Customers with requests an automated system cannot handle are often the first to feel that a company’s promise has changed. Employees and complaint teams may notice next, as they take over unresolved cases; privacy and product teams can see whether the system’s claims and data practices still match what customers were told. That is a reasoned map of who may notice—not a measured ranking.
Who is most likely to notice first?
Customers whose problem does not fit the system
A customer can experience the gap immediately when an automated assistant misunderstands a request, repeats unhelpful answers, or offers no clear route to a person. The Consumer Financial Protection Bureau’s 2022 report describes these risks in consumer finance, including chatbot loops without a human off-ramp. It says chatbots are not suitable as the primary customer-service vehicle when AI fails to understand a person’s request or the message conflicts with the system’s programming. Employees who inherit unresolved cases
When a customer cannot get a useful answer from automation, the next people exposed to the mismatch are often the staff or complaint teams who receive the escalated case. They may have to resolve the original issue as well as repair confusion created by the automated interaction. This is an inference from the service problems the CFPB describes, not a measured finding about which job roles notice most often.
Teams accountable for claims and data practices
Product, customer-experience, privacy, and compliance teams can detect a different kind of gap: what the company says the AI can do, what it actually does, and how it handles customer information. The Federal Trade Commission (FTC) has addressed both capability claims and privacy commitments in its guidance and enforcement announcements.

What does it mean for AI to change the customer promise?
The promise is more than a slogan. It includes what customers can reasonably expect from a service, what a company says its AI can accomplish, whether customers can get help when automation fails, and what the company says about their data. A change in any of these can matter even if a customer-facing interface or marketing page has not visibly changed.
The FTC’s January 2024 guidance says companies should honor privacy and confidentiality commitments about customer data, including commitments concerning model training. It also says material omissions about data collection or use can matter alongside express promises. The FTC staff post warns against quietly changing practices or burying disclosures; it frames the issue as agency guidance, not a complete account of laws in every jurisdiction. In a February 2024 staff post, the FTC said a company cannot unilaterally renege on the privacy commitments under which it collected user data. The post also notes that customers may have limited recourse when switching costs make it difficult to leave a service they relied on. This is the FTC’s enforcement perspective, not a universal statement of every jurisdiction’s law. Read the FTC staff post on changing terms.

How can a customer or company spot the gap?
Compare what the service promises with what happens on the same tasks, using these questions. This framework draws on the CFPB’s service findings and FTC guidance; it is an editorial aid, not a regulator-issued checklist.
- Resolution: Does the system complete the task, or mainly redirect the customer to policies and FAQs?
- Recovery: If the system misunderstands or cannot handle the request, can the customer reach a person?
- Capability: Do public claims about what the AI can do match tested performance for the specific task and intended audience?
- Disclosure: Are limitations, intended audience, and material data practices explained clearly and where customers can find them?
- Commitment continuity: Do current data practices still match the commitments in place when the information was collected?
These checks help distinguish a merely disappointing interaction from a broader mismatch between advertised capability, actual service, and data use. For legal questions, the applicable rules depend on jurisdiction and circumstances; the FTC materials cited here concern U.S. agency guidance and activity.

Claims that an AI system can replace a trained professional are especially consequential because customers may rely on them when making important decisions. In September 2024, the FTC announced a complaint alleging that DoNotPay claimed its AI service could substitute for human-lawyer expertise without testing its output against lawyer performance. The same announcement described the agency’s Operation AI Comply enforcement sweep. FTC Chair Lina M. Khan said, “Using AI tools to trick, mislead, or defraud people is illegal.” The statement appeared in that enforcement context; it does not establish that every inaccurate AI output is unlawful.
What recent FTC activity signals—and what it does not
In September 2025, the FTC announced a 6(b) inquiry into seven consumer-facing AI chatbot companies. It sought information about testing and monitoring, disclosures about features and capabilities, intended audiences, potential negative impacts, and data handling, with particular attention to children and teens. An inquiry is an information request, not a finding that the companies named by the agency violated the law. Read the FTC inquiry announcement.
The FTC also published a proposed AI accuracy policy statement on July 1, 2026, with comments accepted through July 31, 2026. The official materials identify it as a proposal, not a final policy statement. Its discussion of reasonable expectations and Section 5 is the agency’s proposed position.
