The SEC, meanwhile, has proposed exemptions for certain investment-contract offerings involving crypto assets. Those are separate actions, and neither resolves whether the CFTC can require ordinary spot-crypto venues to register: Chairman Michael S. Selig says Congress would need to grant that authority.
What did the CFTC propose for crypto?
On October 5, 2026, the CFTC issued an advanced notice of proposed rulemaking (ANPRM) seeking public comment on a possible framework for retail commodity transactions involving crypto assets under section 2(c)(2)(D) of the Commodity Exchange Act. An ANPRM is a request for input on potential future rulemaking, not an adopted regulation. The agency says comments may inform later action.
The notice asks about how rules could address abusive practices and account for crypto-specific compliance issues. It also seeks input on potentially creating a purpose-built subcategory of designated contract market (DCM) registration called a “crypto asset market.” A DCM is a CFTC-registered market venue; the proposed category is a possibility under consideration, not a registration regime already in effect.
The CFTC announcement sets the comment period at 60 days following publication in the Federal Register. It does not itself state the publication date, so the calendar deadline cannot be determined from the announcement alone.

How is the SEC proposal different?
The SEC’s proposed Regulation Crypto Assets addresses capital raising through certain investment contracts involving crypto assets. It is not the CFTC venue-registration initiative. Issued August 18 and published in the Federal Register August 21, 2026, the SEC proposal remains pending; the SEC lists October 20, 2026, as the deadline for comments.

What the SEC’s proposed exemptions would do
The SEC proposal includes two possible exemptions for qualifying investment contracts involving crypto assets: one with a limit of up to $5 million across a four-year period, and another with a limit of up to $75 million in each 12-month period. The proposals include disclosure obligations and a conditional safe harbor. These are proposed terms, not currently available exemptions; eligibility and the conditions would depend on the final outcome of the SEC’s rulemaking.

Can the CFTC make spot crypto exchanges register?
Not under the authority described by CFTC Chairman Michael S. Selig. On October 5, he said, “We don’t have the authority to impose such a requirement without congressional action.” He distinguished the contemplated CFTC rules from a requirement that ordinary spot-crypto trading take place on CFTC-registered venues. That is the chairman’s account of the agency’s statutory authority, not a judicial ruling.
So the possible crypto asset market category in the ANPRM should not be read as a mandate for all spot platforms to register or move trading onto a CFTC-regulated venue. The CFTC has started asking what rules might be appropriate within its authority; the broader spot-market requirement Selig described would require Congress to act.

What crypto rules are already in effect?
A separate joint SEC–CFTC interpretation took effect March 23, 2026. It explains how federal securities laws apply to certain types of crypto assets and transactions, with related CFTC guidance under the Commodity Exchange Act. Its topics include token categories, airdrops, mining, staking, and wrapping. This effective interpretation is distinct from both the SEC’s later proposed offering exemptions and the CFTC’s October ANPRM.
In June 2026, the agencies also jointly requested comment on clarifying jurisdictional lines for innovative products that may implicate both agencies and on possible alternative compliance arrangements. The comment period closed August 24, 2026. That request was not a resolution of the spot-market authority question.

What to watch next
- CFTC: Federal Register publication of the ANPRM establishes the start point for its 60-day comment window. The notice’s questions and public comments may shape any later proposed or final action.
- SEC: Comments on proposed Regulation Crypto Assets are due October 20, 2026. Until the SEC completes the rulemaking, its dollar limits and conditions remain proposals.
- Congress: Under Selig’s stated view, legislation would be needed to let the CFTC require ordinary spot-crypto venues to use CFTC-registered platforms.
