There is no single owner of every AI-generated song. In the United States, a prompt alone does not necessarily make you the copyright author of the resulting music. Your human-written lyrics or other sufficiently creative contributions may qualify for copyright, while the AI service’s contract separately determines what rights it grants or assigns and whether you may use a track commercially. A song can also involve distinct rights in its composition and its sound recording. Whether copyrighted music may lawfully be used to train an AI model remains a separate, unsettled question.

This guide is U.S.-centered and current as of October 7, 2026. Copyright rules vary by country; a platform’s terms are not a ruling on copyrightability or a substitute for applicable law.

What “owning” an AI song can mean

People often use “own” to mean several different things. Separate these questions before deciding whether you can register, release, license, or monetize a track:

  • Copyright authorship: Which parts, if any, contain protectable human-authored expression?
  • Contract rights: What do the AI service’s terms say about the output, commercial use, and the material you submit?
  • Composition and recording: Who controls the musical work and lyrics, and who controls the particular recorded performance?
  • Training: Was copyrighted material used to train the model, and was that use authorized or otherwise lawful?

These questions can have different answers for the same track. A platform may give a subscriber contractual rights to use an output commercially without making every AI-generated element eligible for copyright. Conversely, a human contribution may be copyrightable even when the service’s terms impose conditions on use.

What U.S. copyright protects in a song

U.S. copyright law protects original works of authorship fixed in a tangible medium. The Copyright Act treats a musical work—including accompanying words—and a sound recording as separate kinds of works. A song recording may therefore contain at least two distinct copyright layers: the composition (music and lyrics) and the particular recorded sounds. The physical file or medium is not the same thing as either copyright.

Copyright owners generally have exclusive rights that include reproduction, preparation of derivative works, and distribution. Musical works also have public-performance rights, and sound recordings have a limited digital-audio-performance right, subject to statutory limitations. A license is permission for specified uses; it does not necessarily transfer ownership.

When can a person copyright music made with AI?

The U.S. Copyright Office’s approach is based on human authorship and creative control, not a blanket rule that AI assistance either disqualifies or automatically protects a work. Its Part 2 report says existing copyright principles can address generative AI: using AI in a creative process, or including AI-generated material in a larger human-created work, does not by itself bar protection. The human contribution must still meet copyright requirements.

As Register of Copyrights and Director Shira Perlmutter put it in a January 29, 2025 Copyright Office release: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” The qualification is important: protection depends on the human creativity expressed in the work.

A prompt alone is not a reliable authorship claim

Suno’s explanation of U.S. copyright says that writing a prompt alone does not amount to creating the resulting song for copyright purposes. A prompt may guide a system, but that does not establish that the user made the expressive choices embodied in the output. The relevant question is what protectable expression the person contributed.

Human contributions may qualify, depending on the facts

Human-written lyrics are a clear example of a contribution that may be assessed separately. A person’s original melody, arrangement, performance, selection, or editing may also matter if it reflects sufficient human creativity and control over expressive elements. Merely making changes is not a guarantee: whether a particular edit or selection qualifies must be assessed on the facts. AI-generated material in a larger human-authored work does not automatically prevent the human-authored portions from receiving protection.

The Copyright Office reported that its staff article in 2025 described more than a thousand registered works in which applicants followed its guidance to disclose and disclaim AI-generated material. That figure covers works generally, not AI-generated songs specifically, and is not a measure of what proportion of AI music qualifies. The Office also said it received more than 10,000 public comments by December 2023 in response to its AI and copyright notice of inquiry.

Copyright authorship is different from who owns rights

After identifying any copyrightable human expression, determine who owns it. The Copyright Office says creators ordinarily own their works, but an employer may own a qualifying work made for hire, and rights may be transferred by contract or other transfer. Co-writing, commissioning, employment, and production agreements can change who controls a contribution. Do not assume that the person who typed a prompt—or the person who paid for a service—owns every right in a finished track.

For a specific song, check who wrote or performed each human contribution, whether it was created within employment or a commission, and whether an agreement assigns or licenses rights. For a release involving multiple contributors, review the relevant agreements rather than treating the AI account holder as the automatic owner of the whole song.

