Prioritize safety over recording: keep a safe distance, do not obstruct or physically resist, and follow immediate safety instructions. As soon as you can, write a factual timeline, identify witnesses, seek care for injuries, and preserve any photos or video in their original form with a separate backup. Recording law and complaint procedures vary by location and circumstances, so treat this as general U.S.-oriented guidance rather than legal advice.
What to do during the encounter
Stay safe and avoid interfering
Do not move closer, obstruct officers, or put yourself at risk to capture footage. The First Amendment generally protects recording law-enforcement officials performing their duties in public when you are lawfully present, but that does not mean every recording is lawful in every setting or risk-free. The ACLU’s guidance on encountering law enforcement and its recording guidance caution against interference and note that private-property owners may set rules for photography or video. State privacy and notice laws can also differ.
Record context only if it is safe
If you can record safely, capture the sequence and surroundings: visible street signs or landmarks, nearby activity, and what happens before, during, and after the key event. A continuous recording may show context that a short clip cannot. Do not hold a phone while driving; the ACLU suggests a hands-free dashcam or asking a passenger to record instead.
If officers take or ask to search your device
ACLU guidance gives a general rights summary: if you are not under arrest, an officer needs a warrant to confiscate your device or view its contents without your consent; if you are arrested, an officer may take the phone but still needs a warrant to search its contents. Do not physically resist a seizure or search. Ask for legal advice afterward about the circumstances and applicable law.

What to write down immediately afterward
Make a dated account as soon as practical, while details are fresh. Use your own words and distinguish what you personally saw or heard from information you learned later. Keep observations factual; avoid filling gaps with guesses.
- When and where: date, approximate time, exact location, and any useful nearby landmarks.
- Who was involved: agency, number of officers, names, badge numbers, patrol-car numbers, and witness names and contact details, if available.
- What happened: sequence of events, any reason given for a stop, requests or commands, searches, force, weapons you observed, statements you remember, and how the encounter ended.
- Injuries and treatment: what was injured, when and where you received care, and any related records.
The ACLU recommends recording identifying details, witness information, actions, and injuries in its documentation guidance. Contact witnesses promptly if appropriate, note their information accurately, and ask whether they are willing to preserve their own original recordings and share them with you or your lawyer.

How to preserve photos and video
- Keep the original file unchanged. Do not crop, trim, add captions to, or otherwise edit the original recording or photo. The ACLU specifically advises preserving originals without editing.
- Make a separate copy. Copy the original file to another device so the only copy is not at risk if your phone is lost, damaged, or deleted. Confirm that the copy opens and plays before relying on it.
- Keep a simple record of handling. Note who recorded the file, when and where, when copies were made, and who received them. This practical note is not a formal forensic chain-of-custody protocol.
- Keep any edited excerpt distinct. If a shorter version helps explain an event, make it a clearly labeled derivative and retain the unedited original separately.
- Share carefully. Avoid publicly posting sensitive footage before the affected person or their lawyer can consider privacy, safety, and case concerns. The ACLU recommends sharing documentation with the affected person’s loved ones or attorney so they can decide whether and when to share it.
A separate device or external drive can serve as a backup; the source guidance does not require or endorse a particular storage product. Avoid treating an emailed or social-media copy as your sole preservation copy, especially if it may be compressed or altered.
Medical care, complaints, and legal follow-up
Address injuries
Seek medical care for injuries. When safe and appropriate, photograph them and keep treatment records; note the date, location, and provider for your own account. These records can help document what happened, but they do not replace medical advice.

Choose the appropriate complaint channel
The ACLU recommends a written complaint to the agency’s internal affairs division or a civilian complaint board, and notes anonymous complaints may be possible in many cases. The U.S. Department of Justice separately describes federal laws addressing certain categories of law-enforcement misconduct and provides information on how to report police misconduct to DOJ. A federal complaint is not interchangeable with a complaint to the local agency; the right route depends on the allegations.
If a complaint or legal claim may follow, a local attorney or civil-rights organization can advise on deadlines, evidence requests, preservation notices, and local recording rules. There is no single deadline or records-request process established for every jurisdiction and case.

What official evidence rules do—and do not—establish
Some official requirements apply only in defined settings. For example, a DOJ consent decree for specified Los Angeles Police Department investigations requires collection and preservation of appropriate evidence, including witness canvassing where appropriate and subject to applicable state law. That decree is not a universal obligation governing every department or complainant: DOJ, LA Consent Decree, Section III.
DOJ body-worn-camera materials discuss agency-policy recommendations, including informing people about recording, variation in consent requirements under state law, and keeping an activated camera running through an encounter subject to stated exceptions. These recommendations do not set the rules for every department: Implementing a Body-Worn Camera Program: Recommendations and Lessons Learned. There is no universal body-camera retention period established here, so ask a local lawyer or the relevant agency about preservation requests and applicable policy.
