It can delay a proposed facility when the project still needs an approval covered by the measure; it does not automatically ban data centers permanently, halt every construction project, or shut down operating facilities. The local law’s wording, project definitions, exceptions, and effective status determine what actually pauses.
What a data center moratorium pauses
The word “moratorium” alone does not tell you what is suspended. A local measure may bar applications from being filed, accepted, reviewed, processed, approved, or issued. It may apply to only certain facility types, projects, or geographic areas. Read the operative text for the exact verbs, covered applications, and territory.
For example, Seattle’s 2026 ordinance covers applications to establish or expand a data center, or change a use to a data center, and prohibits filing, acceptance, processing, or approval. Nassau County, Florida’s first-reading draft lists rezoning, conditional-use, development, site-plan, building-permit, and other development approvals for construction, expansion, or operation in unincorporated areas. The project definition matters as much as the approval stage. A measure may distinguish by facility size, electrical capacity, computing use, whether the data center is a principal or accessory use, or where the site is located.

How a pause can affect construction and permits
Development approvals often occur in sequence. A project might first need zoning or land-use approval, then a building permit, and later an occupancy approval. If a moratorium blocks a required early approval, the project may be unable to move forward even if the measure does not separately name every later permit.
Madison says its pause blocks zoning approvals for new principal-use data centers and telecommunications centers over 10,000 square feet, with associated consequences for building permits and certificates of occupancy. Raleigh’s FAQ says a major data center requires a special-use permit before construction and describes a proposed pause on acceptance and review of development-approval applications. Raleigh’s page, updated for an October 6 hearing, describes a proposed six-month pause; it should not be treated as adopted without checking a later official record. Other measures can reach different points in the process. Pennsylvania Senate Bill 1345 proposes allowing municipalities to pause specified high-impact data-center applications, including land-development plans and some building permits that depend on prior land-use or zoning approval. What it means for operating facilities and projects already underway
Check a project’s status rather than assuming that all work stops or that every prior project is protected. An operating facility, a project with permits but no construction, a project already under construction, and an application awaiting review may receive different treatment.

- Operating facilities: Some measures leave routine activity alone but may regulate approvals for expansion. Pennsylvania Senate Bill 1345 proposes that a local moratorium may not impair routine maintenance or safety upgrades at existing facilities.
- Approved, vested, or previously filed projects: Fort Worth’s explanation of Texas moratorium limits says the described pause would not apply to vested or approved projects, or projects with zoning applications already submitted. That description is specific to Fort Worth’s account and should not be generalized to other jurisdictions. Fort Worth data-center information
- Expansion: Seattle’s ordinance includes a narrow exception allowing an operating facility to expand capacity by up to an additional 20 megavolt-amperes (MVA), subject to the ordinance’s conditions.
- Pending applications and work in progress: Look for explicit rules covering submitted applications, issued permits, vested rights, and construction already underway. State law may also affect how prior approvals are treated.

- Madison: The city says its moratorium covers new principal-use data centers and telecommunications centers above 10,000 square feet. It excludes facilities serving another principal use, such as a data center within and serving a research lab or office. The city says the pause affects zoning approval, with downstream building-permit and occupancy consequences.
- Seattle: The ordinance defines a covered data center as a facility primarily housing computer and networking equipment and handling digital data, with capacity above 20 MVA. Its limited operating-facility expansion exception allows up to 20 MVA under specified conditions. These thresholds apply to Seattle’s ordinance, not to data centers generally.
- Raleigh: The city’s zoning framework distinguishes minor data centers from major facilities; its FAQ says a major facility needs a special-use permit before construction. The proposed pause described on the FAQ concerns development-approval applications.
When reading a local measure, check the covered activity, facility definition, project status, exemptions, geography, and procedural stage—not just its title.

Official materials describe moratoria as a way to study a land use and prepare standards. Madison says it is researching best practices and safeguards, including possible definitions and zoning standards. Nassau County’s draft calls for review of groundwater, water and wastewater, electrical-grid capacity, land-use compatibility, and environmental issues. Pennsylvania Senate Bill 1345 identifies possible infrastructure-capacity assessments, public-safety analysis, environmental and community evaluations, and zoning or development-code amendments.

The legal authority to regulate differs by location. Madison’s page says the city’s authority covers land uses, building and lot size, lot coverage, and setbacks, while certain issues such as water and energy use fall outside its stated municipal regulatory authority. That explanation is specific to Madison and Wisconsin, not a general description of local-government powers.
How long the pause lasts—and whether it is in effect
Duration and legal status are local. An ordinance may set a fixed term, allow renewal, end early when replacement rules are adopted, or require studies and hearings. A proposal, first-reading draft, adopted ordinance, and effective moratorium are different stages; confirm the current official record before relying on a measure.

A practical checklist for a specific project
- Find the controlling document. Locate the adopted ordinance, resolution, or statute, and confirm its effective date and current status.
- Match the site and use. Check whether the property falls within the measure’s geography and whether the facility meets its definition or threshold.
- Identify the blocked step. Look for language about filing, acceptance, review, processing, approval, permit issuance, or occupancy, and compare it with the approvals the project still needs.
- Establish the project’s status. Confirm whether applications were submitted, approvals or permits were issued, rights vested, or construction began before the effective date.
- Read exceptions and time limits. Check maintenance, safety, accessory-use, expansion, early-termination, renewal, and sunset provisions.
- Confirm applicable state and local protections. The treatment of existing approvals and local authority depends on the governing law; the examples here do not establish a universal rule.
