The clearest places to obtain a legal game download are the rights holder’s official store, an explicitly licensed re-release, or the game developer’s own page when it grants permission for that specific file. A ROM is simply a game file; the label does not establish that downloading or sharing it is authorized. For Nintendo games, Nintendo identifies its eShop and website as official download channels and calls third-party ROM copies unauthorized.
Where to get game files with permission
Official storefronts and licensed re-releases
Start with the publisher or rights holder’s current store, or a re-release that is clearly licensed. Nintendo says authentic games can be purchased for download through the Nintendo eShop or Nintendo website; it describes copies hosted by third parties or shared through peer-to-peer services as unauthorized. Store catalogs change by title, region, and date, so check the live listing rather than assuming a particular old game is still available.
A licensed collection can be a legitimate way to play older games, including on physical media, but it may not include a standalone ROM file. Treat it as a ROM source only if the product explicitly provides authorized game files for download and the intended use.

Some developers make original games for older systems available to download. Check the individual game’s creator and license for permission to download, use, modify, or redistribute the file; “homebrew,” “free,” and “downloadable” are not licenses by themselves. CRT Play’s terms of service, last updated June 2026, say hosted games are original or open-source works submitted by rights holders or with permission, and that each title has its own license. That platform policy does not establish the terms for games elsewhere—or replace checking the license for the specific title.

Does owning the cartridge make downloading a ROM legal?
Do not assume that buying or owning a physical copy gives you permission to download a copy from an unrelated website. Nintendo Australia states that its position applies even when someone owns the authentic game. That is Nintendo’s regional position on its games, not a complete statement of the law in every country; copyright and anti-circumvention rules depend on jurisdiction.
For a particular game, look for a current page from its rights holder or developer that identifies the file and says what uses are permitted. An archive’s reputation, a game’s age, or its being labeled “abandonware” does not establish authorization.

Do preservation exceptions let the public download ROMs?
No general public download right follows from the U.S. preservation rules discussed here. Under 37 CFR 201.40, specified acts may be permitted for qualifying libraries, archives, or museums under conditions. For some covered circumstances, the regulation requires lawful acquisition, limits the purpose, and prevents preserved games from being made available outside the institution’s physical premises.
The Library of Congress notes that preserving software and video games may require the proprietary console or a virtual or emulated version. That describes preservation needs; it does not authorize public distribution of game files. These rules are U.S.-specific and should not be treated as a worldwide legal standard.

How to assess a claimed legal ROM source
- Identify who controls the rights. Prefer a page maintained by the publisher, rights holder, or game developer.
- Confirm permission for the exact file. Check that the authorization covers downloading that game file, not merely playing a licensed release or using a hosting platform.
- Match permission to your intended use. A license may permit personal play but not redistribution, modification, or commercial use.
- Check your jurisdiction. Copyright and anti-circumvention rules vary. A U.S. institutional preservation exception or a Nintendo Australia statement does not settle every country’s law.
- Distinguish a playable re-release from a ROM download. A licensed collection may let you play a game without granting or supplying a standalone file.
- Do not infer permission from a preservation claim. A preservation mission, an old game, or commercial unavailability alone does not show that a particular download is authorized.
ROM legality and emulator legality are separate questions
Whether a particular emulator is lawful and whether a particular game file may be downloaded or shared are distinct issues. The sources cited here address authorized game distribution and limited preservation permissions; they do not establish a universal legal answer for every emulator or copying method. Evaluate the game file’s authorization separately.
