To research a U.S. import, classify the actual product under the current Harmonized Tariff Schedule of the United States (HTSUS), then determine its origin and check the duty rules that apply to that product, origin, and entry date. A supplier’s code or a shipment’s departure country is not enough to establish the U.S. classification, origin, or total duties.
What should you establish before importing?
There are several related but separate questions: how the product is classified, which country counts as its origin for the purpose at hand, whether it qualifies for preferential treatment, how it must be marked, and whether additional duties or trade measures apply. The answers depend on the product’s characteristics and manufacturing history, as well as the import date.
The HTSUS is the U.S. schedule for classifying imports. Schedule B is generally used to classify U.S. exports. Both draw on the international Harmonized System (HS): the first six digits are harmonized internationally, but countries can add national digits and set different duty rates. A foreign supplier’s code may therefore be a useful starting point, but it is not necessarily a complete U.S. import code.
As the USITC explains, “The HTS is not a list of all products in trade, but a system of categories that classifies imported products, including new or ‘concept’ products.” A product name that seems obvious in everyday language may not match the relevant legal category.

How do you find the right HTSUS classification?
Describe the article as imported
Start with the product itself, not just its marketing name or a supplier’s description. Record its material composition, function, construction, condition when it enters the United States, and whether it is a set or composite good. Technical specifications, product literature, and photographs can help explain what it is and how it is made.
Read the legal provisions, not just search results
Use the current HTSUS and begin by considering the relevant four-digit heading. Then compare the subordinate provisions and apply the General Rules of Interpretation (GRIs), along with any relevant section and chapter notes. Those legal texts can include definitions, conditions, or exclusions that change which heading applies.

A keyword search may return no match, several plausible matches, or a result that appears right but is ruled out by a note. The USITC advises: “To avoid these kinds of pitfalls, it is best practice to avoid relying on the HTS search tool alone and consult the legal text of the HTS itself after you do a search.” Check the whole provision and its notes before settling on a candidate code.
Use comparable CBP decisions carefully
Search CBP’s CROSS ruling database for decisions involving products with similar materials, functions, construction, and manufacturing details. A ruling can show how CBP applied the legal text to those facts, but it does not automatically decide the classification of a different product. Confirm the cited provision in the current HTSUS because the schedule is revised periodically.

Only U.S. Customs and Border Protection (CBP) issues legally binding classification rulings. If a classification question is material to cost or compliance and remains uncertain, consider requesting a ruling for the specific product and facts.
What does “country of origin” mean in practice?
Origin is not necessarily the country from which a shipment departs, where it is invoiced, or where it passes through customs. Transit or processing in a third country does not, by itself, establish that the product has acquired a new origin. The applicable analysis depends on what determination is needed and on the product’s manufacturing history.

CBP rulings describe substantial transformation as the emergence of a new and different article with a distinct name, character, or use. The result turns on the actual operations and product facts, not a simple count of processing steps or a rule that the last country touched the item. The rules for the purpose being evaluated still matter.

Once you have a candidate classification and origin analysis, verify the current HTSUS provision and applicable measures for the relevant entry date. The HTSUS includes general and special duty columns. A special rate may apply when a product meets the requirements of a trade agreement or preference program; do not assume eligibility from the country name alone.

- Check the ordinary rate: Review the applicable general or special column for the product and entry date.
- Check Chapter 99: Additional duties or restraints may apply depending on the product and origin, so do not stop at the product’s ordinary HTSUS rate.
- Check trade remedies separately: Antidumping and countervailing duty (AD/CVD) orders are separate from ordinary customs tariffs. Their scope and rates require a separate check; they are not simply a standard HTSUS rate.
- Check any applicable quota or other measure: Confirm whether a separate restriction or official instruction affects the import.
There is no reliable single “tariff rate” to infer from a product code alone. A useful duty check ties together classification, origin, preference eligibility, additional measures, and the entry date.
What marking does a foreign-origin article need?
Unless an exception applies, a foreign-origin article must be marked in English with its country of origin. The marking generally must be conspicuous, legible, and permanent to the extent the article or its container permits. CBP describes conspicuous marking as one the ultimate purchaser can find easily and read without strain.
Whether the mark may appear on the container instead of the article, and whether an exception applies, depends on the specific circumstances. Confirm the applicable marking rule for the product rather than assuming that a shipping label or country shown on an invoice is sufficient.
When should you get a broker’s help or request a ruling?
A customs broker can assist with customs entries, but hiring one is not legally required. Importers remain responsible for complying with CBP requirements. The USITC states: “Importers are ultimately responsible for knowing CBP requirements and ensuring their importation complies with all federal rules and regulations.”

A CROSS ruling about a similar item can be informative, but it is not a substitute for a determination based on your own facts. For origin, preference, marking, or trade-remedy questions, make sure you are asking about the particular legal purpose involved; one answer may not resolve the others.
