete statement of every publisher’s terms or every country’s law. Nintendo’s Intellectual Property and Piracy FAQ.
Authorized commercial downloads
Use a commercial download only when the rights holder or an authorized distributor offers it and the terms permit your intended use. A game being old, unavailable at retail, or offered free by an unrelated site is not proof that the download is authorized.
Homebrew and public-domain games
Look for an explicit license or rights statement. Confirm that it permits downloading, copying the file to your handheld, and personal play. “Free to download” does not necessarily mean unrestricted use.

Third-party ROM sites and preloaded collections
A repository or handheld loaded with commercial games is not automatically authorized. Check whether the publisher or rights holder has approved the downloads or included library. Nintendo specifically warns about unauthorized downloads and preloaded copies of its games; verify other publishers’ works with their respective rights holders.
Does owning the cartridge let you download its ROM?
Do not assume so. Owning a physical cartridge does not, by itself, settle whether you may download a matching game file from a third-party site. The U.S. sources cited here do not establish a general consumer exception that makes such a download lawful simply because you own the cartridge.

Making a copy yourself and bypassing copy protection are also distinct legal questions. U.S. law generally restricts circumvention of technological measures that control access to copyrighted works. The U.S. Copyright Office’s current rules include limited, purpose-specific exemptions, not a blanket personal retro-game copying permission. 37 CFR §201.40 and the U.S. Copyright Office’s 2024 Section 1201 proceeding.
Among the narrow videogame provisions are rules for restoring access to certain lawfully acquired complete games after a server required for authentication stops providing access, and preservation by eligible libraries, archives, or museums under specified conditions. Those provisions do not establish that every individual may download or dump any old game. If your plan depends on copying a cartridge or circumventing protection, check the law where you live rather than treating ownership as automatic permission.

Check the law where you live
The legal sources linked above are U.S. materials, and Nintendo’s FAQ is its U.S. support guidance. Rules on private copying, circumvention, and distribution differ by country. This guide is general information, not individualized legal advice; check your local law if a particular copying method or exception matters to you.
Transfer an authorized game to your handheld
Once you have a file you are allowed to use, follow the documentation for your exact handheld model. The steps vary: the device determines which formats it reads, where files belong, and what storage it supports. A compatible microSD card or card reader is useful only if the model supports that setup; hardware compatibility does not change a game file’s legal status.

- Identify the exact handheld model and firmware. Find its official user guide or support page before transferring files.
- Check supported formats and storage. Confirm the accepted game-file formats, card type, maximum supported capacity, and whether removable storage is required.
- Follow the documented folder path and transfer method. Use the device’s official instructions rather than assuming another handheld’s setup applies.
- Keep the file private. A personal-use rationale does not grant permission to upload or share a game file. Do not distribute copies unless the rights holder’s terms allow it.
A practical legality check before downloading
- Can you identify the rights holder or the license for this specific game file?
- Is the download offered by that rights holder or a distributor it authorizes?
- If it is homebrew or public domain, does the license clearly permit downloading, copying to the handheld, and personal play?
- Would your method require bypassing encryption or another access control, and does local law clearly permit that method?
- Does the handheld’s official documentation support the file format and transfer method you plan to use?
If authorization is unclear, do not download the file. Use a clearly authorized release or choose a game with a license that expressly permits your intended use.
