The Income Tax Appellate Tribunal (ITAT) is administratively housed in the Department of Legal Affairs, Ministry of Law and Justice. Its President leads its internal administration and controls how benches are constituted. The Central Government has statutory responsibilities for the tribunal’s constitution and appointments, but those roles do not give a ministry authority to decide the outcome of an individual appeal. Independence is protected by constitutional limits on tribunal design and by judicial review: High Courts may hear ITAT appeals involving a substantial question of law.
Which ministry does the ITAT come under?
The ITAT’s official website identifies it as part of the Department of Legal Affairs, Ministry of Law and Justice, Government of India. That is its administrative home; it does not mean the ministry decides tax appeals. The tribunal hears appeals through its benches.
The distinction matters because “oversight” can mean several things: where an institution is administratively placed, who manages its benches, who appoints its members, or who reviews its decisions. Those functions are not interchangeable.

The ITAT President heads the tribunal’s internal administration. Official tribunal material describes the President as head of department with administrative control over the benches, including authority over their constitution. This is institutional management, not authority to dictate how members decide a particular appeal.
#1 Best Overall
The ITAT website identifies Justice Chandrakant Vasant Bhadang as President and says he assumed charge on 23 October 2023. Leadership can change, so the tribunal’s official site is the appropriate place to check the current officeholder.
What role does the Central Government have?
The Central Government has statutory responsibilities for constituting the tribunal and appointing members. Those powers operate within constitutional requirements for tribunal independence; they should not be read as permission to direct adjudication in a case.

The legal framework has changed. The Income-tax Act, 2025 is the current statutory framework at the date of this article, while section 252 of the Income-tax Act, 1961 is relevant to the prior scheme and transition. The official ITAT site also hosts the Income-tax (Appellate Tribunal) Amendment Rules, 2025, made under section 255(5) of the 1961 Act. The 2025 Act’s official PDF was not accessible in the materials available for this article, so exact current appointment provisions and section numbers are not stated here.

Independence is not established simply by assigning a tribunal to a particular ministry. Appointment arrangements, qualifications, tenure, and service conditions also affect whether a tribunal can decide cases without improper influence—especially where a government department is a party.
In its 19 November 2025 judgment on tribunal reforms, the Supreme Court held that directions in earlier Madras Bar Association cases continue to govern appointments, qualifications, tenure, service conditions, and related matters until constitutional concerns are addressed through appropriate legislation. The judgment also gave the Union four months to establish a National Tribunals Commission as a structural safeguard for independence, transparency, and uniformity. It included a specific direction that service conditions of certain ITAT members appointed in 2021 be governed by the earlier Act and rules. The decision concerns tribunal reforms generally, not only the ITAT.
Quoting paragraph 140 of Rojer Mathew v. South Indian Bank Limited, the Supreme Court’s judgment states: “Independence of the institution refers to sufficient degree of separation from other branches of the government, especially when the branch is a litigant or one of the parties before the tribunal.”
The judgment set a deadline for establishing the Commission; whether it has since been created is not established here. The deadline and direction should not be mistaken for confirmation that the Commission is operational.

Who can review an ITAT decision?
The ITAT’s official material describes its orders as final on questions of fact, with an appeal to a High Court where a substantial question of law arises. High Court review is a judicial route for qualifying legal issues, not a ministry reconsidering the merits of an individual appeal.
Quick Recap
Who does what: a quick distinction
| Function | Responsible authority | What that means |
|---|---|---|
| Administrative placement | Department of Legal Affairs, Ministry of Law and Justice | The ITAT’s stated administrative home. |
| Internal administration and bench constitution | ITAT President | Leads tribunal administration and manages benches; does not decide an appeal by administrative fiat. |
| Constitution and appointments | Central Government, within constitutional constraints | Statutory responsibilities subject to tribunal-independence standards. |
| Review of qualifying legal issues | High Courts | May hear an appeal from an ITAT order when a substantial question of law arises. |
