No single server lock or tamper-evident seal gives a data center permission to operate. The phrase “sealed server” is a metaphor, not a formal term established in the U.S. Bureau of Industry and Security (BIS) rules. The relevant framework is BIS’s Data Center Validated End-User (VEU) authorization: for eligible controlled items used at specific data centers, it makes security and export-control compliance part of authorization.
Who needs to pay attention to the Data Center VEU rules?
BIS’s Export Administration Regulations (EAR) Part 748 provides for both General VEU and Data Center VEU authorizations. Data Center VEU authorization concerns eligible items used at specific data centers; it is not a universal operating license required by every data center. Operators handling relevant controlled items should determine whether the authorization applies to their items, sites, and circumstances using the current regulation and appropriate export-control advice.
An applicant must show a credible plan or demonstrated history for meeting physical, cyber, and personnel security standards for large-scale data center operations, complying with U.S. export-control laws, and respecting human rights. BIS’s EAR Part 748 sets out application and authorization provisions. A declined VEU request does not itself create a new license requirement or prevent later BIS license approvals.
What does an applicant have to demonstrate?
The application is about an organization’s security and compliance program across locations, people, systems, and suppliers—not one piece of server hardware. BIS calls for information including:

- Descriptions of the controlled items and the rationale for the request, along with relevant business relationships.
- Physical and logical security arrangements at each location, plus workforce access policies.
- An information-security plan addressing areas such as logging, monitoring, personnel security, and incident response.
- Network architecture and service providers, as well as supply-chain risk controls.
- Export-control training and compliance procedures.
- For national VEU applications, customer information unless disclosure is legally prohibited or exceptional circumstances apply, and an explanation of how the applicant can verify that certain controlled items have not been moved outside authorized countries.
The framework also includes recordkeeping and provisions for government on-site review. These obligations make the ability to document, assess, and maintain controls part of the authorization picture.
What physical and technical protections does BIS specify?
The current Part 748 text specifies NIST SP 800-53 controls, certified as appropriate for the stated conditions and consistent with FedRAMP High security requirements. It also calls for annual attestation by a qualifying third-party assessment organization. The listed facility and security conditions include:

- No windows in server core areas.
- Either continuous roving guard patrol or a perimeter intrusion detection system (PIDS) with a 15-minute response time; the regulation specifies 24/7/365 roving patrol or the described PIDS alternative.
- Software and hardware mechanisms to detect and defeat tampering, including illicit modification.
- Procedures to address and prevent seizure of chips and hardware.
BIS states: “The VEU must put in place software and hardware mechanisms to detect and defeat tampering, such as illicit modification.” This requirement is broader than applying a tamper-evident sticker to each server: it calls for mechanisms and procedures within a facility-level security program. The exact current text and its applicability should be checked against EAR Part 748, since regulatory requirements can change.
What a server lock or seal can—and cannot—do
Server-level features can support a facility’s physical access controls, but they do not establish that a site meets VEU requirements. For example, Hewlett Packard Enterprise’s HPE ProLiant Compute DL325 Gen12 QuickSpecs lists rack and power security, a bezel lock, and chassis intrusion detection options. These are examples of product features, not proof of regulatory compliance or a substitute for controls covering the building, staff, networks, suppliers, and compliance processes.

A specific seal requirement should not be generalized to all servers. NIST’s SRA EX9000 Security Policy, Version 2.1, revised February 20, 2013, says tamper-evident seals must remain in place for a SonicWALL SRA EX9000 appliance with 140-2 Level 2 FIPS validation. That instruction applies to the named appliance and validated configuration; it does not establish a BIS rule requiring every data-center server to carry a seal.

For an operator assessing readiness, the practical question is whether controls and evidence cover each layer BIS addresses. A rack lock may help control access to equipment, but it cannot answer whether the site can detect a perimeter intrusion, manage employee privileges, respond to cyber incidents, control supply-chain risk, or demonstrate ongoing export-control compliance.

- Perimeter and facility: assess the required patrol or PIDS coverage and response, site access, and server-core-area design.
- Equipment and tampering: identify how unauthorized physical changes, illicit modifications, or attempted seizure are detected and handled.
- People and access: document workforce access policies, personnel security, and access logging.
- Cyber and network: account for information security, monitoring, incident plans, network architecture, and service providers.
- Suppliers and compliance: address supply-chain risks, export-control training, procedures, records, and assessment evidence.
That layered view is why “sealed server” works only as a shorthand for tamper-resistant infrastructure. The authorization rests on a broader, documented program and its applicable regulatory conditions.
