Congress writes and enacts federal immigration statutes. The President does not make those statutes, but the Executive Branch administers and enforces them under constitutional and statutory authority. Courts interpret the law and decide disputes, including questions about constitutional limits. The title’s claim that “the left” forgets this is political rhetoric; the legal sources explain government roles, not what any political group remembers or believes.
Who has which role in immigration law?
| Branch | Role | What that means |
|---|---|---|
| Congress | Enacts federal statutes | It establishes statutory rules through the constitutional legislative process. |
| Executive Branch | Administers and enforces statutes | The President and executive agencies carry out the law and make implementation decisions within their legal authority. |
| Federal courts | Interpret law and adjudicate disputes | Courts resolve cases involving statutory meaning and constitutional constraints. |
These are different jobs. An executive decision can substantially affect how immigration law works in practice without changing the text of a statute enacted by Congress.
How does Congress get authority over immigration?
The Constitution does not expressly set out a general immigration power in one clause. The Supreme Court has nevertheless long recognized broad congressional authority over immigration. Congress.gov’s Constitution Annotated describes the doctrine as “plenary” power: broad authority to decide whether foreign nationals may enter or remain in the United States. That term does not mean unlimited power; the constitutional foundations are more complex and involve multiple sources of federal authority. Congress.gov’s overview of Congress’s immigration powers discusses the doctrine and its foundations.

Its enumerated powers include establishing a uniform rule of naturalization, and it may use its Necessary and Proper authority to carry out powers vested in the federal government. Legislation must follow the Constitution’s lawmaking process. The Constitution Annotated overview of Article I explains Congress’s place in that structure.

Does the President make immigration law?
Not in the sense of enacting federal statutes. The President’s constitutional responsibility includes taking care that the laws are faithfully executed. Executive departments and agencies administer immigration statutes, and Congress can delegate authority to officials to carry out particular responsibilities. Congress.gov’s overview of Article II describes the executive power and the Take Care Clause.
Administration is consequential: agencies make operational choices under the authority the law gives them, and enforcement involves discretion. But implementation or enforcement is not the same as Congress enacting a new statute. Whether a particular executive action stays within legal authority is a legal question, not something settled merely by calling it “lawmaking” or “enforcement.”

What do courts do?
Courts decide cases by interpreting the statutes and other legal rules that apply. They can also consider whether a law or government action complies with the Constitution. Immigration law is not outside constitutional review. The Constitution Annotated explains that due-process safeguards apply to aliens within the United States, while the scope and context of protections vary. Its overview of aliens in the United States addresses those protections.

When a policy changes, ask which kind of action changed:
Rank #3
- Statutory change: Congress enacted or amended a law through the legislative process.
- Implementation or enforcement change: the Executive Branch acted within authority granted by the Constitution or statutes.
- Judicial ruling: a court interpreted a rule or resolved a dispute about its application or constitutionality.
The official sources establish this division of institutional responsibility. They do not establish that a particular political group has forgotten it. For the primary text, the Constitution Annotated’s U.S. Constitution page provides the Constitution online.
