You may be able to challenge an income-tax assessment under section 153C of India’s Income-tax Act, 1961, if the required satisfaction is missing or the note does not connect identified seized material to you, your income, and the assessment year or years selected. The strength of that challenge depends on the exact note, the applicable law and dates, and the court jurisdiction. First confirm that section 153C applies at all: it does not apply to searches initiated, or requisitions made, on or after 1 April 2021.
First confirm which law and search date govern
Section 153C is a provision of the Income-tax Act, 1961 for proceedings against a person other than the person searched. The Income Tax Department’s published section 153C states that it does not apply in relation to a search initiated under section 132, or books, documents, or assets requisitioned under section 132A, on or after 1 April 2021. Do not assume a newer search assessment is governed by section 153C.
The Department’s official portal lists the Income-tax Act, 2025 and Income-tax Rules, 2026, as well as transition materials. The applicable successor provision and transition treatment for a particular search must be checked against the official law and guidance in force for that case. The discussion below is limited to disputes where section 153C of the 1961 Act is in fact applicable.
What the satisfaction note must connect
Section 153C concerns material found or requisitioned in a search involving one person and proceedings against another. Its statutory test includes whether the Assessing Officer is satisfied that the books, documents, or assets “have a bearing on the determination of the total income of such other person.” A challenge should test the note against that statutory relationship, not simply object that it is brief or uses standard wording.

In Commissioner of Income Tax v. Jasjit Singh (Supreme Court, 6 April 2023), the Court discussed the satisfaction process and the roles of the Assessing Officers. It also addressed the wording change made by the Finance Act, 2015, effective 1 June 2015: for books or documents, the provision moved from “belongs or belong to” to “pertains or pertain to.” The applicable wording therefore depends on the relevant dates and statutory version.

Build a chronology before arguing that the note is defective
Make a single dated chronology from primary case records. Section 153C makes the other-person Assessing Officer’s receipt of the material relevant to its framework, and the notice and assessment dates matter to limitation. A missing or disputed date is a fact to establish, not a defect to assume.

- Search or requisition: record the date and whether the event was a search under section 132 or a requisition under section 132A. This helps determine whether section 153C of the 1961 Act is in scope.
- Satisfaction by the searched-person Assessing Officer: obtain the note and record its date, author, and file.
- Transfer and receipt: identify when the material and satisfaction were received by the Assessing Officer handling the other person, using available forwarding, receipt, or file records.
- Other-person satisfaction: obtain any separate note, including its date and the material and assessment years it addresses.
- Notice and disclosure: record the section 153C notice date and when the note and relied-on material were provided to you.
- Assessment and deadline: record the assessment order date and calculate the relevant statutory deadline under the version applicable to the case. The Department’s limitation guidance covers section 153 timelines; verify the exact provision and any applicable extensions or transition rules rather than relying on a generic date.
Then compare the satisfaction note with the notice and assessment order. Mark mismatches in the person, material, year, or dates, and identify material relied on in the order that the note does not identify. A 2025 Delhi High Court order in W.P.(C) 15923/2023 and a connected matter records issues concerning an undated other-person note, delayed disclosure, and discrepancies raised by the petitioner. Those are useful record checks, not automatic grounds that decide another case.
How to present a challenge
- State the governing version first. Set out the search or requisition date and explain why section 153C and the particular wording of it apply. If the search falls on or after 1 April 2021, verify the governing successor law instead of treating section 153C as controlling.
- Identify the precise record defect. Cite the note by author, date, and file, then identify the specific seized item and the missing or contradictory link. Avoid a general allegation that the note is “mechanical” unless the text and record show what statutory step is absent.
- Address each assessment year separately. For every year challenged, point to the material said to support that year and explain what the note does or does not say about the connection.
- Show the chronology and its source. Set out satisfaction, transfer or receipt, notice, disclosure, and assessment dates, with the records supporting each date. Explain the limitation calculation under the governing provision.
- Use authorities for the proposition they actually decide. Read the full judgment, match its statutory version and facts to your case, and check territorial jurisdiction and subsequent appellate history before relying on it.
- Raise the issue through the procedure and at the stage available in your case. Whether to raise it in assessment proceedings, an appeal, or another proceeding depends on the order, procedural posture, limitation, and jurisdiction. Obtain advice from an Indian tax-litigation professional before selecting a route or deadline.
A satisfaction-note defect can be framed as a jurisdictional challenge, but the label alone does not invalidate an assessment. The court or authority will need the actual note, underlying material, applicable statutory text, chronology, and relevant precedent.

Records to request or preserve
- Every satisfaction note, including any note in the searched person’s file and any separate note in your file.
- The inventory or description of seized or requisitioned material and the specific items identified in the note.
- Records showing transfer or receipt of material by the other-person Assessing Officer.
- The section 153C notice, supporting communications, disclosure dates, assessment order, and relevant file correspondence.
- Documents needed to verify the search date, assessment years, and limitation calculation.
If records are not provided, keep a dated record of what was requested, what was received, and what remains unavailable. The absence of a copy in your possession is not, by itself, proof that no note exists.
