Before committing to land, get written, site-specific evidence that the serving system can deliver your requested load at the required point and on a schedule that fits your project. Identify the utility and any applicable RTO or ISO, establish what studies and upgrades are required, clarify who pays and what flexibility the service requires, and test the proposed load and backup-power behavior with grid stakeholders. A nearby transmission line, a regional capacity map, or a place in an interconnection queue is not a capacity reservation or a promised energization date.
How do you know whether a data center site has enough power?
You cannot establish that from geography alone. Grid connection risk is the gap between the data center’s required load, delivery point, and date—and what the electric system can reliably serve after required local and network work is accounted for. A parcel near a high-voltage line may still need substantial substation or transmission upgrades; a regional study may identify constraints without resolving whether a particular parcel can connect.
Start by identifying the entities that control the decisions. The serving electric utility may handle retail service and local facilities; a transmission owner may control affected network work; a balancing authority manages real-time system balance; and an RTO or ISO may administer regional transmission and market processes. Roles vary by location, so ask which entity provides each study, approval, service agreement, and schedule commitment.
DOE’s July 2026 draft National Transmission Needs Study assesses regional transmission needs using public information and more than 120 recently published reports. It identifies needs related to load growth, reliability, generation and load interconnection, and congestion relief, while explicitly not identifying solutions for individual sites or displacing existing planning processes. Its finding that a majority of transmission congestion is concentrated in 5% of hours is a draft-study result, not a prediction about a specific site: congestion varies by region and system conditions.

What evidence should you request before buying land?
Ask for the applicable large-load application and tariff, the study process and status, and a written explanation of which results are preliminary and which terms become binding. A queue entry or application acknowledgment can indicate process status, but does not establish deliverable capacity or a firm service date. The useful evidence is a site-specific assessment tied to your requested MW, point of delivery, operating profile, and target schedule.
Capacity and study maturity
Have the utility and, where applicable, the grid operator assess whether the system can serve the requested load under relevant operating conditions and contingencies. Record the assumptions, study date, status, and unresolved dependencies. Ask whether the assessment includes phased growth and whether the requested initial load can be served before the final build-out.
Facilities, upgrades, and dependencies
Request identification of required customer facilities and system work, including local substation or transformer changes, transmission network upgrades, and any affected-system work. Ask whether the assessment depends on generation, resource adequacy, or other projects being available. For every required item, establish who is responsible for scope, permitting, procurement, construction, testing, and completion.

Costs and commercial terms
Get the cost allocation in writing: customer-funded facilities, network upgrade responsibility, deposits, possible cost sharing or credits, and how estimates may change after restudy or a change in project scope. Do not treat policy discussions as site-specific terms. The applicable tariff and executed agreements govern a project; FERC’s active proceedings make these issues important to monitor but do not themselves set the commercial terms for an individual parcel.

Service conditions and flexibility
Ask whether interruptible service, curtailment, demand response, staged energization, or another form of flexibility is offered or required. Find out who can call for a reduction, under what conditions, how much load could be affected, how long and how often the restriction may apply, and what operational or commercial consequences follow. Do not count flexibility as a benefit until those conditions are quantified and acceptable to the data-center operator.
How long will it take to connect a data center?
Build a project-specific milestone schedule rather than relying on a general duration. NERC’s March 2026 reliability assessment reports that data centers can move from conception to operational readiness in one to two years, while new transmission and generation infrastructure can take four or more years. NERC also notes that utility interconnection may take longer and that a facility may initially energize before ramping to full load. These are reported contrasts, not a forecast for any particular project.

