Usually, the legal property owner—or someone the owner has authorized—can approve contractor work. But approving a project, signing its contract, applying for a permit, making an owner-builder declaration, and being named as the permit holder are separate roles. The right people and paperwork depend on how the property is titled, the project, and state and local rules.

Start with who owns the property

Check the deed or other title record before deciding who can approve work. The owner may be one person, co-owners, a trustee, or a business entity. If someone other than the titled owner will sign or apply for a permit, confirm that person’s authority under the relevant documents and local requirements.

For an agent, use written authorization that identifies the property, the agent, the scope of work, and the acts the agent may perform. A verbal approval may not meet a permit office’s requirements. Forms vary: West Covina, California, for example, calls for a notarized authorization letter when an owner’s agent pulls a permit. California Contractors State License Board materials include an agent authorization form and distinguish it from owner declarations. These are examples, not nationwide forms.

  • Co-owners: Ask the local building department whether all owners must sign the application or provide consent.
  • Trust or entity ownership: Verify who can act for the titled owner. Rancho Palos Verdes, California, gives examples of trust and company documents its office uses to verify authorized signatories.
  • Condominiums: Work affecting shared or exterior areas may also require association approval. Rancho Palos Verdes asks for HOA authorization and meeting minutes for certain such projects; the governing documents and local office determine what applies to your project.

Separate permission to do the work from permit authority

An owner can authorize a contractor to do work without necessarily being the person who should apply for or hold the permit. Ask the local building department who may apply, whose signatures it requires, and who should be identified as permit holder. Then confirm the contractor’s licensing obligations with the relevant state licensing board.

Role or decision What it covers What to verify
Approve the project Consent for the work to proceed on the property. Whether the signer is the titled owner or a properly authorized representative.
Sign the contract Agreement with the contractor about scope, price, and other terms. Whether the signer can bind the owner, and whether the contract identifies who obtains permits.
Apply for the permit Submitting the application and required documents to the permitting authority. Which applicants are eligible and what authorization or license evidence the office requires.
Make an owner-builder declaration Taking on a specific status or responsibility under state rules. Whether the project and arrangement qualify under that state’s law; this is not simply another signature.
Serve as permit holder Being named in the permit record for the permitted work. Who the local authority expects to hold the permit and how that affects accountability.

Local examples show why these roles should not be assumed to be interchangeable. West Covina says a property owner, California-licensed contractor, or an agent for an owner or contractor may pull a permit subject to its paperwork rules. Rancho Palos Verdes also identifies an owner, licensed contractor, or authorized agent. These California city procedures do not establish a national rule.

Arlington County, Virginia, recommends identifying the contractor doing the work as permit holder and warns that enforcement against a contractor can become difficult when the owner is listed instead. Follow your jurisdiction’s instructions, and make sure the contract and permit application accurately state who is doing the work and who is responsible for the permit process. If you rent the house, get the owner’s authority

Being a tenant does not by itself establish authority to approve substantial improvements or apply for a permit. A lease or landlord-tenant law may give a tenant a role in arranging repairs, but that is different from authority to make improvements or act for the owner in a permit application.

West Covina says a tenant may not pull a permit unless acting as an agent for the owner or contractor. That is a local example, not a rule for every U.S. jurisdiction. Check your lease, get the owner’s written authorization where needed, and ask the local building department what it accepts.

Do not treat owner-builder status as a licensing workaround

Owner-builder rules differ by state and may impose conditions involving the owner’s use of the property, supervision, the work itself, or licensing. Taking out a permit as an owner does not automatically make it lawful to hire an unlicensed contractor.

The state statutes illustrate why there is no single national test. South Carolina’s cited owner-improvement exemption expressly does not authorize hiring a person or entity that must be licensed or registered. Florida’s owner-builder provisions also include conditions related to use, supervision, and licensing. Oregon has its own statutory framework. Review the current rules for the project’s state rather than borrowing a rule from another state.

Florida also has a limited permit-exception example in its cited 2026 statute: the provision is value-based, excludes specified trades, and requires a written request and evidence. It is a Florida-specific exception, not a general owner-builder rule; verify the applicable current text and requirements with the permitting authority. See Florida Statutes § 553.79 (2026).

Before work starts, confirm the right people and paperwork

  1. Confirm title. Identify the individual owners, trustee, or entity named in the property records.
  2. Confirm signer authority. If an agent, trustee, officer, partner, or managing member will sign, check the documents that establish authority and ask whether the permit office needs copies.
  3. Define the project. Tell the building department whether it involves ordinary repair, structural work, a regulated trade, a condominium common area, or an owner-builder arrangement.
  4. Ask who may apply and who should hold the permit. Confirm required signatures, authorization forms, licensing evidence, inspections, and any local permit-holder instructions.
  5. Align the permit and contract. Ensure both accurately identify the contractor, the person handling the permit, and each party’s responsibilities.
  6. Check state licensing rules. Verify that the contractor and proposed arrangement comply with the relevant state licensing board’s requirements before work begins.

Because the state and municipality determine many of these details, confirm the current process with your local building department and state licensing board rather than relying on a form or rule from another jurisdiction.
