The agency first decides how design and construction will be packaged—for example, separately or together—and then selects a contractor using the solicitation’s stated award method. A tunnel contract may go to the lowest responsive and responsible bidder, or it may be awarded through a best-value evaluation; design-build alone does not determine which rule applies.
Delivery method and award method are different choices
The delivery method determines how design and construction responsibilities are organized. The award method determines how the agency compares bidders or proposing teams and chooses a contractor. These choices interact, but one does not automatically dictate the other. The applicable law and solicitation govern the specific project.

How a public agency typically moves from solicitation to contract
The exact sequence varies with the jurisdiction, funding, delivery method, and project documents. In a common two-phase design-build procurement, the agency first evaluates qualifications and shortlists teams; shortlisted teams then submit technical and price proposals. Other procurements may use sealed bids or a different authorized process.

- Choose the delivery and procurement approach. The agency determines how design and construction will be packaged and which procurement and award method is authorized for the project.
- Prepare and publish the solicitation. The agency issues the applicable request for qualifications, request for proposals, invitation for bids, or other procurement documents. These set out scope, schedule, qualification requirements, pricing format, evaluation criteria, submission instructions, and required approvals. - Qualify or shortlist teams when the process requires it. In a two-phase design-build process, firms typically submit statements of qualifications in response to an RFQ. The agency evaluates eligibility and qualifications, then may invite shortlisted teams to submit full proposals. FHWA describes three to five teams as a common shortlist range among agencies discussed in practices reported in a 2002 survey; this is historical practice, not a current universal rule or required number. - Receive and evaluate bids or proposals. Depending on the process, the agency may evaluate sealed bids, technical proposals, prices, or a combination. A two-phase design-build solicitation commonly requests technical and price proposals from shortlisted teams. If authorized and stated in the documents, the process may also include discussions, alternative technical concepts, revised proposals, or best and final offers. Evaluation must follow the disclosed rules.
- Select the apparent winner under the stated award method. In sealed bidding, the award is generally made to the lowest responsive and responsible bidder. In a best-value procurement, the agency weighs price and performance factors as disclosed in advance. FTA Circular 4220.1E, as reproduced in the Federal Transit Administration’s Best Practices Procurement Manual discussion of sealed bidding, states: “A firm fixed-price contract award will be made in writing to the lowest responsive and responsible bidder.” See FTA Best Practices Procurement Manual.
- Document the decision, secure required approvals, and execute the contract. The agency records the evaluation and selection, completes any applicable funding or oversight approvals, announces or makes the award under the governing process, and signs the contract. Does the lowest bidder always win?
No. Lowest-price selection applies when the governing process uses sealed bidding or another price-based award rule. Under that approach, the apparent low bidder still must satisfy two separate tests:
- Responsive: The bid complies with material requirements in the solicitation, such as required forms, bid security, and the specified scope and pricing format.
- Responsible: The bidder has the capability and qualifications to perform the contract, as assessed under the applicable rules.
A bid can be low but fail one of these tests. In a best-value procurement, the lowest price may also lose if another proposal scores better on the disclosed combination of price and performance. The live solicitation and governing law—not a general description of public contracting—establish which result applies.

What agencies can evaluate in a best-value competition
The solicitation should tell competitors what the agency will assess and how criteria are weighted. Depending on the project and method, criteria may cover:
- Relevant experience, qualifications, staffing, and capacity
- Technical design and construction approach
- Work sequencing, schedule, and management plans
- Past performance and plans for addressing procurement or delivery challenges
- Compliance with mandatory requirements and proposed price
Ohio Administrative Code Rule 153:1-6-02 provides a specific state example, not a nationwide template. Effective May 19, 2026, it requires a two-step best-value process for covered design-build procurements, with a one-step process permitted for projects valued below $4 million. The rule requires the authority to set qualifications criteria and establish and weight proposal-phase performance and pricing criteria; possible performance factors include schedule, approach, sequencing, performance history, procurement-difficulty plans, technical design, personnel, and management. To understand a particular competition, check the solicitation for the delivery method and risk allocation, qualification and shortlisting rules, scored technical and price factors and their weights, responsiveness and responsibility tests, schedule expectations, rules for discussions or revised proposals, required approvals, and how the agency records its award decision. A factor described as common guidance is not automatically a binding criterion for a live project.
What tunnel projects change—and what they do not
Tunnel work can involve demanding technical design, construction sequencing, schedule, and management questions, but the official sources cited here do not establish a separate nationwide “tunnel award” rule. The applicable procurement still depends on the agency’s authority, project funding, chosen delivery model, and solicitation.

Washington State Department of Transportation’s SR 99 bored tunnel design-build project illustrates why project-specific materials matter: WSDOT’s project page lists the RFQ, a best-value equation, and a contract award notice. Use the current solicitation and the governing procurement law to confirm the criteria, weights, deadlines, permitted discussions or revisions, protest process, and approvals. Check the agency’s posted addenda and official notices as well as the original documents; amendments can change requirements. For transportation and federally funded work, confirm which agency conducts the procurement and which entity provides oversight before relying on a general description of the process.
