If your floating-rate loan EMI has become unaffordable, contact your lender through an official channel as soon as possible—ideally before a payment is missed. Ask for a written breakdown of the reset and compare the lender’s available options: a higher EMI, a longer tenure, a combination of both, or part or full prepayment. A switch to a fixed rate may be offered under the lender’s policy, but it is not guaranteed for every loan. The rules below are for India and cover only specified equated-instalment loans, not every floating-rate product.

First, confirm what changed and what loan rules apply

A floating-rate reset can change your EMI, the remaining loan term, or both. The Reserve Bank of India’s directions require covered lenders to communicate the effect of an increase and provide quarterly statements with key account details. The RBI FAQ says the reset framework applies to equated periodic instalment-based personal loans; it should not be treated as a universal rule for every loan product. Check your loan agreement, repayment structure, lender and jurisdiction before assuming a particular option is a right. RBI master directions, updated October 1, 2025; RBI FAQ, January 10, 2025.

Ask the lender to confirm in writing:

  • The benchmark and spread used to set your rate, the revised annualised rate or APR, and the reset’s effective date.
  • Your current principal outstanding, revised EMI, number of instalments remaining and scheduled payoff date.
  • The total remaining interest and every applicable switching, administrative or other charge under each option.

Compare those details with your loan agreement and latest quarterly statement. For covered loans, the RBI requires the statement to include principal and interest recovered, EMI, the number of EMIs remaining, and the annualised rate or APR.

Compare the repayment options the lender can offer

For covered loans, the RBI directions provide for adjustment through a higher EMI, a longer tenure, or a combination, as well as part or full prepayment, subject to applicable instructions. Ask the lender to model each option using your actual balance and rate rather than relying on a generic estimate.

Option What changes What to get in writing
Increase the EMI You pay more each period; the loan may avoid a longer term. New EMI, effective date, payoff date and total remaining interest.
Extend the tenure You make payments for longer, which may reduce the periodic payment but can keep the debt outstanding longer. New end date, total remaining interest, maximum permitted term and confirmation that the schedule does not cause negative amortisation.
Combine an EMI increase and tenure extension The adjustment is split between a higher payment and more time. Exact EMI, payoff date and total remaining cost.
Switch to a fixed rate, if offered The rate structure changes under the lender’s policy and the terms it offers. New rate, how long it applies, conditions, switching charge and whether further switches are allowed.
Make a part or full prepayment A part-payment reduces the balance; full prepayment closes the loan if the lender confirms the payoff amount. Minimum amount, timing, how the payment is allocated, any applicable charge and the revised schedule or closure figure.

Weigh each documented scenario against your monthly budget, total remaining interest and charges, payoff date, exposure to future rate resets, and whether the lender’s policy makes it available. A longer term can ease the monthly payment but does not by itself reduce the cost of borrowing. RBI’s directions state that a tenure extension for a floating-rate loan must not result in negative amortisation. RBI master directions.

Check fixed-rate and prepayment terms before deciding

Fixed-rate switch

A fixed-rate conversion is not an automatic entitlement under the RBI directions. The lender may provide the choice under its board-approved policy, which can limit how many times you may switch. If offered, compare the quoted rate and its conditions with the floating-rate schedule, and include any switching charge in the cost comparison. Ask whether the lender’s quote is fixed for the entire remaining term or for a defined period.

Part or full prepayment

Ask for the lender’s rules on the minimum part-payment, when it can be made and whether it will reduce the EMI, shorten the tenure, or be applied another way. Do not assume prepayment is charge-free for every product or borrower. The Department of Financial Services says banks cannot levy foreclosure or prepayment penalties on floating-rate term loans to individuals for non-business purposes; that stated scope may not fit every lender, loan or borrower. Take action before a missed payment, and keep a record

  1. Contact the lender using an official channel and explain what payment you can realistically manage. Request its available repayment or hardship options in writing.
  2. Get the reset figures and a written repayment schedule for each available option, including total remaining interest and charges.
  3. Choose only after checking the payment against your budget and confirming the new terms, effective date and any fees.
  4. Keep the reset notice, quarterly statements, your requests and the lender’s replies. If you cannot agree on an affordable schedule, continue communicating rather than assuming a payment holiday or waiver has been granted.

There is no universal entitlement to a moratorium, waiver or restructuring approval established by the cited RBI directions. A lender’s decision on relief is separate from whether it handled your account or complaint properly.

Escalate a service complaint through the right route

If the problem is poor service by an RBI-regulated entity—for example, a failure to address a complaint or provide required information—first complain to the lender and retain the response or proof of submission. The Department of Financial Services says a borrower may use the RBI Ombudsman mechanism for certain unresolved service complaints if the lender’s response is unsatisfactory or no reply arrives within 30 days. This is a route for resolving eligible service complaints; it does not require the lender to approve a requested change to the loan. Department of Financial Services, “Banking”.

Do not treat the 30-day complaint condition as a grace period for loan payments. The same government page describes a term loan as becoming a non-performing asset when principal or interest remains overdue for 90 days. That is a classification threshold, not a safe period to wait before contacting the lender; missed payments can have consequences before then. Department of Financial Services, “Banking”.
