Double Fine’s union petition was withdrawn on May 20, 2026, less than two weeks after it was filed. Kotaku’s October investigation describes confusion over who belonged in the proposed bargaining unit, workplace tensions and personal conflict as contributing factors. Those explanations come from interviews and reviewed messages—not from the National Labor Relations Board (NLRB), whose docket records the withdrawal but does not state why it happened.
What happened to the Double Fine union petition?
The NLRB docket records an RC petition for Double Fine Productions Inc. filed in San Francisco on May 7, 2026. It lists 42 employees in the case and describes a proposed unit of regular part-time and full-time employees, excluding supervisors, guards, office clericals and other employees as defined in the Act. The listed headcount is not a finding that all 42 were eligible for the proposed unit. The NLRB case docket records a withdrawal request and an agency letter approving the withdrawal on May 20; the case is closed.
What did reporting say contributed to the withdrawal?
Kotaku’s October 9 investigation, based on interviews with 15 current and former employees, Slack messages and an interview with CEO Tim Schafer, portrays several overlapping tensions rather than a single agreed-upon cause. Employees’ accounts to Kotaku are explanations of the campaign’s breakdown, not official findings about the company or the petition.

Disagreement and confusion over eligibility
Some interviewees described uncertainty about which jobs belonged in the proposed unit. Kotaku reported that this was difficult to resolve in a workplace where roles and managerial responsibilities could overlap. Some employees outside the proposed unit reportedly felt excluded from a process affecting their workplace, while some interviewees said organizers struggled to answer direct questions about who would be included. The NLRB docket gives the proposed unit’s categories and exclusions, but does not adjudicate the workplace disagreements Kotaku described.

Strained conversations and workplace conflict
Kotaku’s sources also described anti-union messaging, difficult conversations and personal conflict. Together with uncertainty over unit eligibility, those accounts suggest why support and communication may have faltered; they do not establish that any one factor caused the withdrawal or that the NLRB found misconduct.
An earlier organizing effort
Kotaku also reported an organizing effort in 2019, including a meeting that became heated; subsequent conversations were curtailed during the pandemic. Game Developer’s summary likewise describes the earlier effort and the pandemic’s role. That history is distinct from the 2026 petition and should not be treated as the same campaign.

What did Tim Schafer say?
In his interview with Kotaku, Schafer said he generally supported unions and saw why workers in the games industry might want protection. He also said he did not want to intervene in employee organizing conversations because he was the CEO. Those statements describe his stated views; they do not resolve employees’ differing accounts of the campaign.
Were the organizers laid off?
Kotaku reported that Double Fine laid off 23 employees on July 28, 2026, after the studio’s departure from Xbox, and that all eight organizing committee members who signed the withdrawal letter were among those laid off. That overlap is reported; the available sources do not establish that union activity caused the layoffs. Schafer denied that organizers were targeted. Game Developer quoted him saying, “That’s definitely not the reason. We didn’t target people for layoffs.” His denial is his account, not an NLRB finding.
