The CFTC has opened a rulemaking process that could create an optional federal registration path for exchanges offering certain retail crypto transactions with margin, leverage, or financing. It has not finalized new trading rules, required exchanges to register, or shown that trading is returning to the United States.
What did the CFTC just propose for crypto trading?
On October 5, 2026, the Commodity Futures Trading Commission (CFTC) announced an advance notice of proposed rulemaking concerning certain retail commodity transactions involving crypto assets. The agency calls these transactions CTXs and is seeking public comment on how section 2(c)(2)(D) of the Commodity Exchange Act applies to them. The comments are intended to inform possible future agency action; this announcement is the start of a process, not a final rule. CFTC announcement
The CFTC is also asking about a purpose-built “crypto asset market” subcategory of designated contract market (DCM) registration. In a separate statement, Chairman Michael S. Selig described registration as a federal option for exchanges that want to offer retail trading involving margin, leverage, or financing. Selig’s statement
Can U.S. crypto exchanges offer leverage now?
The announcement does not itself authorize a new set of leveraged products or establish the requirements an exchange would have to meet. The CFTC has asked questions and invited comments; the final rules, if any, have not been set. The exact products that could be offered, applicable conditions, and effective date remain unresolved.

Selig says the contemplated federal route would be voluntary. He also says the CFTC cannot require every crypto exchange to register without congressional action: “Unlike the Clarity Act, these regulations wouldn’t require crypto assets to trade on CFTC-registered platforms. We don’t have the authority to impose such a requirement without congressional action.” Selig’s statement
Why might an exchange choose the federal path?
The potential bargain is access to a federal framework for certain retail margin, leverage, or financing products in exchange for operating under a dedicated registration and oversight structure. The CFTC says its goal is to incorporate crypto asset transactions into a uniform national market regulatory framework with consumer protections. Selig said the rules are designed “to prevent, rather than only prosecute after the fact, fraudulent schemes such as FTX.” CFTC announcement

Whether that framework is commercially worthwhile will depend on the eventual requirements and each exchange’s business model. CryptoSlate described possible intermediary involvement and compliance changes as potential burdens in the contemplated approach; those are reported trade-offs, not obligations adopted by the CFTC on October 5. Will this bring offshore crypto trading back to the U.S.?
That is an intended possibility, not an established result. The CFTC has not reported that exchanges have opted into the proposed path, that U.S. product availability has changed, or that trading volume has moved onshore. The outcome depends on later rulemaking and whether exchanges decide the federal framework’s benefits outweigh its costs.

The CFTC says comments are due within 60 days of publication in the Federal Register. Because the reviewed announcement does not establish that publication date, October 5 alone is not enough to calculate the exact deadline.
