You can report workplace discrimination without giving up your protection from retaliation, but no reporting route can guarantee confidentiality or prevent every adverse decision. If you work for a private, state, or local employer, you can raise the issue internally, contact the U.S. Equal Employment Opportunity Commission (EEOC), or consider both. Do not let an employer investigation or grievance process cause you to miss an external filing deadline. Federal employees and applicants generally follow a separate process that begins with contacting an agency EEO Counselor within 45 days.

Choose the reporting route that fits your workplace

An internal report and a formal EEOC charge are separate processes. Reporting to HR does not itself file a charge with the EEOC, and filing with the EEOC is not the same as asking your employer to address a problem through its internal policy.

For harassment, the EEOC advises workers to check the employer’s anti-harassment policy and raise the issue with a supervisor or HR. If the supervisor is involved, another appropriate contact may be a better starting point. These are options, not guarantees that an internal channel will resolve the matter. Make a clear, factual record

Before reporting, write down the events as specifically as you can. The aim is to communicate what happened and why you believe it relates to discrimination, not to prove the entire case in your first message.

  • Record dates, locations, what was said or done, and who was involved.
  • Identify the protected basis you believe is involved, such as race, sex, disability, age, religion, or another basis covered by applicable law. The laws and protected categories that apply can vary by claim and jurisdiction.
  • Note potential witnesses and preserve relevant messages or documents you can lawfully access. Do not take confidential or restricted records you are not authorized to have.
  • Keep a copy of your report and any responses where workplace rules and law permit.

The EEOC’s charge instructions ask for a short description of the alleged discriminatory actions and their dates. A private log is practical preparation, not a special recordkeeping method the EEOC requires. Details about starting a charge are on the EEOC charge-filing page.

Report internally, if appropriate

  1. Check the policy. Find the anti-discrimination or anti-harassment policy and identify the designated reporting contacts and procedure.
  2. Choose a suitable recipient. Use the policy’s contact where possible. If your direct supervisor is implicated, consider HR or another designated manager or reporting channel.
  3. State the concern plainly. Say that you believe the conduct is discrimination or harassment, describe the relevant incidents, and ask the employer to address them. Legal terminology is not required. For internal opposition to discrimination to be protected, it generally must be reasonably clear that your objection concerns unlawful discrimination and be based on a reasonable, good-faith belief.
  4. Keep a permitted copy. Save your report and the employer’s response in a way consistent with workplace rules and your lawful access to records.

Internal reporting may help the employer respond, but it does not guarantee confidentiality, a particular outcome, or an extension of an EEOC deadline.

Check the EEOC deadline immediately

For most covered employment discrimination claims outside the federal-sector process, the general EEOC charge deadline is 180 calendar days from the discriminatory act. It may be extended to 300 calendar days when a qualifying state or local agency enforces a law prohibiting discrimination on the same basis. For age discrimination, the 300-day extension requires a state law and state agency; a local-only age law does not extend the deadline.

Federal employees and applicants generally must contact an agency EEO Counselor within 45 days, subject to possible exceptions. The federal-sector process is different from filing an ordinary EEOC charge. If you are unsure which rule applies, check the EEOC’s time limits for filing a charge and contact the EEOC or relevant state or local agency promptly.

Do not assume that HR’s investigation, a union grievance, arbitration, or mediation will stop the clock. The relevant deadline can depend on the claim, location, employment category, and date of the event, so these general periods are not a way to calculate an individual filing date.

Start an EEOC inquiry or file a charge

For covered non-federal employment claims, the EEOC Public Portal begins with an inquiry and an interview arrangement. A charge is the formal, signed statement requesting agency remedial action. The EEOC says a charge is generally required before filing a lawsuit under most laws it enforces, with an exception for the Equal Pay Act. A charge is not an agency determination that discrimination occurred.

You can begin through the EEOC Public Portal. The EEOC also accepts a mailed letter containing your contact information, the employer’s information, a brief account of the alleged discriminatory actions and their dates, the suspected basis, and your signature. If 60 days or fewer remain before the deadline, the EEOC says special fast-filing instructions are available; contact the agency promptly rather than relying on ordinary scheduling.

Filing a charge requires notice to the employer. An EEOC charge is therefore not a confidential alternative to an internal report, although anti-retaliation law prohibits punishment for protected activity.

Understand retaliation protection—and its limits

EEOC anti-retaliation protections generally cover qualifying opposition to conduct believed to violate equal employment opportunity law and participation in covered EEO proceedings, such as a charge, investigation, or lawsuit. The standards for opposition and participation are not identical: internal opposition generally involves a reasonable, good-faith belief and a clear enough objection, while a person need not prove the underlying discrimination claim to receive protection for participating in an EEOC proceeding.

Retaliation is not limited to firing. Depending on the circumstances, it may include an unjustifiably poor evaluation, an undesirable transfer, threats or abuse, increased scrutiny, false rumors, deliberately difficult scheduling, or adverse treatment of a family member. Whether a particular action is unlawful depends on its context and facts. Employers may still take legitimate, non-retaliatory actions, and workers remain responsible for their job duties and applicable workplace rules.

If adverse treatment follows your report

If something changes after you report discrimination or take part in an EEO process, make a separate factual record of the new event. Note when it happened, what action was taken, who made or communicated the decision, the explanation given, and why you believe it is connected to your protected activity. You can report the new concern through an appropriate workplace channel and contact the EEOC or relevant agency about your options and deadlines.
