Yes—but using an open AI model does not, by itself, meet data residency or compliance requirements. Those depend on where the full workflow processes and stores data, who can access it, the applicable contracts and safeguards, and how the AI system is used. Self-hosting can give an organization more control over infrastructure; a hosted API can offer regional controls for eligible services. Neither option is automatically compliant.

What “open” does—and does not—tell you

“Open AI model” can mean different things. It is often used to describe a model whose weights are available to download, but access to weights is not the same as permission to use, modify, or redistribute them. Check the specific license and the model information that accompanies the release.

Neither open weights nor an open-source license establish where prompts, outputs, logs, backups, telemetry, or support records are processed. Those questions concern the deployment and service configuration, not simply the model. A model can be open and run on infrastructure in a chosen region, or be accessed through a hosted service whose data handling depends on that provider’s terms and controls.

What does EU data residency actually cover?

Residency is a data-flow question. A statement that content is stored in a region does not necessarily mean that inference—the processing that produces a response—also happens there. Nor does a regional setting necessarily cover every form of service data or every connected system.

Trace each category of data through the workflow

For each use case, map information from collection through inference, storage, monitoring, support, and deletion. Identify the entities that receive or can access each category, and the region in which each operation takes place. Include the organization’s own application and connected services, not just the model provider.

  • Content: prompts, responses, uploaded files, retrieved documents, and embeddings.
  • Operational records: logs, cached data, abuse-monitoring records, backups, and monitoring data.
  • Service and account information: system data, identity records, support tickets, and metadata.
  • Connected services: the application, retrieval system, observability tools, subprocessors, and any external tools that receive content.

Questions to resolve before choosing a region

  • Does the commitment cover storage at rest, inference, other processing, or a defined combination?
  • Which data types are included, and which are excluded from the regional commitment?
  • Is the exact endpoint, model snapshot, feature, and processing mode available in the desired region?
  • Must requests use a region-specific endpoint or project setting?
  • Do eligibility conditions, approvals, or contract changes apply?
  • What retention and deletion controls apply, and what evidence can the organization use to verify them?

OpenAI’s API documentation describes project-level residency controls for customer content, distinguishes regional storage from regional processing, and identifies system data and some configurations that may fall outside the selected region. Its business documentation describes eligible products and regions for storage, inference, and processing. These are provider-specific controls, not a general guarantee for all AI services. Check the current endpoint and model information, exclusions, and contract terms for the service actually being used.

Does self-hosting an open-source LLM make it GDPR compliant?

No. Self-hosting may help an organization control where its own infrastructure runs and how it configures access, logging, and retention. It does not remove the need to handle personal data lawfully or to protect it. Data may still flow to external systems through the surrounding application, monitoring, support, identity, or retrieval stack.

Under GDPR, the roles of the parties depend on what they actually do with personal data. The European Data Protection Board’s April 2025 report on LLM privacy describes varied service arrangements: an organization using a model for its own service will typically determine the purposes and means of that use, while a platform provider may have a separate role for data it handles for its own purposes or under instructions. Contract labels alone do not settle those roles. The arrangement should match the actual data flows and responsibilities.

Self-hosting also shifts operational work to the organization or its infrastructure contractor. The organization must configure and secure the environment, control access, manage logs and retention, and maintain the systems it operates. Hosting inside a particular country or region is one relevant control, not a GDPR compliance certificate.

Does the EU AI Act exempt open-source AI models?

Only in a limited respect. Under the EU AI Act, a qualifying provider of a general-purpose AI model (GPAI) released under a free and open-source licence may be exempt from specified provider documentation duties if the required model information—including parameters such as weights, architecture information, and usage information—is publicly available. This exception does not apply to GPAI models presenting systemic risk.

The exception concerns certain duties of the model provider. It does not exempt an organization from relevant requirements for an AI system built with or using that model. The European Commission distinguishes model-level GPAI rules from obligations that may apply to the AI system provider or deployer according to the system’s purpose and risk. An organization that significantly modifies or repackages a model may also need a fact-specific assessment of its role; downloading weights alone does not determine that question.

Relevant GPAI dates

As of 7 October 2026, the Commission states that GPAI provider obligations applied from 2 August 2025. Its enforcement powers begin on 2 August 2026. Providers of GPAI models placed on the market before 2 August 2025 have until 2 August 2027 to comply. The Commission’s guidelines explain its interpretation but are not legally binding; check the live legislation and current guidance for a particular model and deployment.

Self-hosted open weights vs. managed hosted inference

Infrastructure The organization operates or contracts for its environment and is responsible for securing it. The provider operates the inference infrastructure; the customer depends on its controls and contract.
Residency evidence Establish where the organization’s infrastructure and connected systems run. Verify eligible regions for the specific endpoint and model, processing as well as storage, and any stated exceptions.
Data handling The organization configures access, logs, retention, patching, and operational controls. Responsibility is shared; examine which content and service data are covered, plus subprocessors and deletion terms.
Model and system obligations An open release may affect limited documentation duties for the original GPAI provider; applicable duties for the downstream AI system still need assessment. Hosted access does not remove the distinction between provider and deployer roles or applicable duties for the customer’s AI system.
Operational trade-off More direct infrastructure control comes with more security and operational responsibility. Less infrastructure is operated directly by the customer, with greater reliance on provider documentation and contract terms.

These options do not have a universal compliance winner. The appropriate balance depends on the data and use case, applicable law, threat model, organizational capability, and the controls and contract terms available for the chosen deployment.

A practical review before putting a model into production

  1. Define the use. Identify what the AI system does, who is affected, what data it handles, and the organization’s role in providing or deploying it.
  2. Map the data path. Record each service and party involved in collection, inference, retrieval, storage, logging, monitoring, support, and deletion.
  3. Verify the actual regional controls. Confirm the selected endpoint, model snapshot, feature, and configuration, and distinguish regional storage from regional inference and other processing.
  4. Review exclusions and retention. Check coverage for prompts, outputs, files, logs, system data, backups, and support information, along with retention, deletion, and any permitted out-of-region handling.
  5. Match contracts to operations. Confirm parties’ roles, instructions, subprocessors, access, and responsibilities against the real data flows rather than relying on labels alone.
  6. Assess the AI Act and other applicable rules. Consider model-provider duties separately from duties for the AI system and its deployment. Seek legal review where the intended purpose, risk category, model changes, or jurisdiction makes the analysis uncertain.
  7. Keep the evidence current. Recheck provider documentation and terms when the endpoint, model, feature, region, or service configuration changes.
