Before uploading a child’s photo to an AI app, find out whether it leaves the device, how long the service keeps it, whether it is reused or shared, and how you can delete it. If those answers are unclear, avoid uploading the image; choose a less identifying alternative or an app whose current privacy notice answers those questions plainly.
Why a child’s photo deserves careful handling
A child’s image can be personal information even when it is not labeled with the child’s name. In the United States, the Federal Trade Commission (FTC) says photos, videos, and audio containing a child’s image or voice fall within COPPA’s definition of personal information. That does not mean every family upload is automatically covered by COPPA: the law applies to child-directed online services collecting information from children under 13 and certain other services that have actual knowledge they are collecting it from children under 13. Its obligations depend on the service and circumstances. See the FTC’s COPPA FAQ and consumer guidance for parents.
Some apps may analyze a face or create other face-derived data. That is distinct from the photo itself, and you should not assume an app creates a biometric template—or does not—without checking its disclosures. UNICEF identifies particular privacy risks from biometrics for children, including the fact that many biometric technologies were designed around adults. Its Guidance on AI and children, version 3.0 (2025) also identifies protecting children’s data and privacy as a requirement for child-centered AI.
Check the app before choosing a photo
Read the app’s current privacy notice and product information before uploading. Look for clear answers to these questions; if a material answer is missing, treat that uncertainty as a reason to choose another workflow.

- Where does processing happen? Does the app say the image is processed on your device, or uploaded to the provider’s servers? Do not infer on-device processing simply because you select a photo from your phone.
- What is retained, and for how long? Check whether the service keeps the original image, face-derived data, or both, and whether it specifies a retention period.
- How may the image be reused? Look for use to improve products or AI models, human review, or other purposes beyond producing your requested result.
- Who else receives it? Check whether the service shares images or related data with service providers or other recipients, and what the notice says about that sharing.
- How do you control or delete it? Find the steps for requesting deletion and whether they cover stored images and derived data. Do not assume deleting an account removes every copy unless the policy says so.
- What happens to metadata? Ask whether the service receives or retains embedded information such as the location where a photo was taken.
These practices vary by app and can change as features or policies change. A general privacy principle or a platform’s permission prompt cannot establish how a particular provider handles uploaded images; rely on that provider’s current disclosures.
Limit what the app and photo reveal
- Use the least identifying input that works. Consider whether a text prompt, a non-identifying image, or another workflow can achieve the same result without a child’s face.
- Grant access narrowly. When your device offers the choice, select only the photo needed or use limited photo-library access instead of granting access to the full library. Deny location permission unless the feature genuinely requires it.
- Remove location metadata when feasible. Before sending or posting an image, use a method that removes embedded location information if your workflow allows it. Metadata removal does not make a visible child anonymous; the image itself can still identify them.
- Complete the task, then review deletion options. Follow the app’s stated deletion process if you no longer want the image retained, and keep a record of the request. Check whether the instructions address both images and derived data.
- Recheck when the app changes. Review the privacy notice again after meaningful changes to the app, its features, or its ownership.
The UK Information Commissioner’s Office recommends high privacy by default, data minimization, limits on sharing, and geolocation off by default in its Age Appropriate Design Code. These are useful principles for evaluating an app, but the code is UK guidance, not a universal legal rule.

What COPPA does—and does not—mean for parents
For covered services in the United States, COPPA generally requires notice to parents and parental approval before collecting, using, or disclosing a child’s personal information, and provides rights that include access and deletion. The FTC’s guidance also addresses retention, security, and photo metadata. COPPA is not a worldwide rule for every AI photo app or every image a parent uploads; its application depends on the operator, the service, the information collected, and the circumstances. Consult the FTC FAQ for its scope and requirements.

Upload only when the app’s current disclosures let you make an informed choice about processing, retention, reuse, sharing, and deletion—and the benefit is worth the information you are providing. If you cannot determine what happens to the photo or face-derived data, skip the upload or use a less identifying alternative.
