If it feels safe, you can say, “I don’t want to be recorded. Please stop.” Then note what happened and preserve relevant evidence. Whether the recording was unlawful depends on your location, what was captured, where it happened, and whether it was shared or used to threaten you.
What to do first if someone is recording you
Put your safety ahead of collecting proof
Move to a safer place or toward other people if that would help. If the person threatens you or you are in immediate danger, contact local emergency services or a trusted person. Emergency numbers and response options vary by location. Do not grab the device, physically block the person, or put yourself at risk to get evidence.
Set a boundary only if it feels safe
You can calmly say, “I don’t want to be recorded. Please stop.” This makes your objection clear, but it does not by itself establish that the recording is illegal or necessarily require the other person to stop. If speaking up could escalate the situation, skip it.
What to document and preserve
When it is safe, write down the facts while they are fresh. Separate what you directly observed from what you suspect—for example, note that a phone was pointed at you rather than asserting that it captured audio if you do not know.

- Date, time, and location, including whether the space was private or publicly accessible.
- Who appeared to be recording, what device they used, and whether it seemed to capture audio as well as video.
- What was said, whether you asked them to stop, and how they responded.
- Names or contact details for witnesses, if you can collect them safely.
- Any threats, repeated unwanted behavior, or later use or sharing of the recording.
Keep relevant messages, links, screenshots, and the dates and times you found or received them. Online material can disappear, so preserve its location and context where safe. If the person has access to your accounts or devices, store copies somewhere they cannot reach. Do not repost intimate material to prove what happened; that can spread it further.
Is it illegal to record someone without consent?
There is no single worldwide answer. Laws vary by country and, within some countries, by state or province. A verbal objection is important context, but it does not settle the legal question on its own. The Bureau of Justice Assistance’s body-worn-camera guidance tells U.S. agencies to examine applicable state, local, and tribal laws; that guidance concerns agency cameras, not a universal rule for private individuals.

The facts that often matter include:
- Where it happened: a publicly observable scene can raise different privacy questions from a home, restroom, changing area, or other private setting.
- What was recorded: audio of a conversation may be governed by rules different from those for video or images of private activities.
- Who was speaking: whether the recorder was part of the conversation can matter under some laws.
- What happened afterward: making a recording and publishing it, sending it to others, or threatening to distribute it may raise separate legal issues.
- How the person behaved: harassment, trespass, coercion, or threats may be relevant apart from the recording itself.
Local examples illustrate why location matters. Washington LawHelp discusses rules concerning private conversations in Washington. Legal Aid Queensland describes Queensland-specific privacy considerations, including distinctions between public places and private activities. Neither source establishes the law elsewhere. For a legal conclusion, a local adviser needs the incident’s location and details.
What if someone secretly recorded you in a private place?
A covert recording in a home, restroom, changing space, or during an intimate activity raises different concerns from ordinary filming in a publicly observable place. Do not assume that every private-space recording is automatically illegal, or that a public setting makes every recording or later use lawful. The applicable rules depend on the jurisdiction and the activity captured.

If you suspect a hidden or covert recording, prioritize leaving the space and getting support. Record what led you to the concern and any related messages or threats. Avoid confronting the person alone if that could put you at risk. A local lawyer, legal-aid service, police service, or relevant privacy authority can advise which route fits your circumstances.
What if an intimate image or video is shared—or someone threatens to share it?
Consent to creating an intimate image is not the same as consent to distribute it. The U.S. Department of Justice’s Office on Violence Against Women makes this distinction in its guidance on sharing intimate images without consent. A threat to share can also be a reason to seek urgent support and local legal advice, even if the material has not appeared online.

If the material is online
Report it directly to the platform and preserve the post’s link, screenshots, messages, and dates where safe. In the United States, the Federal Trade Commission’s September 2026 guidance describes a Take It Down Act process for qualifying intimate images on covered platforms: those platforms must remove qualifying images and copies within 48 hours of a request. That process is limited to its U.S. legal scope and is not a general removal guarantee for all recordings or locations. The FTC also points to StopNCII.org, which uses image fingerprints to help participating platforms identify and block intimate images.
In Singapore, the Online Safety Commission has a specific intimate-image-abuse reporting process and lists useful supporting evidence such as screenshots, links, messages, and dates. Reporting routes and available remedies differ by jurisdiction.

Do not forward or repost the intimate image, even to demonstrate what happened. If you are a minor or the image involves a minor, seek help from a trusted adult and appropriate local authorities or support services; do not copy or circulate the image.

Choose a reporting route based on the setting and what happened. You may need more than one, but you do not have to resolve the legal question before asking for support.
- Immediate danger or threats: contact local emergency services or police.
- At a venue or event: notify management or security if doing so is safe.
- At work or school: consider the relevant safeguarding, human-resources, or conduct channel.
- Online publication: report the content to the platform, preserving its URL and context where possible.
- Privacy concerns: ask a local privacy regulator or legal-aid service which rules apply. Legal Aid Queensland, for example, recommends seeking legal advice when someone believes their privacy has been invaded in Queensland.
- Intimate-image abuse: contact a victim-support service as well as the platform or jurisdiction-specific reporting service; support can help with safety planning and next steps.
For incident-specific legal advice, tell the adviser where the recording happened, whether it captured audio, whether the recorder was part of a conversation, what kind of space it was, and whether the material was shared or used to threaten you. Those details can change the analysis; this guide cannot determine whether a particular recording was lawful or whether evidence will be admissible.
