On October 5, 2026, the U.S. Treasury’s Financial Crimes Enforcement Network (FinCEN) withdrew two proposed rules on digital-asset transactions: one involving “unhosted” wallets and another involving crypto mixing. The withdrawals end those specific rulemakings; they do not repeal final rules or erase other legal obligations that may apply to financial institutions or particular activity.

What happened to the unhosted-wallet and mixer proposals?

FinCEN announced that it would take no further action on its proposed unhosted-wallet rule. In a separate notice, it withdrew both its proposed finding that international convertible virtual currency (CVC) mixing is a class of transactions of primary money-laundering concern and the associated proposed special measure. These were proposed measures, not final rules, so “withdrawn proposals” is more accurate than “repealed rules.”

The withdrawal notices end those particular rulemakings. They do not establish that all crypto activity is exempt from Bank Secrecy Act, sanctions, or other requirements that may apply in specific circumstances. FinCEN says it will continue to monitor mixer activity and may take appropriate steps in the future. What the unhosted-wallet proposal would have required

The 2020 proposal was directed at banks and money services businesses (MSBs), not at every person using a self-custody wallet. It covered certain transactions involving convertible virtual currency or legal-tender digital assets and an unhosted wallet, or a covered wallet at a financial institution in a foreign jurisdiction identified by FinCEN. The withdrawal notice describes an unhosted wallet as one for which a financial institution is not required to conduct transactions.

  • Above $10,000: The proposal would have required reporting and customer identity verification for a covered transaction. Multiple transactions totaling more than $10,000 within 24 hours would also have crossed the proposed threshold.
  • Above $3,000: For covered transactions involving an unhosted or other specified wallet counterparty, the proposal would have required recordkeeping and identity verification.

These were proposed duties on covered financial institutions, not a general direct filing obligation for every self-custody wallet user. Treasury’s original announcement said the proposal was intended to increase transparency and assist law enforcement. Then-Treasury Secretary Steven T. What the crypto-mixing proposal would have covered

FinCEN’s October 2023 proposal would have required covered financial institutions to report and retain information about certain CVC transactions they knew, suspected, or had reason to suspect involved mixing within or involving a jurisdiction outside the United States. Its activity-based definition was broad: it covered methods that obscure a transaction’s source, destination, or amount, regardless of the protocol or service involved.

Examples in the proposal included pooling funds, algorithmically structuring transactions, splitting transfers into independent transactions, creating or using single-use wallets, exchanging between CVC or other digital assets, and delaying transactions at a user’s direction. The term “CVC Mixer” also extended to a person, group, service, code, tool, or function that facilitated mixing.

For covered transactions, proposed reports could have included the amount and asset type, mixer and wallet details, transaction hashes, dates, IP addresses, and a narrative. How the two withdrawn proposals differed

Why FinCEN withdrew the mixer proposal

FinCEN said commenters raised concerns that the proposal’s broad definition of mixing could discourage legitimate activity and impose a substantial reporting burden on financial institutions. At the same time, the agency said it continues to view illicit use of mixers and other obfuscation methods as a concern. Withdrawal therefore means the proposed measure will not proceed in that rulemaking; it is not a declaration that mixing presents no risks or that FinCEN will not act in the future. What Treasury’s risk assessment says about mixers

Treasury’s 2024 National Money Laundering Risk Assessment describes mixers as tools used by cybercriminals, ransomware actors, darknet-market participants, and others. It discusses cases involving ChipMixer and Tornado Cash. The assessment also notes that transfers between self-custodied wallets can happen without an intermediary financial institution subject to anti-money-laundering and countering-the-financing-of-terrorism duties, while public blockchains can still provide some transaction transparency.

Treasury’s account is a risk assessment and describes specific cases; it does not show that every mixer or self-custody transaction is illicit. The assessment says ChipMixer was responsible for laundering “more than $3 billion worth of virtual assets,” describing a Department of Justice action announced in March 2023. It also says the Tornado Cash indictment alleged the mixer facilitated “more than $1 billion in money laundering transactions,” referring to the August 2023 indictment. What this means for self-custody users

The withdrawal removes the proposed reporting and recordkeeping framework described above; it does not create a blanket guarantee about how any particular transaction will be treated under other applicable laws. The unhosted-wallet proposal would have placed its specified duties on covered financial institutions, rather than creating a general reporting form for individual wallet holders. The status of a particular transaction can depend on the facts and the legal requirements that apply to the people or institutions involved.

Does withdrawing the mixer proposal make crypto mixing legal?

The notices establish that FinCEN withdrew the proposed measure, not the legal status of every mixer, transaction, or service. Other laws or obligations may apply depending on the conduct and parties involved. FinCEN also says it will continue monitoring mixer activity, so the withdrawal should not be read as approval of mixing or as a promise that no further action will follow.
