Elon Musk threatened legal action against Apple on August 11, 2025, after alleging that Apple favored OpenAI in App Store visibility and asking why X and Grok were missing from the store’s “Must-Have” section. X Corp. and xAI followed with a lawsuit against Apple and OpenAI on August 25, 2025. The lawsuit’s claims are allegations, not findings by a court.
What prompted Musk’s threat?
In an August 11, 2025 post on X, Musk asked why Apple had not placed either X or Grok in its “Must-Have” section. He cited X’s position in News and Grok’s overall ranking, then accused Apple of making it impossible for an AI company other than OpenAI to reach number one in the App Store. He said xAI would take “immediate legal action.” The Associated Press reported the threat the next day and noted that Musk had not yet explained what action he intended to take. Are App Store rankings and “Must-Have” featuring the same thing?
No. Category charts, such as Top Free apps in News or Productivity, are distinct from the “Must-Have” section, which is an editorially curated feature. An app can rank highly in its category without appearing in that featured section. The distinction matters because Musk’s complaint was about both forms of visibility, not simply a claim that Grok had a low chart position.
In their August 25 complaint, X Corp. and xAI said that on August 24, X ranked first among free News apps and Grok ranked second among free Productivity apps, while neither appeared in Must-Have Apps. Those are the plaintiffs’ figures for a single day, as presented in their court filing—not an independent ranking audit, evidence of a continuing pattern, or proof that Apple manipulated rankings. Did xAI actually sue Apple?
Yes. X Corp. and xAI filed a 61-page complaint against Apple and OpenAI in the U.S. District Court for the Northern District of Texas on August 25, 2025. The Associated Press reported that the plaintiffs sought monetary damages and an order barring the conduct they challenged. The filing broadened Musk’s public complaint into allegations involving Apple’s ChatGPT integration, App Store visibility, and competition in smartphone and generative-AI chatbot markets. The complaint presents the plaintiffs’ theory of the case. It does not establish that Apple violated antitrust law or that its App Store decisions caused the rankings Musk objected to.

What did Apple say in response?
In a statement to the Associated Press on August 12, Apple said, “The App Store is designed to be fair and free of bias.” It described its discovery features as charts, algorithmic recommendations, and curated lists selected by experts using objective criteria. That statement explains Apple’s position; it is not a court’s assessment of how the system operated in this dispute. Associated Press, August 12, 2025.
What arguments did Apple make in court?
In a September 30, 2025 brief supporting its motion to dismiss, Apple said employees had explained why Grok was not included in certain lists and identified improvements that could help the plaintiffs qualify for curated features. Apple also argued that other generative-AI chatbots—including Gemini, DeepSeek, and Perplexity—had reached top App Store rankings after Apple integrated ChatGPT. What is the latest verified court development?
A court order dated August 26, 2026, denied the Washington Free Beacon’s motion to intervene in order to challenge the sealing of limited records. That was a procedural decision about access to records; it did not decide whether Apple or OpenAI violated antitrust law. The court materials available for this account do not establish later developments through October 4, 2026, so they do not support describing the case as currently pending, dismissed, settled, or resolved.
