There is no single “allied countries” regulatory pathway for in vitro diagnostic (IVD) products. Before offering an IVD in another market, identify the exact countries and territories, determine the product’s intended purpose and classification in each, and verify that market’s authorization, local-party, labeling, and post-market requirements with its regulator.

What information do you need before checking a market?

Start with the product and the claims you plan to make. A label such as “test kit” is not enough to establish its regulatory status: intended purpose and risk can affect classification and the evidence a regulator requires.

  • Record the target analyte or condition, specimen type, intended users, and use setting, such as a laboratory, point-of-care setting, or self-testing.
  • Document the precise performance and clinical claims, along with the product configuration: test, instrument, calibrator, control, accessory, software dependency, or service.
  • Keep separate records for different configurations or intended uses if their claims, users, or components differ.

The TGA’s overview of medical-device and IVD regulation describes intended purpose and risk as the basis for classification and places responsibility for classification on the manufacturer. Do not assume a classification assigned in one market carries over to another.

How do you verify requirements country by country?

  1. Name each destination. Replace “allied countries” with specific countries and, where relevant, territories. Treat the EU, Great Britain, and Northern Ireland as distinct destinations rather than one combined market.
  2. Find the current official route. Use the destination regulator’s current guidance and applicable legislation to establish the product class, conformity-assessment route, whether third-party review is required, the technical or performance evidence needed, and any pre-market authorization or listing steps.
  3. Separate product and establishment obligations. Check authorization for the device independently from manufacturer or importer registration, device listing, quality-system audit, and local representative requirements. One record or audit should not be treated as a substitute for another unless the regulator says so.
  4. Identify the legally responsible local parties. Determine whether the market requires an authorized representative, responsible person, sponsor, importer, or establishment licence holder. A distributor may not automatically fulfill every required role.
  5. Verify official records. Search the regulator’s own database and match the legal manufacturer, product name and model, class, authorization number, intended purpose, certificate scope, manufacturing sites, and validity dates. Keep a dated copy of the record checked.
  6. Check obligations after launch. Confirm local-language and label/IFU rules, traceability or UDI obligations, complaint handling, incident reporting, field-action procedures, and change-notification rules. Record who will handle each task.
  7. Maintain a dated market matrix. For each destination, track the classification basis, applicable regulation and version, authorization route, supporting evidence, authorized manufacturer and sites, local parties, label/IFU version, official record and check date, vigilance contact, and next review date. Recheck before launch and when the product or rules change.

Does FDA approval let you sell in another country?

No. An FDA decision does not automatically authorize sale outside the United States, and foreign authorization does not replace applicable U.S. requirements. The FDA’s “Importing Medical Devices and Radiation-Emitting Electronic Products into the U.S.” page explicitly says it does not recognize regulatory authorizations from other countries as a substitute for U.S. requirements.

For the United States, use the FDA’s “Overview of IVD Regulation” to determine which obligations apply to the specific device. Depending on its status, those may include premarket authorization, establishment registration and device listing, quality-system requirements, labeling, and reporting. FDA registration is not device authorization; where premarket authorization is required, registration and listing alone do not permit marketing. FDA’s IVD overview also notes that safety and effectiveness assessment considers the patient-health impact of false-negative and false-positive performance.

What differs across the UK, Australia, Canada, and Japan?

These examples illustrate why a market-by-market check matters. They do not establish a single pathway for other countries or products.

Great Britain MHRA says medical devices, including IVDs, must be registered before placement on the Great Britain market. Great Britain’s route remains under UK MDR 2002, with transition provisions. A manufacturer based outside the UK must appoint a UK responsible person, who handles MHRA registration and specified tasks. MHRA lists qualified CE-mark transition provisions. Eligibility depends on the applicable conditions and exceptions; check its current guidance rather than assuming a CE mark is sufficient.
Northern Ireland and EU Member States EU IVDR has applied in EU Member States and Northern Ireland since 26 May 2022. Check the applicable route for the specific destination and product. Confirm the local roles and records required under the applicable EU IVDR requirements. Do not treat Great Britain’s route or transition provisions as interchangeable with the EU and Northern Ireland framework.
Australia Verify classification and conformity evidence, and confirm the device is included in the Australian Register of Therapeutic Goods (ARTG) before lawful supply or import. The Australian sponsor is the person or company legally responsible for supply. Check the sponsor and ARTG entry. The TGA may consider specified overseas evidence under its April 2026 version 2.1 guidance. This is an assessment route subject to stated conditions, not blanket mutual recognition.
Canada For commercial imports, Class II, III, or IV devices generally require a medical device licence (MDL). Class I devices generally do not require an MDL. The importer generally needs a medical device establishment licence (MDEL) covering import activity, subject to exemptions. Use Health Canada’s active MDL and MDEL databases to check records. Do not assume an authorization from another country replaces Canadian licensing requirements.
Japan Determine the Japan-specific IVD authorization requirements from official Japanese sources; the MDSAP resource is not a complete product-authorization determination. Use FDA’s MDSAP International Regulations resource as a pointer to PMDA regulatory information, then verify the requirements and records with the relevant Japanese authority. MDSAP is an audit program, not authorization to market a particular product in Japan.

The MHRA’s “Regulating medical devices in the UK” page, last updated 20 February 2026, describes transition provisions for certain EU IVDR-compliant IVDs through 30 June 2030 and certain EU IVDD-compliant IVDs until the sooner of certificate expiry or 30 June 2030. Qualifications and exceptions apply. Verify that the specific device is eligible under the current guidance before relying on a transition.

For Australia, some self-testing IVDs are currently prohibited from supply, making the intended use especially important. The TGA’s April 2026 guidance identifies examples of overseas evidence it may consider, including specified FDA 510(k) or PMA decisions, Health Canada licences, EU certificates, and Japanese MHLW/PMDA approvals. Whether any evidence is suitable depends on the TGA’s current criteria and assessment.

How do you check whether an IVD or importer is licensed?

Use the destination regulator’s official records, not a distributor’s statement or a certificate image by itself. Check the device authorization and the responsible businesses separately. For Canada, Health Canada provides active databases for medical-device licences and establishment licences; check the applicable MDL and the importer’s MDEL, including whether an exemption applies. For Australia, verify the ARTG entry and sponsor. For Great Britain, confirm MHRA registration and the appointed UK responsible person where required.

When reviewing a record, compare its legal manufacturer, device identity and model, intended purpose, class, authorization or licence number, covered sites, scope, and validity status with the product you actually plan to sell. A record for a different model, purpose, manufacturer, or site may not establish authorization for your configuration.

What should you compare before choosing launch markets?

Compare named destinations using the same criteria, then confirm details with each regulator. Relevant comparison points include product class and risk, local review and authorization route, permitted use of foreign evidence, local representative or sponsor obligations, language and labeling requirements, evidence burden, vigilance and change-control duties, and any transition window. The authorities cited here do not establish comparable review timelines, so do not infer that one market will be faster from this information alone.

Make the final decision against the exact product, claims, configuration, legal manufacturer, and supply chain. Regulatory status can change, and a previous certificate or database check is not a substitute for confirming current eligibility at launch.
