Business use alone does not make a vehicle expense eligible for GST input tax credit (ITC). Under India’s central GST rules, ITC is generally blocked on passenger vehicles with approved seating capacity of no more than 13 people, including the driver, and on specified insurance, servicing, repair and maintenance costs related to them. Exceptions apply for certain taxable vehicle-related activities. Goods vehicles are not automatically caught by this particular passenger-vehicle restriction, but ordinary ITC conditions and other restrictions still apply.
Start with the vehicle and the activity
Section 17(5) of the Central Goods and Services Tax Act, 2017 blocks certain vehicle-related credits. For the passenger-vehicle restriction, the key threshold is approved seating capacity of not more than 13 persons, including the driver. The vehicle’s classification and the activity for which it is used matter; calling a vehicle a “company car” or recording it as a business asset does not by itself make its GST credit available.
CBIC’s FAQ 127 answers a question about capital expenditure for company use and cautions that a car does not qualify merely because it is used by the company. The detailed statutory exceptions, rather than the short FAQ summary, determine whether a particular vehicle or expense can qualify.

Which vehicle expenses are generally blocked or potentially eligible?
| Expense or arrangement | General treatment | What to check |
|---|---|---|
| Purchase of a covered passenger vehicle | ITC is generally blocked. | Credit may be available if the vehicle is used for one of the specified taxable activities below, subject to section 16 conditions and any required apportionment. See the CGST Act, sections 16 and 17(5). |
| Insurance, servicing, repairs and maintenance for a covered passenger vehicle | Generally blocked when related to a vehicle in the restricted class. | Section 17(5) sets out exceptions for specified vehicle uses and certain manufacturer or insurer cases. Check that the particular service and recipient meet the applicable exception in the Act. |
| Lease, rental or hire of a covered passenger vehicle | Generally blocked under the vehicle-related restriction. | Specified taxable uses and the proviso covering certain outward supplies can change the result. Examine the contract and what the business supplies to customers; a business purpose alone is not enough. The wording is also addressed in CBIC Circular 172/04/2022-GST. |
| Rent-a-cab service | CBIC’s sectoral FAQ gives an unavailable-credit answer as a general summary. | Do not apply that summary without checking the statutory exceptions and the exact service arrangement. See the CBIC Sectoral FAQs and section 17(5) of the Act. |
| Goods vehicle purchase and related costs | Not automatically blocked by the passenger-vehicle restriction. | Confirm the legal classification and actual use, then apply the ordinary ITC conditions, business and exempt-supply apportionment, and any other applicable block. See the Act and CBIC’s Input Tax Credit Rules. |
| Petrol, diesel or other fuel | Do not assume a business vehicle’s fuel costs generate ITC. | Check the tax actually charged and the legal treatment for that fuel and tax period. The sources cited here do not establish the current notification and treatment for every fuel. |
When can ITC be available on a covered passenger vehicle?
The main statutory exceptions concern the vehicle’s use in making a taxable outward supply. The Act identifies these activities:
#1 Best Overall
- TRACK 1,674 TRIPS IN ONE ORGANIZED LOG BOOK — Keep a clear record of your business and personal driving with 128 pages and 1,674 trip entries. Each entry provides space for the date, business purpose, starting and ending odometer readings, and total mileage, making it easy to keep your mileage records organized and easy to review.
- KEEP BUSINESS MILEAGE RECORDS READY FOR TAX TIME — Record the driving information you need throughout the year instead of trying to reconstruct your mileage months later. A dedicated space for business purpose and mileage helps you maintain a consistent written record for your own tax and expense documentation.
- MORE THAN A MILEAGE LOG — KEEP IMPORTANT VEHICLE RECORDS TOGETHER — This all-in-one log book also includes dedicated space for vehicle maintenance records, insurance information, and emergency contacts. Keep essential vehicle information in one convenient place instead of scattered across notes, apps, and paperwork.
- SIMPLE, PRACTICAL FORMAT FOR EVERYDAY DRIVING — Designed for quick, straightforward record keeping without complicated forms or unnecessary details. The 5.8” × 8.3” size gives you plenty of writing space while remaining compact enough for a desk, glove box, work bag, or vehicle organizer.
- A PRACTICAL GIFT FOR DRIVERS & BUSINESS OWNERS — A useful choice for anyone who regularly tracks mileage, including small business owners, independent contractors, sales professionals, delivery drivers, and commuters who need a convenient way to organize vehicle records. The durable format makes it a practical addition to any driver’s everyday essentials.
- Further taxable supply of the vehicle: for example, a business whose taxable outward supply is the sale of vehicles. The vehicle must be used in the qualifying activity, and the normal ITC conditions still apply.
- Taxable passenger transportation: the vehicle is used to provide taxable passenger transport. Ordinary employee or business travel does not, by itself, amount to this activity.
- Imparting driving training: the vehicle is used to provide driving instruction in a qualifying taxable activity.
The associated insurance, servicing, repair and maintenance restrictions have their own statutory wording and exceptions. A vehicle’s qualifying use may matter, as may whether the recipient is a manufacturer or a qualifying insurer. Check the relevant provision rather than assuming every expense connected to an otherwise eligible vehicle is automatically creditable.
How to assess a claim
- Identify the vehicle. Record its design, legal classification and approved seating capacity, including the driver. Do not rely on an informal label such as “commercial vehicle.” CBIC’s Sectoral FAQs discuss earth-moving machinery and note that tippers and dumpers may not fall within the Motor Vehicles Act definition cited there; that example should not be generalized to every specialized vehicle.
- Identify the outward activity. If the vehicle falls within the passenger-vehicle restriction, determine whether it is used for further taxable supply of the vehicle, taxable passenger transportation or driving training. General business travel is not one of those listed activities.
- Classify each related charge. Separate the vehicle purchase from insurance, servicing, repairs, maintenance, leasing, rental or cab services. Check the exact statutory restriction and exception for each type of charge, as well as the contract and the outward supply involved.
- Check the ordinary ITC conditions. Section 16 of the CGST Act requires, among other things, business use or intended business use, prescribed invoice or debit-note documentation, receipt of the goods or services, supplier-furnished invoice details being communicated, payment of the tax to government, and filing of the return. Applicable timing limits and other statutory conditions also need to be met.
- Apportion and screen for other restrictions. Credit must be restricted for non-business use and exempt supplies. Check other section 17(5) blocks as well, including goods or services used for personal consumption and purchases on which tax was paid under the composition scheme. CBIC’s Input Tax Credit Rules address attribution where inputs or capital goods are used for both business and non-business purposes.
Mixed use, exempt supplies and goods vehicles
Even where a particular vehicle or expense is not caught by the passenger-vehicle block, eligibility is not automatic. Sections 17(1) and 17(2) limit credit to the portion attributable to business use and taxable or zero-rated supplies. Where use or outputs are mixed, calculate and document the eligible share under the applicable rules rather than claiming the full amount by default. The Act and CBIC’s ITC Rules are the relevant starting points.

A goods vehicle is not automatically blocked by the passenger-vehicle rule, but classification can be fact-specific, especially for specialized equipment. Confirm what the vehicle is under the applicable legal definition and how it is used; then test the invoice, business purpose, taxable or exempt outputs and other blocked-credit rules.
