Mark the terms that matter, ask for specific changes, preserve the negotiation record, and compare the value of the deal with the rights and business flexibility it requires. Collective bargaining or a formal dispute route may also be available—but only if local law covers the publisher, platform, and transaction.
Start by working out what the offer actually covers
A low payment is only one possible problem. A license can also be unfavorable because it grants broader uses, lasts longer, or limits the publisher’s future choices more than the value received justifies. Before negotiating, establish what the platform is asking for and whether the publisher has authority to grant it.
- Identify the rights holder. Separate content the publisher owns from work it can license only under an author, agency, syndication, or other agreement. Do not assume that permission to publish also gives the publisher every right the platform requests.
- List the content and uses. Check whether the license covers display, indexing, excerpts, full text, syndication, model training, or other uses, and note the services and territories involved.
- Check the deal’s boundaries. Look for exclusivity, sublicensing, term and renewal, termination, takedown, and any permissions for associated data. Read definitions and incorporated platform policies as well as the main agreement.
These are contract-review questions, not conclusions about what a particular contract legally permits. The answer depends on the actual wording, rights chain, and applicable law.
Compare the offer against the value and risk
Put the proposed deal beside the publisher’s realistic alternative: a narrower license, another distribution channel, or no agreement. Compare commercial value and rights granted together rather than treating payment as the only measure.

The comparison is a decision aid, not a universal formula for a fair price. The available official sources do not establish a typical licensing fee, revenue share, or bargaining success rate.
Negotiate specific changes and keep a clear record
Replace a general objection such as “these terms are unfair” with proposed edits tied to the publisher’s concerns. For example, ask to limit a license to defined content and uses, remove or narrow exclusivity, set a clear end date, specify attribution and reporting, or make payment calculations verifiable. Which changes are achievable depends on the leverage, facts, and applicable law.

Keep the offer, every draft, comments, emails, meeting notes, and any usage or payment information in one place. If distribution or access changes during negotiations, preserve records that show what changed and when. A documented timeline can help clarify whether the disagreement concerns contract interpretation, copyright, competition, or a sector-specific bargaining framework.
Check whether collective bargaining is available
Other publishers may share the same platform, but negotiating together can raise competition-law issues. Do not assume a group arrangement is automatically permitted. Check the rules in the relevant jurisdiction and obtain legal advice about any required authorization or exemption before sharing negotiating activity.

Australia provides specific examples, not blanket permission: the ACCC reports authorizations for Country Press Australia and Commercial Radio Australia to bargain with Google and Facebook, and two class-exemption notices lodged for 23 small publishers. Those examples concern named groups and arrangements; they do not establish that a different group or a different kind of licensing deal is covered. ACCC: News media bargaining code
Use formal routes only after checking eligibility
A regulator, statutory bargaining process, mediation, or arbitration may help in some disputes, but availability depends on local law and the parties and content involved. Confirm the publisher’s eligibility, whether the platform and service are covered, and whether required notices or other procedural steps apply before relying on a formal route.

In Australia, the Competition and Consumer Act provides a bargaining framework and arbitration provisions concerning remuneration, subject to statutory coverage and process requirements. The ACMA’s code page describes eligibility assessment, mediation, and appointment of arbitrators in specified circumstances. These mechanisms do not mean every publisher can compel every platform to negotiate or require it to accept a particular price.
A UK government-commissioned report discusses options such as regulator determinations of fair and reasonable payment and binding arbitration. It notes that administrative determinations can be costly and time-consuming, while arbitration may sometimes produce a faster outcome. Its description of the Australian code reflects conditions as of October 2021, so it should not be treated as a current account of Australian platform designation. UK government-commissioned report

What the Australian framework means now
Australia’s News Media Bargaining Code is a conditional example, not a rule for publishers everywhere. ACMA says eligible Australian news businesses may bargain individually or collectively over payment for the inclusion of news on platforms and services. The code applies to platforms designated by the Treasurer. ACMA’s page, last updated 3 September 2026, said that no platform had been designated at that time. Check both eligibility and current designation status before treating the code as an available route.
The ACCC says a 2022 review counted over 30 commercial agreements between Google, Meta, and a cross-section of Australian news businesses. That historical count does not show what publishers were paid, whether the terms were fair, or whether comparable deals are currently available. ACCC: review and bargaining-code information
On 28 April 2026, an Australian Government release described draft News Bargaining Incentive legislation as open for consultation. The release said the proposal would encourage commercial deals with eligible publishers and charge platforms that did not make deals; it also presented the proposal as addressing the earlier code’s ability to be avoided by removing news from a service. That release establishes the proposal’s status and stated rationale on that date, not enactment or implementation. Verify the legislation’s present status before relying on it as law. Decide whether to sign, narrow, or walk away
After reviewing the terms, compare the likely value of reach, referrals, payment, and platform services with the rights granted and the cost of reduced distribution if there is no deal. Depending on the contract and local law, the practical options may include accepting revised terms, licensing a narrower use, pursuing an available bargaining route, using other channels, or declining the offer. Do not assume content can be withdrawn without contractual or practical consequences.