Ask the utility and grid operator for the dependencies behind every date, then separate utility-controlled work from developer-controlled work. Include the application, studies, permits, equipment procurement, construction, testing, initial energization, and ramp to full load. Mark which milestones have written commitments, which are estimates, and what could trigger a restudy or schedule change.
- Before land commitment: confirm the serving entities, process, requested load assumptions, study entry requirements, and the evidence needed to establish service feasibility.
- During study and agreement: track study deliverables, upgrade scope and cost allocation, deposits, permits, and contractual service milestones.
- Before construction and energization: verify procurement and construction dependencies, testing requirements, operating restrictions, and the conditions for each load phase.
- Before closing or changing the design: obtain dated written updates and confirm that load, point of delivery, ramp, and schedule assumptions remain valid.
Make the land commitment conditional on defined power milestones where commercially possible. A milestone should specify the evidence required, the responsible party, the deadline, and the buyer’s remedy if the condition is not met; have counsel translate those terms into the transaction documents.
What load information should you give the grid planners?
Incomplete or late project data can make studies less useful. NERC’s March 2026 assessment identifies gaps in information sharing about project plans, demand patterns, and demand responsiveness. Provide credible engineering assumptions early, and keep them consistent across utility, operator, and project documents.

- Requested peak MW, the delivery point, and the load expected at each development phase.
- Commissioning sequence, ramp timing, expected operating profile, and material variations in demand.
- Available demand response or other flexibility, including the conditions under which it can actually be used.
- Backup-power architecture and operating assumptions, including transfers off utility supply and return to utility supply.
- UPS and variable-frequency-drive settings, protection schemes, and voltage-disturbance ride-through behavior.
Review these designs with utility and grid stakeholders rather than assuming on-site generation removes interconnection risk. NERC specifically identifies coordination between utility-side protection and facility-side UPS and variable-frequency-drive ride-through settings, as well as how the facility transfers to backup and returns to utility supply during or after voltage disturbances. Ask how those behaviors are represented in the study models.

There is no single settled nationwide large-load process. Requirements depend on the utility, region, applicable tariff, and project circumstances, and the federal policy landscape was still changing as of October 7, 2026.
FERC’s RM26-4 docket describes an advance notice of proposed rulemaking process that followed a Department of Energy direction on October 23, 2025. The questions include whether flexible or curtailable loads might move through studies faster, how upgrades should be paid for, how co-location with existing generation should be evaluated, and how pending requests should be treated. This is an early-stage rulemaking description, not a final uniform procedure. FERC describes “large loads” for this proceeding as generally above 20 MW; that is not a universal threshold for every utility or region.

On June 18, 2026, FERC announced tailored show-cause orders to six jurisdictional RTOs and ISOs concerning large-load integration. The stated issues included study processes, transmission-cost transparency and cost shifting, co-location and behind-the-meter generation, services for flexible loads, and study of generation serving nearby large loads. The announcement set a 60-day period for the operators and transmission owners to justify tariffs or file changes and separately described a 30-day informational report on generation adequacy. These actions are a reason to check current regional tariffs and filings; they do not tell a developer what service a particular site will receive.
How should you compare candidate sites?
Use the same evidence standard and requested load assumptions for every parcel. Separate what is confirmed from what remains an estimate, and compare the full cost and schedule exposure—not just headline MW or regional reputation.

Keep date-stamped study outputs, assumptions, and written utility responses in the site record. Reconfirm them before closing and before a major design or load change: network conditions, tariffs, and large-load rules can change.
When should a site fail the power screen?
Do not treat an unresolved question as a negative finding, but do not price it as secured power either. Pause or reject a site when the project cannot obtain evidence on a critical point within its decision window, or when the documented cost, schedule, or operating conditions no longer fit the project.

- Required upgrades or affected-system dependencies remain undefined enough that cost or timing exposure cannot be bounded for the land decision.
- The earliest credible service milestones do not fit the project’s phased commissioning plan.
- Required curtailment or flexibility conditions conflict with the facility’s operating requirements.
- Study assumptions do not reflect the proposed ramp, backup transfers, or power-electronic equipment behavior.
Where the evidence is incomplete but the site remains attractive, preserve the uncertainty explicitly in the commercial decision rather than treating a queue position, map, or verbal assurance as a substitute for a written commitment.
