A data breach is unauthorized access to, acquisition of, disclosure of, or loss of control over information. A data leak usually describes information becoming exposed to an unauthorized audience, often through accidental sharing or a security weakness. The terms overlap, though: there is no universal rule that “breach” means hacking while “leak” means an accident. To understand an incident, look at what information was exposed, who could access it, and whether that access was authorized.

What is the difference between a data breach and a data leak?

In everyday use, “data breach” often names the broader security incident, while “data leak” emphasizes that information escaped or became visible to people who should not have it. That distinction can help explain what happened, but it is not a consistent technical or legal boundary.

NIST defines a breach broadly. Its glossary includes loss of control, compromise, unauthorized disclosure or acquisition, and actual or potential access by an unauthorized person. It also includes an authorized user accessing information for an unauthorized purpose. See NIST’s breach glossary entry. The CISA NICCS glossary lists “data leakage” as a synonym for “data breach.”

Accidental exposure is a real possibility, not a reason to rule out a breach. NIST’s CSRC glossary defines inadvertent disclosure as: “Type of incident involving accidental exposure of information to an individual not authorized access.” The glossary attributes that definition to CNSSI 4009-2022; see NIST’s inadvertent-disclosure entry.

How to describe an incident accurately

Rather than relying on one label, describe the facts that determine the incident’s scope and risk. These questions are useful for communication and triage; they do not replace a legal test.

  • Was information disclosed, or merely at risk? Distinguish confirmed exposure from a vulnerability or possibility of access.
  • Who could access it? Identify whether the audience included unauthorized people, and whether access was actually confirmed or only possible.
  • How did exposure happen? It may involve a malicious outsider, insider activity, a misconfiguration, or accidental sharing. The FTC’s business guidance discusses hacker theft, insider theft, and inadvertent website exposure as examples.
  • What information and whose information? Identify the types and amount of data involved and the people affected.

These details are more informative than calling an event a “leak” or “breach” on its own. The FTC’s Data Breach Response: A Guide for Business offers examples of different causes and practical response guidance.

What to do if information may have been exposed

For an organization, response depends on the incident and the business. The FTC’s general U.S. guidance recommends moving promptly to secure operations, investigate and fix vulnerabilities, establish a response team, determine what information and which people were affected, and notify appropriate parties. Its recommendations are not a complete account of legal duties in every jurisdiction.

  1. Contain the exposure. Secure affected systems and limit further unauthorized access. Address the vulnerability or sharing path that enabled the incident.
  2. Bring in the right expertise. Assemble people suited to the incident. Depending on the circumstances, this can include internal security staff, legal counsel, and independent forensic investigators.
  3. Establish what happened. Determine what information was involved, who could access it, whether access is confirmed, and which individuals or organizations may be affected.
  4. Notify appropriate parties. The FTC guide discusses notifying law enforcement, affected businesses, and affected individuals as appropriate. Avoid misleading statements and avoid releasing details that could increase consumer risk.

Does the name determine legal notification duties?

No. Calling something a “leak” rather than a “breach” does not establish whether notice is legally required or when it must be sent. Requirements can depend on jurisdiction, industry, the type of information, and the incident’s facts. The sources cited here do not establish one deadline or legal definition that applies everywhere. Organizations should check current authoritative requirements for the jurisdictions and sectors involved and get qualified legal advice where needed.
