Check factual claims, make fabricated scenes unmistakably satirical, avoid cues of real endorsement or affiliation, and disclose realistic synthetic or meaningfully altered content when YouTube requires it. None of those steps guarantees legal protection: the rules depend on the claim, context, platform, and jurisdiction.
What the law does—and does not—protect
In Hustler Magazine, Inc. v. Falwell, 485 U.S. 46 (1988), the U.S. Supreme Court ruled on an intentional-infliction-of-emotional-distress claim brought by a public figure over an offensive parody. For that claim and fact pattern, the First and Fourteenth Amendments barred recovery without proof that the publication contained a false statement of fact made with actual malice. The Court also reasoned that the parody could not reasonably be understood as describing actual facts about Falwell or actual events in which he participated.
That is a significant protection for harsh public-figure caricature, not a blanket license to invent factual allegations, imitate a person deceptively, or use a likeness in every commercial setting. The decision addresses a particular claim; other causes of action and different facts may lead to different outcomes. The Supreme Court’s official opinion is the primary source for the holding.
What to avoid drawing or presenting
Fabricated evidence of real conduct
A staged scene can become misleading when it looks like documentary footage of a real event. Be especially careful with fabricated admissions, criminal conduct, arrests, endorsements, or statements about supporting a political candidate. Do not present invented dialogue as a verified quote or use a fake news lower-third, clipped context, or realistic interface element in a way that makes the invention look like an authentic record.

Satirical style can help signal invention, but no single graphic treatment guarantees that viewers will understand it. Make the satirical frame apparent in the video itself and, where useful, in its accompanying description. Keep verified events and quotations distinct from invented scenes and dialogue.
False endorsement or affiliation
Review the channel and video as a whole for cues that could suggest the executive, their company, or a government body made or authorized the content. Check account and channel names, logos, metadata, the use of a voice or likeness, and calls to action. The FTC’s final Impersonation of Government and Businesses Rule, 16 CFR Part 461, concerns government- and business-impersonation fraud; it does not establish that every parody that refers to a business is prohibited.

Serious factual allegations framed as a joke
Do not assume that labeling a video “satire” resolves the risk of a claim that viewers could take literally. The Falwell ruling concerned a public figure, an offensive parody, and a specific emotional-distress claim. It does not decide every defamation, privacy, publicity, election, trademark, copyright, or commercial-use question.
How to check the video before release
- List the factual claims. Identify each real-world assertion about the executive, their role, an event, date, location, or quotation. Keep a source note for each claim and verify quotations against their original context.
- Separate fact from invention. Mark which dialogue, actions, and scenes are fictional. Review whether a reasonable viewer could mistake any invented material for an authentic recording or report. Framing, style, and description can clarify the joke, but they do not replace checking the underlying claims.
- Check the likeness and affiliation cues. Look at the video, channel identity, logo use, metadata, voice, and calls to action together. Remove or clarify elements that could imply the executive or organization owns, sponsors, or endorses the work.
- Check platform disclosure rules. If publishing on YouTube, determine whether realistic AI-generated or meaningfully altered material makes a real person appear to say or do something they did not. If it does, use YouTube’s disclosure setting for altered or synthetic content. Also consider whether the video creates a realistic invented scene or alters footage of an actual event or place.
- Check the publication context and jurisdiction. Consider where the creator, subject, and audience are located, and whether the video is tied to an election, commercial promotion, or another regulated context. Seek jurisdiction-specific legal advice for serious allegations, realistic synthetic impersonation, election messaging, sensitive private acts, or commercial endorsement.
- Recheck current rules and policies. Platform guidance and law can change. Confirm the applicable pages and rule status immediately before release rather than relying on an older summary.
When YouTube’s AI disclosure and impersonation guidance applies
YouTube’s creator guidance calls for disclosure when AI-generated or meaningfully altered content appears realistic, including content that makes a real person seem to say or do something they did not. Its examples include fabricated conduct by public figures and realistic invented scenes. Follow the disclosure guidance when the video meets those conditions; do not treat a disclosure as permission to impersonate someone.

YouTube’s privacy review guidance considers factors including whether a depiction is realistic, whether it is disclosed, whether it uniquely identifies the person, whether it has parody, satire, or other public-interest value, and whether it shows a public figure in sensitive behavior. YouTube identifies criminal activity and endorsement of a product or political candidate as examples of sensitive behavior. These are platform review factors, not a universal legal safe harbor or a guarantee that a video will remain available.
How to describe the FTC rule accurately
The FTC’s rule page identifies a final rule, 16 CFR Part 461, on impersonation of government entities and businesses. A separate FTC announcement from February 2024 described a proposed expansion addressing impersonation of individuals, including AI-enabled impersonation. Because the announcement described a proposal rather than a final rule, do not state that the individual-impersonation expansion is law on that basis alone. Check the FTC’s current rulemaking information before publication for any later action.

What the Canadian election-law example covers
Canada’s Elections Act, on the current Justice Laws page, includes a parody-or-satire exception in specified election-related impersonation and misleading-publication provisions. The exception is limited to those offences. It does not establish that every video about an executive is exempt from other Canadian laws, and it should not be applied to U.S. law or other jurisdictions.
Two ways to stage the same joke

This is an editorial comparison, not a legal test: context and the finished presentation matter, and a satirical label alone does not settle how an audience or platform will interpret the work.
