Yes. U.S. federal law enforcement can compel some data held by covered technology providers, but the legal process depends on the information sought and the circumstances. A subpoena, a court order and a warrant are not interchangeable, and constitutional protections may also apply.
What this U.S. overview covers
The framework described here focuses on U.S. federal law enforcement seeking information from electronic communication and remote computing service providers under the Stored Communications Act (SCA), 18 U.S.C. §§ 2701–2712. It is not a complete account of intelligence authorities, state-law rules, civil investigations or other countries’ laws. The rules for a particular demand can depend on its purpose, the type of provider and the records requested.
What legal process can the government use?
The Department of Justice’s Justice Manual describes three routes under the SCA: a subpoena, a court order under 18 U.S.C. § 2703(d), or a search warrant. Which route is available depends on the category of information and the circumstances. The Congressional Research Service’s summary of the SCA likewise distinguishes stored communication content from non-content records and notes that constitutional protections remain relevant.

Content, such as stored messages, and non-content information, such as subscriber or transactional records, can be treated differently under the statute and constitutional law. The existence of one legal route does not mean it can be used for every category of information. For a specific demand, the governing statute, case law and facts matter.

Will a company tell you if the government asks for your data?
Not necessarily. The DOJ says the SCA does not by default prohibit a provider from notifying a user. But under 18 U.S.C. § 2705(b), the government can obtain a protective order barring notice. Whether a customer learns about a request therefore depends, among other things, on whether such an order applies.
Can the government preserve data before it obtains disclosure?
Yes. Preservation is different from turning records over. Under 18 U.S.C. § 2703(f), a provider must take necessary steps to preserve records and other evidence in its possession when the government requests preservation while it pursues legal process. The statutory preservation period is 90 days and may be extended once for an additional 90 days on a renewed request. The period and extension are set out in the statute as accessed in 2026.

Can U.S. agencies obtain data stored in another country?
Storage location alone does not settle the question. The DOJ’s 2019 white paper explains that the CLOUD Act clarified that providers subject to U.S. jurisdiction may be required to produce data within their possession or control regardless of where it is stored. The department’s Cloud Act FAQ emphasizes that jurisdiction over the provider and possession or control of the data matter; whether a provider controls data held by a subsidiary can be fact-dependent. This is a U.S. framework, not a universal rule or a guarantee that every overseas record is reachable. As the DOJ white paper puts it, “The CLOUD Act does not create any new form of warrant.”
Does the Fourth Amendment require a warrant for every kind of digital record?
No universal warrant rule follows from the Supreme Court’s decision in Carpenter v. United States (2018). In the circumstances before it, the Court held that the government’s acquisition of historical cell-site location information (CSLI) was a Fourth Amendment search requiring a warrant supported by probable cause. The Congressional Research Service describes the case as involving historical CSLI obtained under an SCA court order. The holding should be kept to that kind of location information and those circumstances; it does not automatically resolve the rules for every record held by a technology company.

What should you check when a specific request is at issue?
- Jurisdiction: Confirm which government and legal system are involved; this article describes a U.S. federal framework.
- Information sought: Identify whether the request concerns message content, subscriber details, transactional records or location information.
- Process and scope: Determine whether the demand is a subpoena, a § 2703(d) order or a warrant, and what records and time period it covers.
- Notice restrictions: Check whether a nondisclosure order limits what the provider may tell the customer.
- Provider control: For data stored abroad or by an affiliated company, assess jurisdiction and possession or control rather than relying on storage location alone.
