That prospect matters to companies building blockchain-based financial products, including tokenized securities. A framework written into law could provide a more durable basis for operating than interpretations that can change with administrations. It would not, by itself, settle every question about how particular products should be treated.
Why did the bill stall?
Coverage points to a mix of disputes over the bill’s substance and difficulty reaching agreement in an election year. The reporting does not establish one cause as the sole reason for the failed vote.
Ethics safeguards and Trump’s crypto interests
Democratic opposition focused in part on ethics safeguards and whether the bill adequately addressed President Donald Trump’s crypto-related business interests. Sen. Elizabeth Warren criticized the legislation on those grounds. The dispute was about the protections in the bill and the president’s interests—not simply about how to classify digital assets.

Stablecoin rewards and banks
Another point of contention was whether crypto platforms should be allowed to offer rewards on stablecoins. Banks warned that such rewards could compete with bank deposits. Earlier in the legislative process, Coinbase CEO Brian Armstrong opposed provisions affecting stablecoin rewards, slowing momentum for the bill.

Reuters also cited banking-lobby opposition and pressure from the election calendar as factors that made bipartisan agreement harder. Those pressures help explain the political environment around the bill, but the reporting does not show that any single lobby or lawmaker alone caused its failure.
Did crypto’s political spending move the vote?
Reuters reported that the crypto industry spent more than $300 million across the 2024 and 2026 elections. It described the Senate setback as a significant blow that demonstrated limits to the industry’s political influence. The procedural vote became a test of whether that influence could overcome disagreements about ethics and banking; the result shows that spending did not guarantee enough votes to advance the bill.

The reporting does not establish that campaign donations determined the 49–50 outcome. It is more accurate to distinguish the industry’s spending and election activity from proof of a causal effect on individual senators’ votes.
How did Fairshake respond?
After the Senate setback, Fairshake pledged nearly $30 million against Democratic Senate candidate Sherrod Brown, the Associated Press reported. The group also outlined support for a bipartisan slate of House candidates as the industry looked toward a later Congress to revive stalled legislation.

What does Mike Cagney’s view add?
Figure leader Mike Cagney discussed the CLARITY Act in an October 2025 interview about blockchain capital markets, months before the Senate vote. He described divergent interests among centralized exchanges, decentralized-finance participants, banks and established market-infrastructure firms, and argued for durable statutory rules in the context of tokenized securities and blockchain-based markets.
In that interview, Cagney put the problem this way: “The problem is it’s not codified in the law.” He was referring to regulatory interpretations that can shift between administrations, not commenting on the September 2026 vote. His remarks offer context for why a Figure leader concerned with tokenized securities might want legislation, but the available reporting does not establish that Cagney influenced the vote.

It also does not establish a unified venture-capital response to the CLARITY Act setback. A reported PAC donation pattern and a vote-specific reaction are different claims, and the coverage does not show that crypto VCs acted as a single political bloc.
What comes next for digital-asset regulation?
An October 2026 legal analysis said attention had shifted toward potential SEC and CFTC action after the Senate setback. It described passage in the current Congress as unlikely given the shortened calendar, while leaving the bill’s ultimate fate uncertain. The available reporting does not establish a specific date for a revival.
Agency rules or guidance could offer interim direction, but they are less durable than a statute. That distinction is central to the debate: regulators may provide guidance while Congress remains stalled, but that is not the same as enacting the market-structure framework the bill sought to create.
