Choose a business messaging platform by checking whether it can support your specific messaging program—not by treating “compliant” as a universal certification. Your organization remains responsible for obtaining consent, using messages appropriately, protecting personal data, and meeting the laws and carrier policies that apply to your audience and use case.

Start by defining your messaging program

Before comparing vendors, write down what you plan to send and to whom. Requirements and platform capabilities can differ by channel, message purpose, sender type, and recipient location. Separate marketing messages from transactional notices and authentication messages; do not assume that permission for one automatically covers another.

  • Channel: Identify whether you need SMS, RCS, or another messaging channel.
  • Purpose: Classify messages as marketing, transactional, or authentication.
  • Geography: List the countries or regions where recipients are located.
  • Sender and audience: Specify who sends the messages and who will receive them.

Then ask each vendor for a country-by-country and channel-by-channel matrix showing available sender types, registration or review requirements, permitted use cases, and local policy differences. Treat it as a starting point for your review, not a substitute for checking your own obligations. AWS stresses that customers must follow applicable laws and carrier policies, while Shopify identifies rules such as the GDPR, CPRA, TCPA, EU ePrivacy Directive, and UK PECR as potentially relevant to SMS marketing depending on the region. Verify the full consent and opt-out lifecycle

Ask the vendor to demonstrate the actual journey from opt-in through withdrawal. CTIA describes two starting practices for text marketing: obtaining consumer consent and giving people a way to opt out of further communications. CTIA messaging guidance.

  • Can your intended signup flow capture affirmative consent and show the exact language recipients see?
  • Does the system record when, where, and for what purpose consent was given?
  • Can authorized staff export those records in a form useful for an audit?
  • Can preferences be distinguished by channel or message use where needed?
  • What happens operationally after someone opts out, and how quickly are further messages suppressed?

AWS, for its messaging services, calls for an explicit opt-in flow, disclosure language, links to terms and privacy notices, and maintained consent records. These are AWS service requirements; confirm the requirements for your own channel, region, and program rather than assuming one vendor’s rules apply everywhere. Review disclosures in context

AWS offers this example disclosure for its verification-message service: “Message and data rates may apply. Message frequency varies. Reply HELP for help. Reply STOP to cancel.” It is an example, not a universal legal script. Ask which disclosures apply to your geography, channel, and message purpose, and verify that they are visible in the actual opt-in flow. AWS registration and compliance guidance.

Check customer-facing terms, privacy notices, and support

Your platform should let you implement accurate customer-facing terms and privacy information. Confirm that your notices explain the relevant collection and use of phone numbers, storage, sharing with service providers, and recipient choices. AWS says its customers must publish terms and privacy pages, link them to each other, and provide an accessible support email or phone number. Shopify’s guidance says SMS privacy policies should address number collection, data use and storage, sharing (including with SMS providers), and data-subject rights; terms should cover message frequency, possible data rates, opt-out, and support details. Read the vendor’s own privacy and data-processing terms as well. Check whether the provider’s stated data use, sharing, retention, and subprocessors match what your business tells recipients. A platform feature cannot make an inaccurate notice accurate or resolve a mismatch in how data is handled.

Demand security evidence—and read its scope

Ask for current independent audit reports or certifications, and establish exactly which services, infrastructure, and controls they cover. Also review data residency and retention terms, access controls, incident processes, subprocessors, and exclusions that could affect your use case.

For example, Google says RCS for Business and its RCS infrastructure are independently audited annually and hold ISO 27001, SOC 2, and SOC 3 certifications. Google also states that RCS for Business is not HIPAA compliant. Its product-specific security statements do not establish the status of another provider, channel, or customer workflow. Compare viable platforms on the same criteria

Once a vendor can support your program, compare candidates against the same checklist. Ask for demonstrations and documents rather than relying on a broad claim that a service is “compliant.”

Keep responsibility with your business

A platform can provide controls, records, and security measures that help you operate a responsible messaging program. It cannot by itself establish that your campaign is lawful or that your organization’s privacy practices comply with every applicable rule. AWS explicitly assigns customers responsibility for appropriate consent, applicable laws, and carrier policies; Google cautions that its own processing compliance does not make a customer’s practices compliant. Use the vendor review to surface gaps, then validate the requirements for your audience, channel, and message purpose with qualified counsel and check current vendor terms. This is a procurement framework, not legal advice or a determination that any particular campaign is compliant.
