No one has been shown to own “brain rot” as a whole. The reported dispute is narrower: it concerns Tung Tung Tung Sahur, a character used in the Roblox game Steal a Brainrot, and competing claims about who can control particular uses of it. The case raises separate questions about AI-assisted authorship, trademark claims, platform takedowns and the many creators who helped make the character a meme.
What is the dispute actually about?
“Brain rot” is a broad meme genre, not the object of a single reported ownership case. The legal dispute described by The Guardian on October 6, 2026, centers on one character: Tung Tung Tung Sahur, also called Triple T, and its use in Steal a Brainrot, a Roblox game.
The Guardian reports that an Indonesian teenager who uses the name Noxa created the character in 2025 with OpenAI’s image-generation tool. It depicts an anthropomorphic kentongan, a drum associated with waking Muslims for the pre-dawn Ramadan meal. The report says Triple T spread through social videos, fan art, cosplay and merchandise as part of the “Italian brain rot” meme genre. Those are reported descriptions of its circulation, not independently verified audience figures.
The distinction matters: a claim over this character or its commercial use is not a claim to own every “brain rot” character, the genre itself, or the audience’s remixes.

How did the Roblox dispute develop?
According to the Guardian’s account, Do Big Studios released Steal a Brainrot in May 2025 with recognizable meme characters. In September 2025, Spyder Games LLC and Speedy Simulator Gaming LLC, described in the report as Do Big’s owners, received a cease-and-desist letter from Mementum, which represents Noxa. The character was initially removed while the parties tried to negotiate. The game owners then sued Mementum in the Northern District of California.
The same report says Mementum sought removal of Triple T from the game through an EU Digital Services Act takedown request, which succeeded, and brought a US trademark-related counterclaim. It also says Mementum did not yet hold a US trademark for Triple T, while noting that some US trademark-infringement arguments can be made without registration. These are the newspaper’s descriptions of legal and platform steps; the underlying complaint, counterclaim, docket, trademark records and notice are not available here to confirm their precise terms or current status.
A platform takedown is not a court ruling that the claimant owns a character. It is a separate process concerning content on a service. Likewise, the reported trademark claim is distinct from the dispute over who authored copyrightable expression.

Can an AI-generated character be copyrighted?
The US Copyright Office’s Part 2 report, published January 29, 2025, says copyright may protect original expression made by a human even when a work also contains AI-generated material. It says purely AI-generated material, or material for which human control over expressive elements is insufficient, is not protected on that basis. Whether a person’s contributions are enough is assessed case by case; in the Office’s view, prompts alone, using generally available technology, do not provide sufficient control.
That is not the same as saying that every image made with AI is unprotectable. Human-authored parts, creative modifications, and the arrangement or selection of material may matter. Nor does the Office’s general analysis decide who owns Triple T: it is not a ruling on this character, a trademark decision, or a substitute for a court’s assessment of evidence about how the work was made.
The Guardian reports that documents in a separate French trademark-related dispute describe a creation process of about 15 minutes and seven prompts, including an instruction to draw a “pentungan sahur with a face and legs.” Do Big’s lawyer, Aaron Moss, argues that sparse prompts and choosing a preferred output do not amount to human authorship. That is the lawyer’s position as reported by the newspaper, not a court finding about the process or its legal effect.

Copyright and trademark answer different questions

For either route, the important questions are specific: what expression or mark is claimed, what use is challenged, what commercial context is involved, and what evidence supports the claim. A legal right to particular protected material would not automatically mean exclusive control over every idea, archetype, joke or community-created variation associated with the meme.

The Guardian’s account spans an Indonesian creator, a French agency representing that creator, a California lawsuit and a character it says was popularized partly in Latin America. That geography shows how a work posted online can acquire cultural and commercial life in many places. It does not mean that one country’s law automatically governs every dispute, or that the rules in Indonesia, France, the EU and the United States are interchangeable. The sources available here do not provide a comparative account of Indonesian, French or EU copyright law.
The EU takedown process and the US litigation should therefore be understood as distinct tracks. The reported success of a request to remove content from a platform does not settle the US copyright question; a US court’s eventual decision, if there is one, would not by itself determine every rights issue in every country.

Why do other creators say the meme belongs to the crowd?
Legal rights and cultural contribution are different things. Video creator Fabian Mosele told the Guardian, “There are a ton of creators who made these characters come to life,” and argued that restricting the character to its original prompter would not feel right. That expresses a community concern about the work of remixers and popularizers; it does not itself establish a legal entitlement.
Mementum co-founder Eben Jeda framed the economic stakes this way: “Brain rot is one of the first highly visible manifestations of a much larger transformation: internet native creativity can now become global almost instantly, while the people who originate it can remain economically invisible.” Content creator Adam Aleksic described meme characters as archetypes that people use to project their own expectations and stories onto them. Both views capture why a meme can feel collectively made even when a particular person claims rights in an original character.
The legal question is narrower than the cultural one. A decision about authorship or a particular commercial use would not erase the contributions of people who spread, adapted or gave the character meaning; conversely, widespread participation alone does not resolve who has rights in specific protected expression.

What is known about the case’s outcome?
The Guardian’s October 6, 2026 report describes the lawsuit and related claims, but the materials available for this article do not establish a final ruling or independently confirm the docket’s present status. They also do not establish the exact causes of action, requested remedies, or current status of any US trademark application or registration. The US Copyright Office’s 2025 announcement separately said it had received more than 10,000 comments as part of its broader AI initiative; that figure is not about this lawsuit or public opinion on Triple T.
For now, the responsible answer to “Who owns Tung Tung Tung Sahur?” is that the reported parties are contesting rights and uses, while the available account does not resolve the claim. The answer to “Who owns brain rot?” is broader still: the genre has no single owner established by this dispute.
