In the United States, a person may own copyright in the parts of a children’s book they actually authored—such as original story text, sufficiently creative edits, or the book’s creative selection and arrangement. Merely prompting an AI tool does not make the user the copyright author of generated text or pictures. A book can therefore contain protected human contributions alongside AI-generated material that is not protected by copyright. Who owns any protected rights after creation also depends on contracts and work-made-for-hire rules.
What copyright can cover in a mixed human-and-AI book
U.S. copyright generally protects original expression authored by a human. A book is not necessarily all protected or all unprotected: its text, images, edits, and arrangement can be assessed as distinct contributions. The U.S. Copyright Office says AI assistance or inclusion of AI-generated material in a larger human-created work does not by itself bar copyrightability. The Office’s Part 2 report explains that whether human contributions are sufficient must be evaluated case by case.
Story text
A person’s original wording may qualify for copyright even if an AI tool helped with brainstorming or drafting. The relevant issue is what expressive wording the person determined and contributed. Passages generated by a system and accepted unchanged should not be described as human-authored simply because the person wrote a prompt or clicked a button. Where a writer rewrites or substantially revises generated passages, the writer’s own expression may be protected; the boundary depends on the facts.
Illustrations
Paying for an AI service, owning the account, or entering a detailed prompt does not automatically give the user copyright in the resulting image. In a registration example involving a graphic novel with human-written text and Midjourney images, the Copyright Office allowed claims in the text and human selection and arrangement, but excluded the generated images. That example is a close analogy for a picture book, not a blanket ruling on every image or editing workflow. The Office’s registration guidance explains disclosure and claims involving AI-generated content.

Creative human modifications to an image may be protectable as those modifications, without making the underlying generated image human-authored. Distinguish any original additions from the AI-generated image itself when describing or claiming rights.
Page sequence and overall arrangement
A person’s original selection, coordination, or arrangement of book material may be copyrightable even if some included material is not. The Copyright Office describes collective-work registration as covering copyrightable authorship in selection, coordination, or arrangement, and gives a children’s book made by a writer and illustrator as an example. Its collective-work guidance does not convert generated pictures into human-authored art.

Prompts, editing, and creative control
Under the Copyright Office’s account of currently generally available AI technology, prompts alone do not give a user sufficient control over the expressive elements of generated output to make the user its author. The Office’s Part 2 report treats the sufficiency of human contributions as fact-specific; it sets no universal percentage of human work, word-count threshold, or prompt-length test.

Authorship is different from who owns the rights now
Copyright authorship asks who created the copyrightable expression. Ownership can later change through a transfer, and employment or qualifying work-made-for-hire arrangements can affect initial ownership. For specially commissioned work to qualify as work made for hire, the Copyright Office says there must be an express written agreement signed by both parties and the work must fall within a statutory category. Review the actual employment, publishing, illustration, and service agreements rather than assuming that the publisher, illustrator, parent, employer, AI vendor, or person who paid owns everything. The Copyright Office’s work-made-for-hire circular describes the rules.
Owning a printed copy is not the same as owning copyright in the book’s contents. The Copyright Office also says minors may claim copyright, although state law may regulate business dealings involving copyrights owned by minors. Its copyright FAQ explains these distinctions.

How to approach U.S. copyright registration
If registering a mixed human-and-AI book, describe the workflow accurately. Identify the human-authored material being claimed and disclose AI-generated material as the current application instructions require. The Copyright Office’s graphic-novel example shows that a claimant may identify human-written text and arrangement while excluding generated images from the claim. Do not claim generated passages or pictures as human-created.
- Separate the book’s content into human-written text, generated text, human-created or modified art, generated images, and human-authored arrangement.
- Identify the human expression for which you are claiming copyright, rather than treating the book as one indivisible work.
- Follow the current U.S. Copyright Office application instructions to disclose AI-generated content and limit the claim appropriately.
- Keep drafts and workflow records that help show which material came from a person and which came from a system.

A practical checklist before publishing
- Record who supplied the expressive wording, drawings, revisions, and page arrangement.
- Separate AI-generated material from human contributions in your working files and descriptions.
- Check employment, publisher, illustrator, and commissioned-work agreements for transfers and work-made-for-hire terms.
- If registering in the United States, disclose generated material and claim only qualifying human authorship.
- If the book will be sold or registered outside the United States, check that country’s law separately; the U.S. analysis does not resolve international copyrightability or ownership.
For a dispute, a high-value publication, or uncertainty about contract terms, consult a copyright lawyer in the relevant jurisdiction.
