Xaivian Lee is playing for Gonzaga under a temporary restraining order, but his final eligibility determination is still pending. A RotoWire update published Oct. 2, citing The Spokesman-Review, reported that a decision is expected Oct. 20, 2026. That date is in the future as of Oct. 3, and no outcome has been established.
What is Xaivian Lee’s eligibility status?
According to RotoWire’s Oct. 2 update, Lee is currently eligible to play under a temporary restraining order while awaiting a court decision. The report attributes the update to Theo Lawson of The Spokesman-Review and says a favorable decision from the Superior Court of Santa Clara County is needed for full eligibility.
This is a reported case update, not confirmation from Gonzaga, the NCAA or a court order. The available reporting does not establish the precise legal relief at issue or what the court will decide.

The report says Lee will hear about a decision on Oct. 20, 2026. That is a reported date, not an independently confirmed court schedule. As of Oct. 3, the outcome remains unresolved.

Why are a temporary order and final eligibility different?
A temporary restraining order can allow Lee to play while the case is pending; it should not be treated as a final ruling on his eligibility. A court decision and an institution’s formal NCAA eligibility certification are also distinct matters.
NCAA Division I Proposal 2026-44 says the institution is responsible for certifying eligibility in specified circumstances and requires final certification before an athlete practices or competes. It provides for temporary certification for up to 45 days in a defined situation while certification is pending. The rule does not establish that this NCAA certification provision is the same as the court order described in Lee’s case.

How do the NCAA’s new eligibility rules fit in?
On June 23, 2026, the NCAA announced a Division I age-based eligibility model. The new model is the sole rule for prospects first enrolling in fall 2027 or later. For current athletes with eligibility remaining after 2025–26, and first-time enrollees during 2026–27, the transition allows whichever is more favorable to the individual: the prior rules, which generally allow four seasons of competition in five years, or the age-based model. The NCAA’s transition rules provide context; they do not determine Lee’s individual court case or confirm his certification.

Does transfer portal status decide eligibility?
No. The NCAA describes the Transfer Portal as a centralized database: an athlete tells the current school of an intent to transfer, the school enters the athlete, and portal status indicates availability for coach contact. That process does not establish eligibility or resolve a court dispute.