What an AI music service’s terms may allow

Platform terms answer contractual questions, not the separate legal question of whether AI-generated expression qualifies for copyright. Suno’s help-center articles illustrate why the service, plan, and generation date matter. The table summarizes Suno’s statements in materials edited on the dates shown; it is not a rule for other services.

For any service, check the version of the terms in force when you generated the track, your subscription tier at that time, and any conditions tied to the particular feature or input. Do not infer that another platform follows Suno’s policy or that “commercial use” means copyright ownership.

Check the rights in material you submit

Suno’s Terms of Service require users to represent that they have the rights and permissions needed for submitted material and permit the service to use submissions to generate output and develop the service or models. Its terms say a user may create a voice model resembling their own voice, not another person’s. These are Suno’s contractual policies, not a complete statement of publicity, privacy, or copyright law in every jurisdiction. Before uploading a sample, existing song, or voice, confirm you have the necessary permissions for that material and the intended use.

How to assess a particular track

  1. Identify the service, model, and generation date. Keep a copy of the applicable terms and any feature-specific rules.
  2. Record the plan in effect when you created it. Note whether it was free or paid and what the service said about ownership and commercial use at that time.
  3. Inventory the human contributions. List who wrote lyrics, composed or arranged music, performed, selected or edited material, and what the AI supplied. Do not assume a contribution is protectable just because it took effort.
  4. Separate the composition from the recording. Identify rights in the music and lyrics separately from rights in the particular recorded sounds.
  5. Check every input and contributor. Confirm permissions for uploaded songs, samples, voices, and collaborators’ contributions; review employment, commission, and co-writing agreements where relevant.
  6. Identify the country whose law applies. This guide covers the U.S. framework; do not apply it as a global rule.
  7. Match the permission to the planned use. Verify that the service terms and any third-party licenses cover the specific release, monetization, distribution, performance, or other use you intend.

Can AI music companies train on copyrighted songs?

That is a different legal question from who owns a generated output or what a platform’s output license permits. The U.S. Copyright Office’s AI initiative covers both copyright in AI outputs and the use of copyrighted material for training. As of October 7, 2026, its official AI page still listed Part 3, “Generative AI Training,” as a May 9, 2025 prepublication report, with a final version forthcoming. Training legality remains unsettled and fact-dependent in this U.S.-focused account; a company’s position in a dispute is not a court ruling.

Licensing announcements also have limited scope. On October 29, 2025, Universal Music Group and Udio announced that they had settled copyright litigation and entered recording and publishing licenses for a planned service using authorized and licensed music. Udio’s November 19, 2025 announcement said its arrangement with Warner Music Group resolved their litigation and described a future service involving participating artists’ voices and styles. These announcements do not establish the training or output rights for every model or user.

Axios reported on September 9, 2026 that Suno launched v6 models developed with Warner Music Group, BMG, and Believe. The report said v6 was trained partly on licensed Warner music and participating artist material; the financial terms were undisclosed. That dated report does not reveal the full scope of private agreements or establish that all Suno models, outputs, or catalogs share the same licensing status.

There are also questions about how label licenses interact with performer agreements. In an August 21, 2026 litigation update, the American Federation of Musicians said it had filed a suit alleging that labels failed to notify or compensate covered musicians after licensing recordings to AI platforms. This is the union’s allegation in pending litigation, not a finding of liability. It illustrates that label authorization, performer contracts, union compensation provisions, and a user’s rights in an output are distinct matters.

Does a license make an AI song copyrightable?

No. A license can authorize particular uses of material or an output under a contract, but it does not determine whether the output contains human-authored expression that qualifies for copyright. Likewise, copyright eligibility does not by itself establish that you have permission to use an AI service’s output under its terms or to use third-party inputs. Evaluate the copyright, contract, and input permissions separately.

What this means outside the United States

This article describes U.S. copyright principles. Approaches to AI-generated works differ internationally, as the Copyright Office staff has noted. The applicable law may depend on where protection is sought, where an act occurs, and the relevant agreements. If you plan to release or license a track in another country, check that jurisdiction’s rules rather than assuming the U.S. human-authorship analysis controls.
