Its licensing business, Qualcomm Technology Licensing (QTL), offers rights to patents used in cellular devices; Qualcomm Technologies, Inc. (QTI) runs the product and engineering businesses, including the chipset business QCT. Qualcomm’s public 5G handset materials describe two license options, with stated rates of 3.25% or 5% of a branded 5G handset’s net selling price, depending on portfolio scope. These are Qualcomm’s published program descriptions—not a universal schedule for every negotiated contract.
Who licenses the patents, and who sells the chips?
Qualcomm’s FY2025 Form 10-K distinguishes its licensing and semiconductor businesses. QTL is operated by QUALCOMM Incorporated, which owns most of the patent portfolio. QTI operates substantially all of Qualcomm’s engineering, research and development, and product businesses; QCT is its semiconductor business. For a phone maker, that means patent rights and chip purchases are distinct commercial matters: a chipset order is not itself the patent license. This distinction explains the business structure, but does not by itself settle legal disputes about licensing practices or establish what obligations apply when a manufacturer uses a competing modem.
What rights can a handset license cover?
A standard-essential patent (SEP) is a patent considered necessary to implement a particular technical standard. Qualcomm says it has informed standards bodies about patents and applications that might be essential to 3GPP cellular standards and has committed to offer licenses for essential patents consistent with its commitments to those bodies. That does not mean every Qualcomm patent is essential.

Qualcomm describes worldwide cellular SEP licenses for cellular devices. It also offers a broader portfolio option that combines cellular SEPs with other patents Qualcomm says may be useful to licensed products, including other SEPs and patents that are not essential to a standard. Rights to patents Qualcomm has no duty or obligation to license may be negotiated at its discretion. The scope actually covered depends on the agreement.
What rates does Qualcomm publish for 5G handsets?
Qualcomm’s public 5G handset licensing document gives these descriptions for branded 5G-capable handsets. The figures are Qualcomm’s statements in an undated program PDF, not independent findings about what every manufacturer pays.

Qualcomm’s 5G handset licensing document also says it has more than 200 5G licensing agreements. That is a company-reported figure, not an independently audited measure of market share or proof that all agreements use the displayed rates.
The published program uses “net selling price,” while Qualcomm’s FY2025 filing says royalties are generally calculated as a percentage of the licensee’s wholesale selling price of complete licensed products, after certain permissible deductions. The filing also describes minimums, caps and, for some product categories, fixed per-unit royalties. The public rate should therefore not be treated as a simple, universal percentage of a phone’s retail price: contract terms, product category and applicable deductions matter.

How royalties are paid
Qualcomm says QTL licensing revenue consists primarily of per-unit royalties. Under the general approach described in its FY2025 filing, licensees report sales and pay quarterly royalties for products incorporating or using licensed intellectual property. The calculation generally uses a percentage of the wholesale price of the complete licensed product, subject to permitted deductions and contract-specific minimums, caps or fixed amounts. The precise reporting obligations and calculation are set by the relevant agreement.
How standards commitments fit in
Qualcomm says its cellular licensing program is consistent with its commitments to standards bodies and with ETSI’s IPR policy, including FRAND principles (fair, reasonable and non-discriminatory licensing). That is Qualcomm’s stated position, not an independent determination that every particular contract term meets FRAND obligations. The filing describes a commitment to offer licenses for essential patents consistent with its standards-body commitments; it does not make every patent in the broader portfolio essential.

What recent Qualcomm agreements do—and do not—show
Huawei
On October 5, 2026, Qualcomm announced a multi-year broad patent license agreement with Huawei, including cross-licenses across 5G, computing, AI and networking, as well as Qualcomm’s purchase of certain Huawei U.S. patents. Do not confuse handset licensing with Qualcomm’s IoT program
Qualcomm separately describes a cellular IoT licensing program for certain products using cellular modules, asset trackers, smart meters, payment terminals and industrial products using CAT-M or LTE CAT 1–4. Some products using third-party cellular modules may be covered through a module supplier’s license, and Qualcomm offers a direct-license option for certain eligible products.
