There is no single environmental-review process for every federally assisted housing project. The program, funding, planned activity, site, and agency determine what review applies and who is responsible. HUD projects generally follow either HUD’s Part 50 process or an authorized responsible entity’s Part 58 process; USDA Rural Development now follows USDA’s department-wide NEPA framework in 7 CFR part 1b, after its former part 1970 was rescinded in 2026.

What determines whether a housing project needs a review?

Federal environmental review evaluates a project’s potential environmental effects and whether site conditions could adversely affect residents. The required route and level of analysis depend on the specific assistance and activity—not simply on whether a project is called affordable or federally assisted housing.

Start with the funding program and the work proposed. New construction, acquisition, rehabilitation, and activities without physical changes may be treated differently. The site also matters: the review may need to address conditions or laws relevant to that location and activity. A determination for one program or project should not be assumed to apply to another.

HUD’s environmental requirements can involve NEPA and other federal authorities. Depending on the project, relevant checks may include Part 51 criteria such as noise and hazardous operations, Part 55 floodplain and wetland requirements, historic-preservation obligations, and other applicable laws. These are not a universal checklist for every site.

Who conducts a HUD environmental review?

HUD projects generally follow one of two routes. Under Part 50, HUD conducts the review. Under Part 58, a responsible entity may assume the federal review responsibility only when the governing program statute permits it. HUD identifies states, tribes, and units of general local government as potential responsible entities; a local government does not automatically have authority for every HUD program.

Part 58 An authorized responsible entity owns the review’s scope, content, and finding. Only when the governing program statute permits assumption of the federal review responsibility.

HUD’s program-specific rules determine the route. Confirm it with the administering agency before assuming that a city, state, or other recipient can conduct the review.

When must clearance happen, and how can it affect the schedule?

For covered HUD activities, environmental clearance must come before the commitment or expenditure of project funds. The applicable review level depends on the assistance and activity, so environmental review can influence site selection, design, funding sequence, and construction timing.

Do not treat every activity as requiring the same review. For example, HUD’s notice on public housing agency activities describes tenant-based rent subsidies without physical changes as generally not requiring a NEPA review in the same way as site acquisition or development. That example is specific to its context; other requirements may still need consideration.

  1. Identify the program and funding. Ask the administering agency which environmental-review rules govern each funding source.
  2. Describe the proposed activity and site. Include the planned physical work and enough site information for the responsible reviewer to determine the applicable scope.
  3. Confirm who has review authority. For HUD, establish whether Part 50 applies or whether the program allows an authorized responsible entity to proceed under Part 58.
  4. Sequence commitments and work around clearance. Confirm the program-specific restrictions before committing or spending covered funds or beginning project activities.

What is the current USDA Rural Development framework?

USDA Rural Development’s former environmental-review rule, 7 CFR part 1970, was removed in a 2026 final rule as USDA consolidated agency procedures into its department-wide framework, 7 CFR part 1b. USDA announced on May 12, 2026, that Rural Development programs would follow the modernized NEPA rule. For current purposes, applicants should not rely on part 1970 as the governing rule.

The public USDA material identified here does not establish a complete housing-specific applicant workflow under part 1b. Do not carry over classifications, thresholds, or steps from the rescinded part 1970. Contact the appropriate Rural Development environmental official for a project-specific determination. A Rural Development page that still describes part 1970 as in effect conflicts with the later final rule and USDA’s May 2026 announcement; its reference to State Environmental Coordinators may be a contact lead, not confirmation of the current technical process.

What does the HUD–USDA agreement announced in September 2026 change?

HUD and USDA announced a memorandum of understanding on September 29, 2026, to coordinate environmental review for jointly funded housing. The announcement describes goals and work to be developed, not a complete joint procedure already in operation.

  • The departments will evaluate categorical exclusions for housing funded by HUD and USDA; the announcement does not establish a new categorical exclusion.
  • They will develop a process to designate a lead agency and streamline adoption of the other department’s approved environmental assessments and environmental impact statements for jointly funded housing. No completed process or implementation date was announced.
  • The agreement calls for maintaining compliance with Part 58 as it stood on January 1, 2025, subject to any categorical-exclusion changes made through standard rulemaking.
  • The departments will evaluate whether joint physical inspections are feasible.

The announcement does not say that one agency’s clearance automatically satisfies the other agency’s requirements. For a project with both HUD and USDA assistance, confirm each program’s authority, review responsibility, and applicable clearance before relying on document adoption or a single lead-agency process.

Where can you find HUD review records and public-comment details?

HUD’s online environmental records resources make environmental assessments and categorically excluded reviews available and surface records that are in public-comment periods. HUD says tiered reviews are available for five years. For a live review, use the comment contact and instructions in that individual record rather than assuming a general process applies.
