If your mortgage closing is delayed, contact your lender and closing agent immediately, get the reason and a realistic revised date in writing, and check your Closing Disclosure, rate-lock deadline, and purchase contract before agreeing to changes. A delay does not automatically mean you owe an extension fee or lose your deposit; the outcome depends on your lender’s terms, transaction documents, and applicable law.

What to do first when closing is postponed

  1. Call your lender and closing agent. Ask what specifically is preventing closing, what remains to be done, who is responsible for each item, and the earliest realistic new date. Request the explanation and timeline in writing. The Consumer Financial Protection Bureau (CFPB) advises consumers to discuss mortgage closing problems with the lender and to contact the lender or closing agent about closing documents (CFPB: Close on your mortgage).
  2. Notify the people coordinating your move. Update your real-estate agent and, where relevant, the seller’s agent and title or settlement contact. Contact movers, lodging providers, storage companies, and other affected services directly to ask about changing dates and charges. Your contract and each provider’s terms determine who is responsible for costs; do not assume another party must pay.
  3. Check your Closing Disclosure and review time. For covered mortgages, you generally must receive the disclosure at least three business days before consummation. If it has not arrived, request it from your lender immediately and do not proceed until you have received and reviewed it. Compare it with your Loan Estimate and ask the lender to explain errors or unexplained increases (CFPB: Close on your mortgage).
  4. Check your rate-lock agreement. Find the expiration date and conditions in your Loan Estimate or lock agreement. Ask the lender in writing whether the lock remains active, whether an extension is available, what it costs, and what policy applies to this delay.
  5. Read your purchase contract before agreeing to a new date or walking away. Ask your agent to point out the closing-date, notice, and extension provisions. If your deposit, deadline, or remedies are disputed, consult an attorney familiar with real-estate law in your jurisdiction. Walking away can have contract consequences, and you may lose a deposit or application and appraisal fees (CFPB: Close on your mortgage).

How the Closing Disclosure waiting period works

The initial Closing Disclosure generally must be received at least three business days before closing for covered mortgages. The CFPB says: “You should also not go through with the closing until you receive and review the Closing Disclosure.” If yours has not arrived, ask the lender for it and pause closing until you have reviewed it (CFPB: Close on your mortgage, reviewed August 9, 2024).

When a corrected disclosure restarts the clock

A correction does not automatically require another three-business-day wait. CFPB compliance guidance requires a new waiting period if a change makes the annual percentage rate inaccurate, makes the disclosed loan product inaccurate, or adds a prepayment penalty. For most other changes, the corrected disclosure may be received at or before consummation without a new three-day wait. Ask the lender to identify the change and explain which timing rule applies (CFPB Regulation Z, § 1026.19).

What a delay can mean for your rate lock and loan terms

A rate lock usually protects the offered rate only during the stated lock period and while the application remains within the agreement’s conditions. The CFPB describes 30, 45, and 60 days as common lock periods, with longer periods sometimes available; these are typical examples, not a guarantee. Extension fees and policies vary by lender, so there is no universal fee or automatic result when closing moves (CFPB: What is a rate lock?, reviewed May 2, 2023).

Ask the lender to confirm in writing whether your lock is still active, its expiration date, whether an extension is possible, its cost, and how the lender determines responsibility for the delay. Do not assume an extension is free or that your rate necessarily changes just because closing is postponed.

If the rate, points, or fees changed

Compare the Closing Disclosure with your Loan Estimate and ask the lender for a specific explanation of each difference. Some cost changes are allowed under applicable rules, and a locked rate can change in limited circumstances, including changes in the application or verification. If the explanation does not resolve your concern, discuss options with the lender, which may include another lender or a negotiated delay, and seek legal advice when needed (CFPB: What if the interest rate or fees changed on my Closing Disclosure?; CFPB: What is a rate lock?).

How to limit delay-related costs and escalate a problem

A delay can disrupt moving plans and other expenses, but federal guidance does not set a typical cost or automatically assign responsibility. In its 2020 assessment of the mortgage disclosure rule, the CFPB recorded examples commenters raised, including forfeited good-faith deposits, tax penalties for advances on retirement accounts, and travel, hotel, and moving-company costs. These are examples of possible harms, not a measured frequency or prediction of what you will owe (CFPB: Assessment of TRID Integrated Mortgage Disclosures).

  • Ask affected providers whether you can change dates or reduce or avoid fees.
  • Keep written communications, revised estimates, and receipts.
  • If you cannot resolve a lender problem, you can submit a complaint to the CFPB online or by phone. The Bureau says it generally forwards complaints to the company for a response within 15 days (Submit a complaint to the CFPB; CFPB complaint process, reviewed September 11, 2024).
  • Consider consulting a local real-estate attorney about contract rights, potential losses, or legal claims.

Which rules apply to your mortgage?

The CFPB’s Closing Disclosure guidance applies to most covered mortgages, but exceptions exist for some loan types. If you have a reverse mortgage, home equity line of credit (HELOC), certain assistance-program loan, or a manufactured-home loan not secured by real estate, confirm with your lender which disclosure rules apply (CFPB: Close on your mortgage; CFPB Regulation Z, § 1026.19). Your purchase contract, state law, and lender-specific rate-lock terms also affect your individual rights and costs.
