TikTok’s U.S. business is now operated by a U.S.-based joint venture controlled by U.S. persons, while ByteDance and its affiliates retain a reported 19.9% stake. The transaction closed in January 2026. President Donald Trump’s September 25, 2025 executive order created the enforcement framework for that deal; it did not itself transfer ownership. ByteDance also still owns the underlying intellectual property for TikTok’s recommendation algorithm, which the U.S. operation licenses and runs under the new arrangement.
How the TikTok ownership change unfolded
The 2024 law set the deadline
Congress enacted the Protecting Americans from Foreign Adversary Controlled Applications Act as part of Public Law 118-50 in 2024. The law required ByteDance to sell TikTok to an owner that is not controlled by the People’s Republic of China by January 19, 2025. Without a qualifying divestiture, app stores and hosting providers could be prohibited from supporting the service. The Congressional Research Service (CRS) reports that the Supreme Court upheld the law in 2025.
Trump’s September 2025 order supplied a legal pathway
Executive Order 14352, “Saving TikTok While Protecting National Security,” was signed on September 25, 2025. It determined that the proposed U.S.-based joint venture would meet the statute’s definition of a “qualified divestiture” if ByteDance and its affiliates held less than 20%. The order directed the attorney general not to enforce the Act for 120 days so the contemplated transaction could be completed.
That was a presidential determination and an enforcement direction—not the closing of a sale. Earlier enforcement delays had already occurred, and the order described the proposed structure rather than announcing that the transaction was complete.

The transaction closed in January 2026
The Associated Press reported that the deal ultimately closed in January 2026. A Congressional Research Service account published August 26, 2026, describes the resulting ownership and governance structure. The cited sources do not establish whether a later legal or implementation event materially changed it.
Who owns and controls TikTok’s U.S. operation now?
The U.S. service is run through a U.S.-based joint venture that is majority-owned and controlled by U.S. persons. CRS reports that ByteDance and its affiliates hold 19.9%. The Associated Press identified Oracle, Silver Lake and Abu Dhabi-based MGX among the major investors.

This means “TikTok was sold” is shorthand for a change in control of the U.S. operation, not proof that ByteDance disappeared from every part of the business. Its minority equity interest, board role and continuing algorithm license are separate questions from who controls the U.S. venture.

Does ByteDance still own TikTok’s algorithm?
Yes—its underlying intellectual property remains with ByteDance. The U.S. venture licenses a copy rather than receiving an outright sale of the algorithm. At the same time, the arrangement places operation of the algorithms and code, and content-moderation decisions, under the joint venture’s control.

AP reporting says the U.S. backend algorithm is being retrained on U.S. user data. That describes how the licensed system is operated in the United States; it does not change who owns the underlying IP. The distinction matters because “U.S.-controlled algorithm” can accurately describe operational control without meaning that ByteDance has no technical or contractual connection.

These are safeguards claimed by the White House and described in the executive-order framework. The cited CRS, White House and AP materials do not independently establish that they eliminate every national-security, data-access or influence risk.
What remains legally and practically unsettled?
Whether the algorithm license fits the statute
Some members of Congress have questioned whether ByteDance’s continuing role in licensing the recommendation algorithm is consistent with the Act’s restrictions. The arrangement was accepted by the administration as a qualified divestiture, but that political and legal debate has not been resolved simply by the order or the closing.

How much influence a minority owner can retain
A 19.9% stake and one board appointment are limited compared with majority control, yet they are not the same as no continuing relationship. The available reporting raises questions about influence and technical ties; it does not prove that ByteDance manipulates U.S. recommendations.
Whether users will notice feed or interoperability changes
AP reported uncertainty about how the new U.S. backend and licensing arrangement could affect recommendations, feeds and interoperability with TikTok’s service in other countries. The cited material does not provide a settled outcome for the everyday user experience.
How to interpret the headline figures
- 170 million Americans: the user count stated by the White House in the 2025 executive order and fact sheet. It is the administration’s figure, not a fresh independent estimate.
- $178 billion over four years: the White House’s projection of U.S. economic activity associated with the arrangement. It is a forecast, not measured activity or an independently verified result.
Trump summarized the administration’s economic rationale in the September 25, 2025 White House fact sheet: “And if we can save it, I think that would be a very good thing. And I think it would be economically good for America.”
