If the issue is not resolved, send a written notice of error to the servicer’s designated address. Keep making payments required by your loan while the servicer investigates, and act promptly if property taxes or insurance may be unpaid.
First, check whether it is an error or a legitimate payment change
A payment can be credited incorrectly, but a higher monthly bill or changed escrow balance is not automatically a servicing error. Property taxes and insurance premiums can change, affecting the amount collected for escrow. Compare the servicer’s records with the underlying bills before concluding that the account is wrong.
Gather the records that show what happened
- Your monthly mortgage statement and prior account history.
- Your bank record or payment confirmation, including the date and amount sent.
- The servicer’s escrow analysis, if the issue involves escrow.
- Current and prior property tax bills and insurance premium notices.
For a payment dispute, compare the amount and date you paid with the amount the servicer credited to principal, interest, escrow, fees, or a suspense account. Check the posting date against the due date and any transfer or processing records. For escrow, compare projected and actual disbursements with the tax and insurance bills. Ask the servicer to explain its calculation if the records do not make the change clear. The CFPB recommends monitoring mortgage statements and tax and insurance bills (CFPB guidance on mortgage problems).
Contact the servicer and document the conversation
A phone call may help identify a posting or calculation issue. Write down the date, the representative’s name, any reference number, and the explanation given. Keep copies of statements, bills, payment confirmations, and all follow-up correspondence.

If the issue is not promptly corrected or you want a formal investigation, send a written notice of error. Under Regulation X, payment application errors are covered when a servicer fails to apply an accepted payment to principal, interest, escrow, or other charges as required by the loan and applicable law. The notice must include your name, information sufficient to identify your mortgage account, and a description of the error you believe occurred (12 CFR § 1024.35).
Send the notice to the designated address
Use the servicer’s special address for notices of error or information requests, if it has one. Check the address on your periodic statement, coupon book, or the servicer’s website, and follow its current submission instructions. Do not write the notice on a payment coupon. Keep a complete copy of the notice and attachments, and preserve evidence of when and where you sent it. The CFPB explains how to submit a notice of error or information request.
What to include
- Your name and information that identifies the mortgage account.
- A concise description of the alleged error, with relevant dates and amounts.
- Copies of supporting records, such as a payment confirmation, statement, escrow analysis, or tax bill.
- A clear request for the servicer to investigate and correct the account if it confirms an error.
Send copies rather than originals, and keep a copy of everything you send.

Know the response deadlines
For a general notice of error, the servicer generally must acknowledge receipt within five business days and respond within 30 business days. These periods exclude weekends and legal public holidays. In specified circumstances, the servicer may take an additional 15 business days if it gives notice of the extension. Certain errors involving an inaccurate payoff balance have a distinct seven-day response deadline; that shorter period does not apply to every dispute. Keep paying what your mortgage requires
A servicer cannot require you to pay the disputed amount as a condition of investigating or responding to a notice of error. That does not suspend your obligation to make payments due under your mortgage terms. Do not stop paying because a dispute is open; the servicing process does not itself change the loan’s payment requirements (12 CFR § 1024.35).
Protect yourself if a tax or insurance bill may be unpaid
If property taxes were not paid
Send the tax bill with your notice of error and contact the tax authority promptly to ask about the bill, deadlines, and any steps needed to prevent further consequences. The CFPB warns that unpaid property taxes can lead to a tax lien. Keep records of what the tax authority and servicer tell you.

If insurance was not paid
Contact the insurance carrier promptly to confirm whether coverage remains in force and whether any deadline or action is required. Keep the insurer’s response and your communications with the servicer in writing where possible. A servicing dispute does not resolve a separate tax or insurance deadline.
Regulation X generally requires a servicer to make covered escrow disbursements in time to avoid a penalty when the borrower’s payment is not more than 30 days overdue. The rule does not establish that every missed or disputed payment violates the law; the account history, loan terms, timing, and applicable requirements matter. See 12 CFR § 1024.17 and 12 CFR § 1024.34.
How to assess an escrow increase
Servicers must conduct escrow analyses and provide disclosures, including notice of shortages or deficiencies at least once during the computation year. The rules govern how a shortage or deficiency is handled, but the amount and timing of a new monthly payment depend on the account analysis, loan terms, applicable rules, and the underlying bills. A higher payment alone does not establish an error.

- Check whether the tax bill or insurance premium changed.
- Compare those bills with the projected amounts in the escrow analysis.
- Compare the analysis with actual disbursements shown in the account history.
- Ask the servicer to identify the figures and calculation behind the new payment.

If the servicer does not resolve the issue, you can submit a mortgage complaint to the CFPB online or by phone. For help understanding options, find a HUD-approved housing counselor through the CFPB’s housing counselor tool.
Do not wait for the ordinary servicing response timeline if foreclosure is imminent or you have been served legal papers. Contact a qualified housing counselor or attorney promptly. A tax lien or threatened lapse in insurance also warrants quick attention to the relevant tax authority or insurer.

If the mortgage has been paid off and escrow funds remain
For a paid-off mortgage, Regulation X generally requires the servicer to return escrow funds it controls within 20 days, excluding weekends and legal public holidays, subject to exceptions in the regulation. If you believe the servicer still holds funds, check the payoff and account records and contact the servicer in writing. See 12 CFR § 1024.34.
Scope of this guide
This article describes federal CFPB guidance and Regulation X for covered mortgages. It cannot determine whether a particular servicer violated the law or address every state-law protection, loan term, bankruptcy issue, military protection, or litigation strategy. Check the current notice address and submission method on your own servicer’s statement or official website; seek qualified individual help for urgent tax, foreclosure, or legal-paper issues.
